  	Charles Snead Sr. vs. Robert Drummond, a suit for recovery of a slave. That a certain William Burton formerly of Accomack County, now dec., having a daughter then married to a certain John West, made his last will and testament in which he devised a number of slaves to his said daughter for life then to be equally divided between all her children; that the said Agnes West had nine children, one of whom named Katharine intermarried in her mother's lifetime with a certain Edmund Chambers and died before her mother and before any division could be made of said slaves; that after the death of the said Agnes the said Edmund Chambers obtained administration on the estate of his said wife, who was one of the said nine children, and a division was made among the complainants under the said Burton's will after a long and tedious litigation, and a slave named Lazar was alotted to the representative of the said Edmund's deceased wife without determining whether the right to the said slave vested in the son or the administrator of the deceased, as also the sum of 21 £ 16 s. and 8d for the proportion of the rent of the said slaves with interest from 23 Nov. 1766; that in consequence of the said partition and administration the said Edmund obtained possession of the said slave sometime in the year 1767 and sold him to your orator for a valuable consideration; that the said Snead held the said slave until sometime in the beginning of the year 1768 when he was spirited away and seduced from his service by Major Chambers, the son and heir of the said Catherine Chambers, one of the nine children aforesaid, and by a certain Jonathan Willett, and by them, after the said Willett had kept him in possession ____ years sold to the respondent &c. Catherine Chambers left at her death Major Chambers, her only son and heir at law, and a daughter Agnes. The defendant in his answer denies that the said Edmund Chambers had any right to any part of the slaves devised by William Burton, but only in right of his son, Major Chambers, one of the defendants; and that this will appear evident from a suit in chancery commenced in this Court by Jonathan Willet and Agnes, his wife, Garrat Topping and Scarburgh, his wife, Charles Crowson and Comfort, his wife, and Major West then plaintiffs vs. John West, Smith Bunting, Major Chambers, one of the present defendants, Thomas Goffigon & George Scott then defendants, in which it was decreed that the slaves devised to the said Agnes should be equally divided between the parties plaintiff and defendant, children and grandchildren of the said Agnes. Decreed that the plaintiff, Charles Snead, was a fair purchaser of Edmund Chambers whose property the said slave was, and that he recover the said slave Lazor of the defendant (Jonathan Willett m. Agnes West, Charles Crowson m. Comfort West, Garret Topping m. Scarburgh West, George Scott m. Susanna West, Thomas Goffigon m. Elizabeth West, Smith Bunting m. Anne West, Edmund Chambers m.   	Albert James Willett Jr. in his book Poquoson Families III shows that there were 2 Garrett Toppings in Accomack Co, VA. The elder Garrett Topping (1734-1772) married Scarburgh West about 1755 and died in 1772 and his son Garrett Topping (1757-1817) married Scarburgh Snead 22 Mar 1785. The Accomack County Order Books of this time period, abstracted by JoAnn Riley McKey, with an every name index, were searched and there was no mention of a Garrett Topping Sr and a Garrett Topping Jr and no mention of a Garrett Topping dieing in 1772. So until proof of the 1772 death is found, it is assumed that there was only one Garrett Topping in Accomack Co, VA who married 1st Scarburgh West and 2nd Scarburgh Snead, as shown in AP&P, 4th Ed, by John F. Dorman.

It was bounded on the North by Market Street, on the East by Noah Belote lotts, on the South by Queen's Street and on the West by lotts of William Wise, formerly property of Elizabeth Guy. And they further certify that said Garret Topping hath errected such buildings on the said lott as are required by law to secure the possession & fee simple estate. Witt: Wm. Snead, Tully Snead & Wm. Satchell Junr. According to Whitelaw this was Lot No. 10 in Onancock.

  	Bennett Scarburgh & George Scarburgh, heirs & devisees of Henry Scarburgh dec'd, both of St. George Parish, Accomack Co, sell 150 acres for £195 Virginia money to Garret Topping of the same place the following tract of land in aforesaid Parish & Co bounded on the North East corner by George Teackle, Northeasterly by Henry Custis, Northwesterly by Henry Custis & William Finney; on the Westerly by William Finney & heirs of George Holden dec'd, being part of a larger tract whereof the aforesaid Henry Scarburgh died seized. Witt: John Wise, Tully Snead & Zero Rodgers. According to Whitelaw Garret Topping bought 150 acres (part of Whitelaw's tract A54) from Bennett & George Scarburgh, who left 75 acres each to his sons John S. and Nathaniel S., the later to get "the mannor part of my plantation." The house (Whitelaw's A54E) was known both as the Topping Place and the Dahl's Swamp House. The quaint little house stands well back in the swamp, and it must have been built by Garret Topping soon after his purchase in 1792.

  	According to Whitelaw, in 1812 Garret Topping's widow Anne Topping exchanged Lot No. 10 in Onancock for land elsewhere with Patience Laylor and Elizabeth Jacob, and 2 years later Levin and Patience Laylor sold their interest to James Ashmead, who had married Elizabeth Jacob. The deed stated it was the lot "whereon the tavern is now kept," so if it happend to have been at the east end fo the lot, it would have been approximately where Taylor's Inn is now operated (1953). (NOTE: Whitelaw must have been mistaken on this Anne Topping being Garret's widow, as Garret was found about 5 years later freeing a slave. The deed showed that she was exchanging her dower rights, but it did not show her as a widow of Garret Topping.)
