Whitelaw assumed that his wife had been the former Agnes Somers and title to the land had come to him through her and that she had gotten it by the 1703 will of Daniel Neech left his balance of 110 acres to wife Margaret, but if she did not make disposition it was to go to Thomas and Agnes Somers. Whitelaw also conjectured that this Agnes then married Azariah Scott, as 8 years later the death of Costin the Scotts sold the same land to John Wilson. Then in tracing the owership of tract N10 Whitelaw found evidence confirming the previous assumptoin that Francis Costin had married the widow Agnes Somers and that she late married Azariah Scot of tract N9 was found in a deed from the Scotts to Matthew Costin for her dower interest in the land left to him by Francis Costin. (NOTE: One concern here is that the Agnes Somers mentioned in the will of Daniel Neech was born circa 1680 and therefore would have been somewhat older then either Francis Costin or Azariah Scott, but it does support the owership of the land. Enderd Jacobson saith that on Thursday night late, Sibilla Jarvis came up to the house of Thomas Dimmors and that she and George Leicham came on shore together and that George Leicham came up before her and that there was such fighting (as never was in this world about her). Rich. Founded saith that on Thursday last at night later he came on shore at the marsh by Thomas Dimmors, and called after George Leicham going up the bank, and said friend sequiter have you the sword, the woman being between, he answered no, I am very sick man, neither did he see him strike anyone, or any to strike him.4 |

Whereupon they agreed and Thomas Ward gave the indenture to Mathew Pett and Mathew Pett to Jarvis and bid Jarvis to burn it. The Mathew Pett saith unto him, now you are free, but if thou wilt now make thy condition good with me, let them be made now being here in one that can write, your deponent being present, made them and the said Jarvis set to his hand freely of his own will without any motive or persuasion of any man. On 8 Aug 1727 Elizabeth Jarvis, William Gascoines and Thomas Luker have recieved of John Stachell and Thomas Dalby all of the estate they had in their hands but 1750 lb tobacco that is in other men's hands. For all the estate of William Jarvis dec'd the above 3 give Satchell and Dalby a general discharge this 12 of May 1712. Signed by the mark of Elizabeth Jarvis, by the mark of Thomas Lucor and by the signature of William Gascions. This my shall oblige me Elizabeth Jarvice to pay or cause to be payed unto John Satchell or his order the sum of 83 lbs tobacco and 6 lbs of good, clean washed wool to be payed upon demane where as witness my had 12 May 1712, signed by the mark of Elizabeth Jarvice. The above release of John Satchell was presented at Court and at his motion is admited to record 8 Aug 1727.5 |
