My Exrs. to have power to sell 1500 acres of the land at Mossongo which I bought of Richard Lee, being in all 2500 acres, not to sell the part lying on the Creek, but to dispose of the back part, & the remaining 1000 acres I give to my 2 sons Spencer & William. - Thomas Bayley & Anne his wife vs. Anne Buncle &c., a suit for recovery of land. That Richard Drummond the elder, formerly of the county aforesaid, dec., grandfather of your oratrix, was in his lifetime seized and possessed of a very considerable quantity of land and personal estate; that the said Richard Drummond made his last will and testament dated the ____ day of ____ 1730, and appointed his wife, the respondent Anne Buncle executrix, Capt. Hancock Nicless and his son Richard Drummond executors, and soon afterwards died so thereof seized and possessed, leaving issue at his death the aforesaid Richard the younger his eldest son and heir at law, father of your oratrix, whom he appointed one of his executors aforesaid, also George, William, Spencer, Elizabeth & Ann Drummond; that the aforesaid Ann, executrix, and the aforesaid Hancock & Richard, executors under the aforesaid will, proved the same &c. That the said Richard the elder died seized of 1500 acres on Mesongo Creek in the county aforesaid, and by his last will and testament empowered his executors to dispose of the same for the payment of his debts; that 300 acres of said land sold by the executors, together with the personal estate of the testator, was more than sufficient to discharge the testator's debts; that Richard Drummond the younger after the settlement of his father's estate died leaving issue your oratrix, and another daughter called Elitia, who is since dead an infant and without issue; that Elizabeth, one of the daughters of the aforesaid Richard the elder, is also dead intestate and without issue; that the other daughter, Ann, is married to your respondent John Selby; that after the death of the aforesaid Richard the younger, father of your oratrix, who died on the ____ day of ____, and after the death of Hancock Nicless on the ____ day of ____, the said Ann Buncle, the respondent, then remaining sole executrix of the will of the aforesaid Richard the elder, under pretense that the personal estate of her former husband, Richard the elder, was sufficient to satisfy his debts, although she well knew to the contrary as the same were already satisfied and paid &c., did expose for sale the residue of the aforesaid 1500 acres, and it was so proceeded that Spencer Drummond aforesaid, now deceased, father of the respondents Betty, Spencer, Charles, Richard, Sarah & Ann Drummond, Jr., became the nominal purchaser thereof, to whom the said Ann Buncle as executrix conveyed the same. That the said Spencer Drummond departed this life _____ as appears from the probate of his will, seized of the whole residue of the aforesaid 1500 acres; that soon after his decease the aforesaid George Drummond, dec., and the respondent William Drummond, by a suit in chancery commenced against the respondents Betty, Spencer, Charles, Richard, Sarah & Anne Drummond, Jr., devisees under the will of the said Spencer Drummond, dec., obtained a decree against the devisees under the will of the aforesaid Spencer, dec., that they should convey 1/3 of the said residue to the said George & William; that after the making of the said decree, which was on the 28 Nov. 1764, the Respondent, John Selby, who intermarried with the aforesaid Anne, one of the daughters of Richard Drummond, the elder, complained of the fraudulent practice above set forth ---- to quiet which complaint the said George and William made their joint deed bearing date 6 March, 1765, conveying to the said John Selby 249 acres of the said land. That soon after the said George Drummond made his will dated 9 May, 1765, and devised all his interest in the Mosongo land to his daughter, the respondent Anne Drummond, and soon after departed this life. The joint and separate answers of Edmund Custis, who very lately intermarried with the defendant Elizabeth, to the bill of complaint of Thomas Bailey & Ann, his wife; That the residue of the 1500 acres so conveyed to the said Spencer Drummond was to be equally divided between the said Spencer and his brothers, William and George, but that the death of the said Spencer prevented the necessary conveyances being executed, by which means the said George and William were put to their suit in equity against his children and devisees to compell a conveyance agreeable to contract, after which the said John Selby, who intermarried with Anne, claimed in right of his wife her part of the residue of the said 1500 acres, which the said George and William by their joint deed dated 6 Mar. 1765 conveyed to him; That the said William by his will devised his part of said land to one of his sons, but that his sons died without issue at the same time with their father, they all being unfortunately drowned together, all the testator's land descended to the defendant Elizabeth and her sister, Sarah, and that part of the said 1500 acres conveyed to him was allotted to the said Elizabeth - (Answer dated 27 Sept. 1782) The joint and separate answers of Henry Wilkins and Ann, his wife, defendants, to the bill of complaint of Thomas Bailey and Ann, his wife - That the said George Drummond made his last will and testament bearing date the 9 May 1765, and thereby devised all his interest in the Mesongo land to his daughter Ann, the defendant, and soon after departed this life &c. - (Answer dated 23 Sept. 1782) Deposition of John Drummond, age 20 years and upwards. Land surveyed and divided, and Thomas Bayly & Ann, his wife, put in possession of 450 acres of the aforesaid land, being for his full fifth part of the aforesaid land recovered, and for all the land which belonged to the aforesaid John Selby & Ann, his wife, as their share of the aforesaid land, the same being now conveyed to the said Thomas Bayly, &c.
