Henry, Jr., produced two notes charged on Wheeler and Sturgis, swearing that he never received payment. Ordered that execution issue to satisfy the debt with court costs.9 |

At that time it was moved that the estate remain in the possession of Henry Allin (who had married Elizabeth, widow of James). He was to post security for giving the estate to the orphans when they reached full age. The court accepted Edmund Allin as his security, and the clerk prepared the papers soon after the date of the order, but in contempt of the order, Henry Allin failed to give bond. Since the orphans might be defrauded by his embezzlement of their estate, it was ordered that Henry Allin be taken into custody until he gave security. At the next court he was to answer for his contempt and show why he had not performed the order.22 |

The sheriff reported the attachment served in part on the estate of Henry, Sr., that was in the hands of Thomas Ironmonger: one felt hat, an old shirt, a pair of leather drawers, three yarn gloves, half yard of cloth, thirty gimp buttons, a belt, a pair of brass shoe buckles, one ivory tobacco stopper, a staple and cutting knife, two other knives (one broken), one pair of old shoes, four bits of whale bone, a box, a parcel of writings, a leather apron, also 200 lbs tobacco in the hands of John Wheeler, 200 lbs more in the hands of John Sturgis, and 200 lbs allowed Henry, Sr., in the levy. Henry, Jr., produced two notes charged on Wheeler and Sturgis, swearing that he never received payment. Ordered that execution issue to satisfy the debt with court costs.6 |
