Hitchins produced several witnesses to prove his complaint. Colvert's attorney, Mr. John Tankred, claimed that he could prove that Hitchins had ridden the horse "down the county to Maggaty Bay" after the alleged incident at the house. The court accordingly referred the case to the next court so Tankred could produce the evidence.5 |

The suit of Gerrard Hitchin against John Colvert had been referred to this court because Colvert's attorney alleged that Hitchen had ridden a horse to Maggoty Bay in Northampton County after Colvert was accused of shutting the same horse in a house. However, the defendant failed to prove the allegation at this court. Samuel Ball and Robert Taylor appraised the horse at 800 lbs tobacco; ordered that Colvert immediately pay that sum to Hitchin with the costs of the suit. (Side note: The judgment was satisfied by execution served by Sheriff Danll. Jenifer on Jno. Colvert, 10 March 1689/90.) The horse was appraised at 800 lbs tobacco. Signed 19 February 1688/89, by Samuel Ball and Robert (R) Taylor. (The following deposition was barely readable.) Deposition of Elizabeth Hitchins aged about 27 (?) years: About the middle of last August when she was at Widow Mears' house, John Colvert, in the presence of John Mears admitted shutting up the horse. Signed 21 November 1688, by Elizabeth Hitchins. Deposition of John Mears aged about 17 years: At his mother's house during the past summer, John heard John Colvert admit (in the presence of Elizabeth Hitchins and others) that he had shut up Gerrard Hichins' horse; Colvert affirmed it with an oath. Signed and sworn in open court 21 November 1688, by Jno. (X) Mears. Deposition of Charles Somervile aged about 36 years: At Widow Mears' house sometime last June (?), Somerville was present when John Colvert was asked about Garret Hitchins' horse that was found dead. Colvert admitted shutting up the horse in a house while he worked with planks. He said he afterwards let the horse out again. Signed and sworn in open court 18 December 1688, by Charles Somervile. Deposition of Mary Mears, widow, aged about 40 years: About last August, John Colvert and Elizabeth Hitchin were both at Mears' house. When asked about Gerrard Hitchins' horse, Elizabeth replied that he was found dead, and that John Colvert had shut him up in the house. Colvert answered that he had shut the horse up while he went to "draw planks" and then released him. Elizabeth replied that he had shut up the horse till it was "jawfallen" (nearly dead). The report of the jury continues that by the consent of Robert Wiggens, Richard Carvey and Mary his wife and Benjamin Dunton and Margaret his wife, Edmond Scarbough, formerly Surveyor of the County, divided the 300 ac between the said Robert, Richard & Benjamin as by plat in 1702. The report also found that the widow, Mary died about 14 or 15 years ago (i.e. about 1708). Margaret the wife of Benjamin Dunton died in the lifetime of her mother and that Mary the wife of Richard Carvey died on 9 Jan 1721. The lessor Robert is the only surviving child of the Testator. The report of the jury continues that by the consent of Robert Wiggens, Richard Carvey and Mary his wife and Benjamin Dunton and Margaret his wife, Edmond Scarbough, formerly Surveyor of the County, divided the 300 ac between the said Robert, Richard & Benjamin as by plat in 1702. The report also found that the widow, Mary died about 14 or 15 years ago (i.e. about 1708). Margaret the wife of Benjamin Dunton died in the lifetime of her mother and that Mary the wife of Richard Carvey died on 9 Jan 1721. The lessor Robert is the only surviving child of the Testator. Another document shows a long list of fees and costs against the Dft Richard Carvey levied by the Court.3 |
