That upon the death of the said Peter Fitzgerrald the said Frances entered into the said premises and became seized thereof, and afterwards intermarried with a certain Bayly Hinman who afterwards, to-wit: on the 28 Oct. 1784, together with the said Frances, conveyed to William Barclay the said premises containing 60 acres, but it does not appear that the said Frances was examined privily & apart from her husband touching the said indenture as the law requires, by virtue whereof the said William Barclay entered into the premises and became possessed thereof; that the said William Barclay being so seized on the 12 Jan. 1799 conveyed the said premises to Benjamin Potter, by virtue of which the said Benjamin Potter entered into and became seized thereof; that the said Benjamin Potter & Elizabeth, his wife, on the 29 Sept. 1801, conveyed the premises to John Bull, Jr., the defendant; that Bayly Hinman, the husband of the said Frances, died on the ____ day of ____ in the year 1800, and that the said Frances is now living in the State of Delaware where she was residing with her said husband at the time of his death, and that she has continued ever since to reside in the said State of Delaware &c.3 |

That upon the death of the said Peter Fitzgerrald the said Frances entered into the said premises and became seized thereof, and afterwards intermarried with a certain Bayly Hinman who afterwards, to-wit: on the 28 Oct. 1784, together with the said Frances, conveyed to William Barclay the said premises containing 60 acres, but it does not appear that the said Frances was examined privily & apart from her husband touching the said indenture as the law requires, by virtue whereof the said William Barclay entered into the premises and became possessed thereof; that the said William Barclay being so seized on the 12 Jan. 1799 conveyed the said premises to Benjamin Potter, by virtue of which the said Benjamin Potter entered into and became seized thereof; that the said Benjamin Potter & Elizabeth, his wife, on the 29 Sept. 1801, conveyed the premises to John Bull, Jr., the defendant; that Bayly Hinman, the husband of the said Frances, died on the ____ day of ____ in the year 1800, and that the said Frances is now living in the State of Delaware where she was residing with her said husband at the time of his death, and that she has continued ever since to reside in the said State of Delaware &c.1 |
