  	Wife Sally Bayne & son William D. Bayne Extrs. To son William D. Bayne all the lands on the west part of the plantation whereon I now live containing the water grist mill & running up Smith's Branch & adjoining the land of the heirs of William Williams. To son John Bayne land I bought of Ann Foreman containing 191 acres. To son Walter Drummond Bayne land I purchased of Jabez Pitts containing 140 acres & the land I purchased of Joseph Waggaman containing 200 acres. To son Collin Scarburgh Bayne the lands I purchased of John Gootee containing 227 acres. To daughter Elizabeth Bayne all the lands I bought of Isaac Boston & 100 acres I bought of Joseph Powell. To son George Washington Bayne the lands I bought of Holden's heirs & also the land I bought of Henry Selby both containing 190 acres. If either of my young children die under age or without issue, then the whole of my plantation where I now live to son William D. Bayne & if William dies, then to son Walter D. Bayne & Walter's property to my other children. The remainder of the land I now live on not before devised to William D. Bayne containing the field east of Smith's Branch & wood land between that & the road containing all to northeast of the land devised to William D. Bayne to sons Collin Bayne & George W. Bayne. To wife Sally Bayne … & 1/3 of all my land except the Messongo lands & 1/3 of my personal estate & Negroes. Residue to my sons William, John, Walter, Collin, George & my daughter Elizabeth Bayne. During the minority of my children, my wife continuing my widow, shall have the profits of all the under age children's estates for the purpose of boarding, clothing & schooling them. If my wife marries, then the property of the younger children to be hired or rented out & the money put in interest. Witt: George Corbin, John Henderson, William McMaster & Henry Selby.

  	Dennis Kelly, by Thomas M. Bayly, his attorney, sued out of the Clerk's Office of the Court of this County his summons in partition against Sally Bayne & Betsy Bayne & William R. Taylor and Bridget his wife, in right of said wife, Southy Bull & Susanna his wife, in right of said wife, Nancy Garrett, Elisha Garrett, Charles Garrett, Samuel Garrett & Sally Garrett, heirs of Elisha Garrett, dec., who together and undivided hold a tract of land in the County of Accomack, containing 175 acres, to make partition thereof &c. One moiety or one half thereof and 1/4 of one moiety doth belong to the said plaintiff, and 3/4 of the other moiety doth belong to the said defendants; that the said defendants do not permit division, although the said Dennis Kelly is entitled to one moiety & 1/4 of one moiety of the said lands by virtue of a decree of Accomack County Court 2 Apr. 1812 wherein John Custis & William Robinson Custis were plaintiffs & William Nock & Agnes Nock & Lucretia Nock, children and heirs of Elizabeth Nock, were defendants, the said land being sold according to the said decree, & the said Dennis Kelly being the purchaser of the said land being recovered by the said William Nock & Elizabeth his wife against Joseph Powell in the District Court of Accomack & Northampton on the 17 Oct. 1808; Sally Bayne appointed guardian to the infant defendant Betsy Bayne, & John Bull guardian to the other infant defendants for the purpose of defending this suit. Surveyors report: 14 Jan. 1813 - A certain tract of land containing 173 3/4 acres situate near Pocomoke in the county aforesaid, heretofore belonging to Joseph Powell & by him sold to Walter Bayne, Esq., & Elisha Garrett, both now dec., and from whom, or their heirs, William Nock & Elizabeth his wife afterwards recovered 1/2 & 1/4 of 1/2 in an undivided state, which interest of the said William Nock & Elizabeth his wife in the said lands they afterwards mortgaged to John Custis & William R. Custis, who afterwards obtained a decree of foreclosure & sale thereon, at the sale of which Dennis Kelly became the purchaser, &c.
