- The will of Isaac Avery of Norfolk - (ITEM) I give to my eldest son Isaac Waightstil Avery and his heirs forever all that part of my land in Warwick County which lies between the County road and James River. (ITEM) I give to my son James Avery and his heirs forever all the remaining part of my land in Warwick County, be the same more or less. (ITEM) I give to my loving wife Polly Avery and her heirs forever the following slaves to wit: Dick, Frank, Guy, Robin, Amey & Hannah. (ITEM) I give unto my four children Isaac Waightsil Avery, James Avery, Peggy Stringer Avery and Betsy Avery & their heirs forever to be equally divided among them, the following slaves to wit: Jacob, Adam, Peter, Will, Sam, Isaac, Comfort, Mary, Rose, Linder, Leah & Beck. (ITEM) I give to my said daughters, Peggy Stringer Avery and Betsy Avery, to be equally divided between them all the remaining part of my estate of every kind. (ITEM) It is my meaning and desire that the devise of slaves here made to my wife, them to her dower as to my slaves only, and not as to my land or personal estate, slaves excepted. It is my desire that my Extr herein after named, shall sell off my personal estate, slaves excepted, immediately after my demise for ready cash. (ITEM) I leave the guardianship, person and property of my said son Isaac Waightstil Avery, to my dear friend Major Thomas Parker of Accomack. (ITEM) I leave the guardianship of my said son James Avery, person & property to my dear brother-in-law, Isaac Dolby. (ITEM) I leave the guardianship of my said daughter Peggy Stringer Avery, to my dear friend Mr. Archibald Godwin. (ITEM) I leave the guardianship of my said daughter Betsy Avery, person & property to my dear brother-in-law, Mr. John Stringer Senr of Accomack. (ITEM) I do appoint the said John Stringer Senr sole Extr to this my last will & testament. And I also appoint Thomas Newton Junr, Esq. of Norfolk, a Trustee to the same.
In testimony where of I have hereunto set my hand & affixed my seal, to this my last will and testament, written in my own well known handwriting & dated this 8 August 1799. Signed Isaac Avery. Witt: Archibald Godwin, Caty Parker, George Boggs, John Stringer Senr.
Norfolk Borough - At a Hustings Court continued and held 24 December 1799. The last will and testament of Isaac Avery dec'd, was proved by the oath of Caty Parker and George Boggs, two of the witnesses thereto, and ordered to be recorded. And on the motion of John Stringer Senr, Extr therein named, who made oath and together with John Stratton and George Boggs his security, entered into and acknowledged their bond in the penalty of $10,000, condition as the law directs, certificate is granted him for obtaining probate in due form.

- To wife Elizabeth Parker the use of my estate to educate & maintain my children in lieu of dower. At the death of my wife my property to my children. Wife Elizabeth Parker & brothers George Parker, John A. Parker & Jacob G. Parker Extrs. & guardians to my children. Codicil: 14 May 1808 - When any of my children arrives to lawful age or marry, they should receive such part of their estate as can be paid conveniently. Codicil: 22 Sep 1815 - I hereby revoke that part of this will which appoints my brothers Extrs. & now appoint my sons William A. & James M. Parker Extrs. Prob: There being no witnesses the will was proved by the oaths of William R. Custis, John C. Parramore & Joseph Ames who testified to the handwriting of Thomas Parker with Peter Hack Jr., John C. Parramore & Theodore W. Adair securities on the $40,000 bond. His will was proved 27 Dec 1819.
