Now a jury charged with setting the damages returned a special verdict. They found that the plaintiff had £13 currency and a Negro (as executor of Samuel Brittingham, deceased), all of which he delivered to Hopkins, who promised to give security or keep Hopkins indemnified from Early Brittingham (the minor daughter of Samuel Brittingham and his wife, who as a widow had married Hopkins). It was after this that Brittingham was made executor of the estate. The jury found that the money and Negro were Early's part of her father's estate. The jury asked for the advice of the court, for if the law was for the plaintiff, they awarded him £25:10:00; if not, they would find for the defendant. The matter of the law would be argued at the next court.2 |
