- George Goodright” (lessee of John West) sued Betty Jenkins (guardian Gavin Sill) for land. The jury found that: –on 23 Dec 1650, John West’s grandfather John West was granted 1600 acres, part of which was in question; –on 6 Feb 1702/03, West, in his will, gave his son Anthony’s daughters (Matilda, Mary Scarburgh and Jean) land where Anthony lived; –Jean’s part was the land in question; –John West (the plaintiff’s lessor) is grandson and heir of the elder West; –Jean died about a year before this suit; Nathaniel Rodgers married Jean and on 16 Sep 1722, they sold the land (100 acres) to John Jenkins, whose granddaughter Betty Jenkins was heir; –the land was in her possession by her guardian, Gavin Sill; –the Jenkins had possessed the land since the purchase. The jury asked the court’s advice. If the law favored the plaintiff, he would be awarded one shilling for the trespass. Judgment would pass next court.
