  	Jacob Rogers and his wife Matilda brought action for damages of 5 pounds 4 shillings money of Virginia against John Hall,who pleaded “not assumpsit.” After a jurywas impaneled and heard both sides of the dispute, itwas agreed that juror Tho. Simson, Jr., be withdrawn; now the matter was put to the court, which allowed Hall to deny the charges. Hall swore that he had not borrowed the money in question, but had received it as part of a debt due to him from Matilda. Hall’s attorney asked that the suit be dismissed, which the court did. The plaintiffs were to pay the cost of the suit.

  	Mary Margretta Hack was granted her motion to file a declaration against Jacob Rogers (who was present in court) and his wife Matilda (executrix of the will of Peter Hack, deceased) for a debt of 15 pounds sterling due by a bill signed by Peter Hack. Mary Margretta’s attorney (Francis Allen) filed the declaration and she swore that she had been paid no part of the debt. Simon Michael swore that he saw the deceased sign the bill; he also swore that Hill Drumond signed the document as a witness. The court considered thematter and decided that Jacob Rogers and his wifeMatilda should immediately pay the full debt from Peter Hack’s estate as well as the cost of the suit and the fees of one attorney.
