  	Ordered that Richard Whitmarsh upon his humble petition be remitted of his fine laid upon him in May court last, except 300 lbs tobacco which is to be paid upon demand with costs of the suit.

  	William Walton sold as 158 acres to Richard Whitmarsh. It was the south part of the neck on the branch separating from N20. This deed was recorded 31 Dec 1669.

  	Richard Whitmarsh patented 458 acres to include the Thomas Gaskins 300 acre patent and the 158 he bought from William Walton. This land was patented to John Custis in 1689 as having been deserted by Whitmarsh. The patent was reissued the next year. In 1691 John & Tabitha Custis sold it all to Joseph Benthall.

  	Captain Argoll Yardley sold 550 of this tract to Richard Whitmarsh and three years later he assigned to Agnes Powell, widow. In 1684, she deeded it all to her son John. In 1702 John Powell (wife Frances Stratton) left the north 200 acres to his son Nathaniel and 350 acres balance to his son Nicholas.

Itt is therefore ordered by the Court That the said Whitmarsh forthwith deliver unto the said Lt Coll Waters or whome hee shall appoint all the clothes wch appertained or belonged to the said Eliz: Smith the said Lt Coll Waters paying him the said Whitmarsh, one hundred pounds of Tobacco for her Coffin out of the Estate hee hath in his hands That belonged to the said Elizabeth Smith. Whereas Eliz: Smith & Mary Smith the orphts lately in the Tuition of Lt Coll Waters are decd & have left in the said Waters his Custody a Small Estate. The Court doth request the said Waters & Major Wm Andrews to make devision as equally as may bee of the said Estate and to deliver it soe devided, one moiety to Mrs Anne Mellinge widow for the use of theirs the said Elizabeth and & [sic] Mary Smiths Brother Wm Smith orpht And ye other moiety to Mrs Agnes Powell widow for the use of their sister Agnes Smith orpht & upon receipt of the same the said widowes to give under their hands to bee accomptable to the said orphts when they come to age.
