- That Benjamin Floyd, the elder, being seized as of fee of and in a certain tract of land containing by estimation 150 acres, of which the lands in the declaration mentioned are a part, with the water grist mill in the said declaration mentioned, lying in the Parish of St. George and County of Accomack, and having three children, to-wit: Elizabeth, one of the lessors of the plaintiff, by one venter, also Benjamin and Polly Floyd by a second venter, and being so seized on the 20 Nov. 1801 made his last will & testament, and afterwards, to-wit: on the ____ day of ____ 1802, the said Benjamin Floyd the elder departed this life leaving the said will in full force, which said will was probated 27 Dec. 1802; that by virtue of the said will the said Benjamin Floyd the younger, and devisee of the said lands and mill in the said will mentioned, immediately after the death of the said Benjamin the elder, entered into the said lands and mill and became seized thereof and being so seized on the ____ day of ____ 1803 departed this life an infant, under age and without issue, and leaving Elizabeth, the lessor of the plaintiff, his sister of the half blood on the part of his said father, and the defendant his sister of the whole blood, and his mother a certain Molly Floyd, &c.

- In his will Dickie Dunton gave to son Elias Dunton two hundred acres of land more or less lying to the eastward of the road where I now live. My will and desire is that all my lands not before given lying to the westward of the road where Mr. Isaac Bratten now lives should be sold and the money arising from the sale of the land to be equally divided between my children; Peggy Garrison Dunton, Benjamin Floyd Dunton, Suckey Gascoins Dunton, Henry Gascoins Dunton and the child that my wife is now pregnant with and my loving wife Molley Dunton to have an equal part with my children above mentioned in lieu of her dower on the said land. My will and desire is that my Negro man Kent shall be free and at his own Liberty. I appoint my friend Arthur R. Savage and my son Elias Dunton my executors.
