  	These are to authorize John Pott or whom he shall lawfully depute to drive away and possess forever with the increase these cattle undernamed now being upon the plantation which Mr. John Neale lives on which cattle belonged to Mr. Thomas Deacon and Company (Viz.) One black cow with a hole in her ear, ready to calve, one black heifer which hath not as yet calved, with one cow calf about four months old, which three above female cattle I am to receive the like for at Harropp near Martins Hundred, from Capt.   	William Whitby arrived in Virginia sometime prior to 1642, when he took office as Burgess, representing Warwick County. He was returned to the assembly in 1644 and served from 1652 to 1655. During the 1640s he also was a Warwick County Justice. He owned some land near the mouth of Waters Creek. During the 1640s he invested in some property at the head of Tindall's Creek, acreage near Gloucester Point that and he and George Ludlow had bought from Argoll Yeardley. In May 1646 Whitby confirmed the sale of the Gloucester property to Richard Lee. In July 1653, while Whitby was representing Warwick County in the assembly, he replaced Walter Chiles I as speaker. As time when on, patented literally thousands of acres of land in Warwick County, on the Middle Peninsula and in the Northern Neck. In 1653 he witnessed a document acknowledging that Sir William Berkeley and his wife, Lady Frances, had received 26 oxen from Colonel Francis Yeardley of Lower Norfolk County. A March 30, 1655, land transaction reveals that William Whitby I had rented a row house in urban Jamestown, part of a three-bay brick structure that Sir William Berkeley had built in the capital city around 1645. Although it is uncertain when Whitby began leasing the property and when he ceased, it probably was during the Commonwealth government was in power and he was serving in the assembly. Whitby died sometime prior to April 1670, leaving a widow, Katherine, and a teenage son, William II. On May 26, 1671, Katherine Whitby was sued by Theophilus Hone of Jamestown.

  	Letter from Francis Pott in London, to nephew John Pott in Northampton Co, VA (recorded in court records) - To: Loving Cousin &c., nephew John Pott - I am in the saddest condition ever I was in, since I [illegible] man, by being disappointed of money that Mr. Nuthall promised me so faithfully at his going away from Accomack. Therefore, my request & advice unto you is that you provide for all things necessary for my people & plantation at the best hand you can, I being altogether unprovided to bring in supply; my Cousin Menefye have paid 116 pounds sterling for me; for which is bound over for her security my three Negroes, Manuell & his wife & Bashawe; with 16 of my best cattle; all which (if it come to be demanded) of you, I would have you immediately to deliver without any suite or contention they being first appraised: (or satisfaction to the value either in tobacco or any other goods or lands; that I have, reserving my said Negroes or what you can of them; for I had rather part with anything, or all that I have, besides, then with my Negroes; I hope that before my coming over, that I may compose the business into tobacco: or other ways which (if I should) I hope you & Mr. Cockitt will be careful to get in my debts of Mr. Whitby, Mr. Jones & others. I left all my bills with Mr. Wilkinson, minister, & Mr. Cockitt; I shall not need further to enlarge in this; but by your next ship you may either expect me (or more ample directions concerning all other matters.) Till then & ever while I remain your constant loving uncle, Francis Pott. Signed in London, 10 Oct 1646. Read more - of my cousin Mrs. Mary Menefye, 4 pounds sterling which makes 120 to be paid as aforesaid. Witness my hand, recorded per me Francis Pott.

  	Whereas Jno Pott (Attorney of Capt Francis Pott) has petitioned this court for judgment upon an order granted last court against Antho: Hoskins for 800 lbs tobacco (in case of a "nihill dicit") and for as much as Hoskins has made his personal appearance this present court and by the attestation of Mr. Steph: Charlton has made manifest that the 800 lbs tobacco (now claimed by the said Jno Pott) for which order (as aforesaid) granted in December Court last was for so much paid to Capt Pott (for the use of Mr. William Whitby and by the said Whitby's appointment) it is therefore thought fit & ordered that Execution shall be "respited" until a certificate shall be procured by the said Hoskins (concerning the cause in question from Elizabeth City County Court.)

  	Ordered that an attachment proceed at the suite of Henry Williams against the estate of Mr. Wm. Whitby (in Northampton County) for £4.10 sterling, due for his wages (according to agreement at 30 shillings per month . . . until a legal trial determining the cause. Also on this date Lt. Tho: Sprigge also was to be paid 1,500 lbs tobacco from the estate of Mr. Wm. Whitby in Northampton County.
