Joynes and William Gilliett shall be, and they are hereby authorized and empowered, upon such terms, and in such manner, as the court of the county of Accomack, if it shall be of opinion, upon examination that the interest of the said infant daughter of the said Severn E. Savage will be promoted thereby, shall order and direct to make sale of the said three lots of land, or such part thereof as the said county court of Accomack shall order and direct, whereof the said Severn E. Savage died seized, and convey the same to the purchaser or purchasers thereof in fee simple. And the said commissioners, or any two of them, are hereby authorized to ----- the proceeds of the sales of the said lands, or such part thereof as may be necessary, towards the payment of debts remaining due from the estate of the said descendant, and which are a legal or equitable lien on said lands; and the balance of the said proceeds, if any, they shall account for and pay to the widow such part thereof as the said county court of Accomack shall adjudge and decree equitable, not exceeding one-ninth(?), and the balance to the guardian of the said infant daughter of the said Severn E. Land cause | 29 March 1814 | She was named in a land cause on 29 March 1814 at Accomack Co, VA. Came Margaret Savage, by William H. Smith, her next friend, and brought her bill in chancery against William S. Custis; That a certain John Savage late of this county was in his lifetime and at the time of his death seized in his demesne as of fee among other lands of a valuable plantation and tract of land situate on Metompkin in this County, containing about 500 acres, which said tract of land the said John Savage had purchased of a certain James Henry, and being so seized thereof on the ____ day of ____ 1792, the said John Savage departed this life, having first made his last will & testament, in which said will the said John Savage among other things directed that his plantation on Metompkin should be rented until his son Joseph arrived to the age of 18 years, and that then the same should be equally divided between all his children who were then living; when the said Joseph arrived to the age of 18 years, there were living of the children of the said John Savage William, Thomas, Charles, Joseph, Severn, the father of your oratrix, and Ann, the wife of a certain William Stone, George, another of the sons of the said John Savage having departed this life previous to that time; on the 8 June, 1803, the aforesaid William Savage conveyed to William S. Custis of this county, who had intermarried with the widow of the said John Savage, all his right to the aforesaid plantation; shortly after the said Joseph arrived to the age of 18 years, viz: on the ____ day of ____ 1808, a suit in chancery was instituted in this court by the said William S. Custis & Margaret, his wife, S. E. Savage, Ann Savage & Joseph Savage vs. Thomas W. & Charles Savage for the purpose of assigning to Margaret, the wife of William S. Custis, her dower in the said land, and also for the purpose of dividing the balance of said land among those entitled thereto; division made & dower assigned under said decree; on the 13 July, 1803, Thomas W. Savage conveyed to Severn E. Savage, your oratrix father, all the part of said land which had been alotted to him, also all his right in the reversion in that part of land which had been assigned to Mrs. Custis as her dower; on the 4 Apr. 1812, Joseph Savage conveyed to the said William S. Custis the part of said land which had been allotted to him, and also his part in the reversion in Mrs. Custis' dower; on the 21 Sept., 1811, William Stone & Anne his wife conveyed to William S. Custis all the said Anne's original share of the said land which had been allotted to her, and also her share of Mrs. Custis' dower, and on the 26 Feb. 1810, Charles Savage conveyed to the said William S. Custis all his right in the said land which had been assigned to Mrs. Custis for dower; on the 26 Aug. 1813, the said Margaret Custis departed this life; on the 6 day of Sept. 1808 Severn E. Savage, the father of your oratrix departed this life intestate, leaving your oratrix his only child & heir at law. Your oratrix is further advised that she is entitled as heir of said Severn E. Savage to 1/3 of the land which had been allotted to Mrs. Custis for her dower, and that the aforesaid William S. Custis, by virtue of the said several conveyances aforesaid is entitled to the two remaining thirds thereof &c.1 |
Land cause* | 10 February 1818 | She was named in a land cause on 10 February 1818 at Richmond, VA. Severn E. Savage, late of the city of Baltimore, departed this life intestate, seized of three lots of land in the county of Accomack, leaving Sally Savage his widow, and Margaret Savage an infant daughter. That the said three lots of land, being detached from each other, without houses or ----- thereon ------ that the said Severn was at the time of his death indebted on bonds to a considerable amount, and having no personal estate, the claims on these lands remain as a lien on the said lands; and the said Sally Savage having petitioned the Legislature that an act may pass authorizing a sale of the said lots for the payment of the debts of the said Severn E. Savage, and for the support and maintenance of herself and her infant daughter. Be it enacted that Major S. Pitts, Thomas R. Joynes and William Gilliett shall be, and they are hereby authorized and empowered, upon such terms, and in such manner, as the court of the county of Accomack, if it shall be of opinion, upon examination that the interest of the said infant daughter of the said Severn E. Savage will be promoted thereby, shall order and direct to make sale of the said three lots of land, or such part thereof as the said county court of Accomack shall order and direct, whereof the said Severn E. Savage died seized, and convey the same to the purchaser or purchasers thereof in fee simple. And the said commissioners, or any two of them, are hereby authorized to ----- the proceeds of the sales of the said lands, or such part thereof as may be necessary, towards the payment of debts remaining due from the estate of the said descendant, and which are a legal or equitable lien on said lands; and the balance of the said proceeds, if any, they shall account for and pay to the widow such part thereof as the said county court of Accomack shall adjudge and decree equitable, not exceeding one-ninth(?), and the balance to the guardian of the said infant daughter of the said Severn E. Savage: Provided, if the said infant daughter should die under the age of twenty-one years, the part of such proceeds allotted to her shall pass and descend as the ---- ---- ---, whereof the said Severn E. Savage died seized, would have descended(?) if this act had never passed. And also provided, that no sale be directed by the said county court of Accomack, until a summons shall have issued and been served upon the infant daughter of the said Severn E. Savage and her guardian, and also upon Lovey Savage, widow of Charles Savage, deceased, and other creditors of the said Severn E. Savage, to show cause, if any they choose, against such sale. This act shall be in force from the passage thereof.
