To son William 150 acres adjcent my son James. To son John Reade 1 s. To kinsman John Reade. To brother John Reade. Wife (no name) residual legatee & Exec. Witt: Thomas Bushell, John Read, Phillip Willson. (NOTE: Whitelaw shows her as wife Mary and court documents confirm that.)3,4 |
Court - nam in petit | 20 June 1695 | She was named in a petition that was recorded in court records on 20 June 1695 at Accomack Co, VA. On behalf of himself and his brothers, John Read (oldest son of Henry Read, deceased) petitioned that Mary Read (widow of Henry Read) might be summoned to court to make probation of Read's will, or relinquish it so "care might be taken with ye said estate before it was embezzled or destroyed." The court decided that if Mary Read did not produce the will (if one had been made) at the next court, then administration would be granted to a person that had a right to it.2 |
Court - namd in suit | 18 December 1695 | She was named in a lawsuit on 18 December 1695 at Accomack Co, VA. Mary Read (executor of Henry Read, deceased) brought an action of trespass against Robert Chambers, but she wrongly stated her action. The suit was dismissed; a nonsuit with court costs was granted against Mary.5 |
Court - namd in suit | 19 December 1695 | She was named in a lawsuit on 19 December 1695 at Accomack Co, VA. In the suit of John Fenn against Mary Read (executrix of the estate of Henry Read, deceased), it appeared that the Read estate owed Fenn 479 lbs out of an original bill of 829 lbs tobacco. Mary had paid William Snelling and a concession was due for four yards of hair cloth. Ordered that Mary pay the debt and costs of the suit. The action brought by John Read (as guardian of Richard Read) against Mary Read (executrix of Hen. Read, deceased) was referred to the next court.6 |
Court - named in ord* | 17 June 1696 | She was named in a court order on 17 June 1696 at Accomack Co, VA. John Read (guardian of Richard Read) brought action against Mary (executrix of Henry Read, deceased) and declared that in the will of William Stevens (deceased) Richard Read had been bequeathed the following items: a large iron pot, large iron kettle, a small iron pot, a brass kettle "cast and not hammered work", a bell metal mortar, brass pestle, feather bed and bedding, "that bed which was my mother's", a large chest, pair of iron dogs [andirons] at Capt. Foxcroft's, a chest, a gun, all his books of "chyrurgerie" [surgery], "one Negro woman with all her increase to be purchased out of ye tobacco due to him in Somerset County", his "small styllyards" and his pewter. The items were to be divided between Richard and Henry Read, Jr., and, within one month of Stevens' death, to be "marked with their several marks" along with part of the cattle and horses belonging to the estate. Henry Read had been executor of Stevens' will and was therefore possessed of the estate; now Mary Read (the executrix of the estate of her husband Henry Read) refused to deliver the legacies. The court considered the case and found that Henry Read had failed to turn in an inventory of Stevens' estate; he also failed to give the legacies to Richard Read. Likewise, Mary Read had not turned in an inventory of her husband's estate. Ordered that Mary deliver all the legacies that Stevens had given to Richard Read, with execution on the order respited till the next court at which time Mary was to give a true account of the Read estate under oath. Henry Read brought an action against Mary Read (executor of the estate of Henry Read, Sr.) declaring that Wm. Stevens (deceased) in his will left Henry a feather bed and bedding, brass mortar, his biggest iron pot, a small iron kettle "which had one leg put in", and an equal share of the cattle and horses that were to be divided among the children of Henry Read. As in the above complaint, Mary Read refused to deliver the legacies. The court heard all the pleas and ordered Mary to deliver all the legacies that Stevens had given to Henry Read, Jr. Execution on the order was delayed till the next court, when Mary was to give an account of the estate of Henry Read.7 |
Court - namd in suit* | 18 June 1696 | She was named in a lawsuit on 18 June 1696 at Accomack Co, VA. The suit of Mary Read (for her son James Read) against Robert Chambers for trespass was referred to the next court at the request of Mr. Tully Robinson.8 |
Court - namd in suit | 6 January 1696/97 | She was named in a lawsuit on 6 January 1696/97 at Accomack Co, VA. Mary Read (as executrix of her deceased husband, Henry Read) had sued Capt. Thomas Welburne, who alleged that the 600 lbs of the tobacco claimed in the declaration had been received by Henry Read from John Carter. The case was referred to the next court for proof. The suit of Mary Read on behalf of her son James Read against Robert Chambers for trespass was dismissed because Mary failed to prove the lease that she claimed Chambers held for a year. A nonsuit with court costs was granted against Read.9 |
Witness paid to be* | 2 March 1696/97 | Mary was paid for being a witness on 2 March 1696/97 at Accomack Co, VA. Mary Read petitioned to be paid for attending court six days as a witness for Tho. Wadkins against John Read, Sr. Ordered that Wadkins pay her 240 lbs tobacco and court charges.10 |
Will - Father's* | 2 May 1705 | Mary was named in her father's will on 2 May 1705 at Accomack Co, VA. In his will, Robert Davis, wife Elizabeth, named sons Samuel Davis, Thomas Davis, James Davis, Robert Davis (1s) and William Davis (1s); daughters Elizabeth Parks (1s), Mary Read (1s), and unmarried daughters Sarah, Gean, Comfort & Easter Davis.1 |
Death* | before 3 November 1708 | She died before 3 November 1708 at Accomack Co, VA. Henry Read was granted administration of the estate of Mary Read (deceased). As security the court accepted Micael Rickets and John Morris.11 |
Est inv filed* | 7 December 1708 | She's inventory was recorded on 7 December 1708 at Accomack Co, VA. Henr. Read presented and swore to an inventory of the estate of Mary Read (deceased).12 |
Court - namd in suit | 6 December 1709 | She was named in a lawsuit on 6 December 1709 at Accomack Co, VA. At the last court Micael Needham brought an action of debt against Henry Read (administrator of Mary Read). Now when Needham failed to appear to prosecute, the suit was dismissed for lack of proof. A nonsuit with court costs was granted to Read.13 |
