Coleburn, wife of James H. Coleburn, for life, with remainder to his grandaughter Betsy F. Coleburn, his plantation called Snead's & Hargis, containing 40 acres, with a contingent limitation to William D. Outten & John H. Bunting, and also the 16 acres purchased by him from Mckeel Bonwell should be sold for the payment of his debts, and also gave his executor the right to sell the field called the Monger field if necessary for the same purpose, and appointed your orator and the said William D. Outten executors. The land devised by the said Matthias to his daughter Sally T. Coleburn, is the same land mentioned by the said Matthias in the second deed above mentioned to your orator, and expressed therein as containing 50 acres; the lots devised to his grandchildren John H. and Elizabeth Copes in the said will are the same lands conveyed by the first deed of mortgage to your orator; the land devised to the said William D. Outten is the same lot conveyed by the second deed to your orator; the land devised to the said William D. Outten called the Joynes field is the same conveyed in the second mortgage to your orator; the land directed to be sold and purchased by the testator from William R. Bunting is the same land conveyed in the first deed of mortgage; the land directed to be sold called the Monger field, is the same land conveyed in the second deed of mortgage containing 20 acres; the land directed to be sold purchased from Mckeel Bonwell was conveyed in neither of the aforesaid deeds; after the death of the said Matthias Outten your orator ascertained that the testator was indebted to a certain John B. Walker, his late ward, in a greater sum than the value of the whole real estate, and that there is still a considerable balance due the said Walker &c.3 |

That Ezekiel Ashby was in his lifetime and at his death seized in his demesne as of fee of and in the lands & appurtenances in the declaration mentioned, which were contiguous to other lands of the said Ezekiel, and being so seized on the ____ day of ____ 1764 made his last will & testament; that on or about the 15 Apr. 1764 the said Ezekiel Ashby died without having altered said will, which said will was probated 24 Apr. 1764; that the aforesaid Ezekiel Ashby died possessed of several slaves & personal estate including the legacies in his said will mentioned to amount of £370:7:8 1/2 that John Ashby in the said will mentioned after the death of the said Ezekiel entered into the lands in question and was thereof seized at the time of his death; that William Ashby was the eldest son and heir at law of the said Ezekiel Ashby; that the said William Ashby died on or about the ____ day of ____ 1767 intestate and without issue; that John Ashby aforesaid was the second son of the said Ezekiel Ashby and heir at law of said William Ashby; that said John Ashby made his last will & testament and afterwards died without having altered said will on or about the ____ day of Jan. 1792, leaving children to-wit: John Ashby, the defendant, Sarah, Samuel, Ezekiel, William, David & Elizabeth, which said will was probated 1 Feb. 1792; that upon the death of the said John Ashby the elder, John Ashby, his son, the defendant, entered upon the lands in the declaration mentioned and became and still is possessed thereof; That the lands in the declaration mentioned are the same lands mentioned in the will of said Ezekiel Ashby and called and known by the name of Fox Ridge, and contains 70 acres, and is the same land conveyed by a certain James & Elizabeth Longo to the said Ezekiel Ashby; that the lessors of the plaintiff, to-wit: James, Tamer & Susanna, are children of the said Ezekiel Ashby and part of the children mentioned in the residuary clause of the said Ezekiel's will; that Ezekiel Beach, one other lessor of the plaintiff, is the son and only child of Mary, one other child in the said resid. clause mentioned; Sarah, one other of the children named in the said resid. clause died on the ____ day of ____ 1769, an infant, intestate & without issue; that Ezekiel, another of said children in said resid. clause mentioned, died on or about the ____ day of ____ 1794, having first made his last will & testament, which was probated 30 Jan. 1797; That afterwards, to-wit: on or about the ____ Jan. 1796, David Ashby, one other of the said children in the said resid. clause mentioned, died having first made and published his last will & testament, which said will was probated 25 Jan. 1796; that George Ashby, one of the sons of Ezekiel Ashby the elder died on or about the ____ day of ____ 1794, after having made his last will & testament, which was probated 23 Feb. 1795; that Sarah Ashby, widow of Ezekiel the elder, & mentioned in said will, died intestate and without having married a second time on or about the ____ day of ____ 1795, leaving property of her own acquiring after the death of the said Ezekiel her husband, and of the estate of said Ezekiel Ashby bequeathed to her by his said will during life or widowhood, to amount of $114:8:5 &c.3 |

War and died without issue, and of James Ashby who also served in the Rev. War and has not been heard from for the last 15-20 years, where recorded. They left brothers & sisters as follows: (A) John Ashby, (B) Molly Ashby and (C) Tamar Ashby. (A) John Ashby left 5 children: (1) John Ashby, (2) Sally Ashby, (3) Samuel Ashby, (4) Ezekiel Ashby & (5) Elizabeth Ashby. (1) John Ashby died leaving Smith Ashby and Sally Floyd, wife of Thomas, his only heirs at law; (2) Sally Ashby married Jesse Ames and died leaving three children: John A. Ames, Thomas Ames and Jesse Ames; the said Jesse is dead and left three children: Emily Ames, Georgianna Ames and Virginia Margaret Ames; (3) Samuel Ashby, dec'd, left 4 children: Juliet Robins, wife of Arthur, Elizabeth Mears, widow of William, Levi Ashby and Mary Ashby; (4) Ezekiel Ashby died leaving four children: Margaret Ashby, Elizabeth Ashby, Washburn Ashby and David Ashby; and (5) Elizabeth Mears, dec'd, left 3 children: William D. Mears, Sally Mears, & Elizabeth Mears. (B) Molly Ashby married William Beach and both died leaving Ezekiel Beach their only child; the said Ezekiel Beach died leaving one child: Molly Beach who married Littleton Willis; the said Molly Willis is dead leaving Elizabeth Willis her only heir at law. (C) Tamor Ashby married Robert Savage and died leaving children unknown. Said Smith Ashby, Sally Floyd, John A. Ames, Thomas Ames, Emily Ames, Georgianna Ames, Virginia M. Ames, Juliet Robins, Elizbeth Mears, Levi Ashby, Mary Ashby, Margaret Ashby, Ezekiel Ashby, Washburn Ashby, David Ashby, William D. Mears, Polly(sic) Mears, Elizabeth Mears, Elizabeth Willis and the children of Tamar and Robert Savage are the only heirs at law of David and James Ashby, both of whom were soldiers in the Army of the Rev.
