- I Moses Purnell of Matthew of Worcester County, MD, being of sound and disposing mind . . . FIRST - I give to my son Theodore Moses Purnell the farm in Quepongo on which I formerly resided being all the land conveyed to me by William Hammand of William Senior called Purnells Industry, Purnells Security and Addition to Sherburne or Sherbin or by whatever name the same may be known or called being the same lands which were formerly owned by Milby Purnell dec'd. Also all of the lands which were reconveyed to mey by John Reed and Thomas Purnell of Milby and the wives as the heirs of Mary Marshall, wife of William A. Marshall dec'd called Purnells Industry, Purnells Security and Addition to Sherbourne or Sherbin, to him the said Theodore Moses Purnell. But it is my will and devise that if Theodore Moses Purnell should die without lawful issue of his body living at the time of his death, then to my sons William Henry Purnell and Levi Matthew Purnell to be held in joint tenancy. Also to my son Theodore Moses Purnell I give my Negro man named Charles and a Negro girl called Sarah (daughter of Mary) and a colt called Victoria and one bed and furniture. ITEM 2 - I give to my son Levi Matthew Purnell all the land s called Purnells Security and Purnells Industry or by whatever name they may be called being the same lands upon which my father Matthews Purnell resided at the time of his death and devised by him to my brother Levi, also 60 acres of land of Cypress Swamp which was conveyed to my by my brother Levi Purnell, also all of the tract of land on River Swamp purchased by Milby Purnell of Abel Teackle and Mary his wife on 24 January 1805 and conveyed to me by Thomas D. Purnell trustee of the said Milby Purnell, also all of the tract of land called Living Twisted Boggy or by whatever name the same by be known purchased by mother Mary Townsend of Solomon Bradford and by her devised to me lying on the east side of the Ninepin Branch Bridge to him the said Levi Matthew Purnell. But it is my will that if Levi Matthew Purnell die without lawful issue of his body I do give the said lands to my son Theodore Moses Purnell and my daughter Josephine E.M. Purnell to be held in joint tenancy. I likewise give to my son Levi Matthew Purnell one Negro boy named Harry and one Negro woman named Sarah (daughter of Beck), also one half dozen table spoons and one half dozen tea spoons and one bead and furniture. ITEM 3 - I give to my son Daniel M. Purnell all the lands which were willed to me by my father Matthew Purnell in his will called Addition to Sherbourne or Sherbin containing 100 acres of land during his natural life and after his death I give the said land to my daughter Evenim Sarah Purnell. ITEM 4 - I give to my daughter Evenim Sarah Pitts all of the land which were conveyed to me by deed from Zederiah Hammand and wife by whatever name it may be called. ITEM 5 - I give to my daughter Josephine E.M. Purnell my Negro woman Mary and her children Olive, Seah, Jacob, Ana, George and a Negro girl Charlotte (daughter of Hetty). Also to my said daughter Josephine one bed and furniture, one Piano Feste(?), . . . ITEM 6 - I give to my wife Maria Purnell the house and lot whereon I now live near the town of Berlin and conveyed to me by deed from Thomas Timmons and Mary E. Timmons his wife, during her natural life and after her death to my daughter Josephine E.M. Purnell and if my daughter dies without lawful issue then the house and lot to my sons William Henry Purnell and Levi Matthew Purnell to be held in joint tenancy. Also to my wife Maria Purnell one Negro man named Abel and a Negro woman named Hetty, two beds and furniture, one pair of mahogany tables, . . . ITEM 7 - I give to my granddaughter Maria Virginia Purnell Handy one Negro girl Lucinda, daughter of Hetty. ITEM 8 - I give to my son William Henry Purnell one Negro girl Maria, daughter of Mary, and one bed and furniture. ITEM 9 - It is my will that the Sixth Item of this will shall be observed provided by wife Maria Purnell shall relinquish her right of dower in the land herein devised to my son Damiel M. Purnell and my daughter Evenim S. Pitts, otherwise not. Lastly I do hereby appoint my son William Henry Purnell to be Sole Executor. Codicil - Since the making of my will my son Levi Matthew Purnell is dead without heirs I now give to my youngest son Charles born since the death of my son Levi all the lands devised to my son Levi. But if my son Charles should die without issue then to my son Theodore and my daughter Josephine in joint tenancy. And to son Charles the Negro woman named Sarah given to my son Levi since deceased and if Charles should die without issue then to my grandson Moses Purnell Handy. ITEM - To my son Theodore the Negro boy named Harry given to my son Levi since deceased and if Theodore dies without issue the said Negro boy to my daughter Evenim S. Pitts. ITEM - To my wife Maria Purnell the tract of Weva land near the town of Berlin containing about 15 & a half acres called Narrowgate or by whatever name it may go by being the tract conveyed to me by deed from Robert Franklin and wife since the making of my will and not disposed of therein, to her the said Maria during her natural life and then to my daughter Josephine and if Josephine should die without issue than to go with the house and lot mentioned in ITEM 6 of my will. In case my daughter Josephine shall died without issue I give the respective Negroes given to her in ITEM 5 to my sons William and Theodore Moses. - On 19 April 1859 in Worcester County William H. Purnell made oath that this was the last will and testament of Moses Purnell late of Worcester County deceased. On 19 April 1859 John C. Dirickson, Zadok P. Henry and Josiah M. Marshall the three subscribing witnesses made oath that this was the will of the testator therein named and they also saw him sign the Codicil. Maria B. Purnell, widow of Moses Purnell late of Worcester County deceased, did renounce and quit all claim to any bequest or devise made to me by the last will and testament of my husband, exhibited and proved according to law and I expect to take in lieu thereof my dower or legal share of the estate of my said husband.
