Deposition named in | 19 May 1681 | She was named in a deposition on 19 May 1681 at Accomack Co, VA. Deposition of William Thorroton aged about 36 years: About the middle of April 1680, Thorroton was in the woods near Christopher Tompson's plantation when he saw John PettiJohn "go to a certain hog's bed near the said Tompson's pasture fence where there lay four lusty barrow hogs." PettiJohn roused them and flung corn among them, calling them as far as the nearby small tobacco patch. There he struck at some of them but could not hit them. He then called them further and set a couple of dogs on them; they caught a whitish hog, which PettiJohn then took by "the hinder leg and knocked him on the head with an axe. Which done, the said PettiJohn stuck him and opened his belly and pulled forth his guts, and so hauled him to the root of a tree and threw chunks of wood on him." Later, at John Cole's house, Thorroton heard PettiJohn say he had killed one of Tompson's hogs. After nightfall Thorroton saw PettiJohn bring the "hog on horseback and fling it down on the side of the branch by the said Cole's house." Thorroton knew it to be Tompson's by the marked ears, which he had helped to cut. Signed before Wm. Custis on 26 April 1681, by William (sideways S) Thorroton. Sworn in open court 18 May 1681. Deposition of Wm. Yeo aged about 29 years: Mary Cole, wife of Jno. Coale, came to Yeo, Wm. Thorton, Jno. Terre and John Pettijohn in April 1680, when they were at work in the woods. She "called to us to come and sit down and pipe it, and when we were come together, she said, 'Come, let us contrive and get a hog.'" She was afraid that Terre's wife would tell if she knew about it, so after eating breakfast, they met with Mary Cole "under the house side" where she said, "Well, who will go with Jack to get a hog?" Yeo and Terre refused to go, but Wm. Thorton said he would go along with Jack, who took an axe and shortened the handle. "Then they said one to the other, 'Which way shall we go?' The said Cole being by, said, 'That blind dog Tomson and that old knave or rogue Bowman hath good hogs.'" PettiJohn and Thorton left, one with an axe and the other with a rope or bridle, as though they went to work horses. Three or four hours later they came back to work. When Yeo asked whether they had gotten a hog, they said yes. About an hour before sundown they went to fetch the hog. About dark, John Terre and Yeo were on the road going after some wood when they saw PettiJohn and Thorton ride down to the branchside with the hog in front of one of them. They threw the hog down by an old tree near the branch and then rode up to the house to see if it was clear of company; only Wm. Steavens was in an inner room. Though some of the men refused to help, the hog was brought to an inner room in the house. Mary Cole then came and said, "What a pox is the matter with you all? You shall all help to hold it, for we will be all as deep in the dirt as in the mire." They scalded the hog and carried it into the milk house. The next day some of it was dressed, and Wm. Steavens ate part of Christo. Thomson's hog. The hair was carried to a hole by the root of a tree, but was not covered. Eliz. Terrey came by the next morning and saw it. That same morning while the men were working about the fence, Christopher Thomson came by. Yeo asked them "if their hearts did not ache for killing the man's hog and to see him ride by." Thorton answered, "All the blood was in -my- face." They said they were glad that Thomson was so far out of the way the day before. Yeo commented, "It is so common with the said Cole's family, that they -do- not dread it at the sight of any man whom they have wronged in the like kind." Signed and sworn in open court 19 May 1681, by Wm. Yeo. John Terrey affirmed that Yeo had told the truth. Signed and sworn in open court 19 May 1681, by John Terry. Eli(sabeth) Terre declared that Mrs. Cole came to the kitchen and said, "This will be a bloody (problem), about -what- this rogue Thorton has done. Be good. Let us stick all together. What you do owe shall be forgiven. Terre, you and your wife shall be free. You shall not pay a pound of tobacco, and I will persuade Cole that you shall pay none, and I will give your boy a mare colt." Signed and sworn in open court 19 May 1681, by John (IT) Terry and Elisabeth (squiggle) Terre.7 |
Court - plaintiff* | 4 February 1685/86 | She was a plaintiff in a court case on 4 February 1685/86 at Accomack Co, VA. Upon an act of the assembly, John Cole complained against his covenant servant, Lancelot Jacques, for "laying violent hands on his mistress Mary Cole." After examining the evidence, the court judged that Jacques was not within the compass of the law cited by Cole; the suit was dismissed with Cole paying court costs. Deposition of John Cole, Jr., and Frances Cole: On 17 December, "we both -did- see Lance Jacques strike our mother with his hands violently on the face and flung her with his arms violently against the chest and bedstead." Signed 22 December 1685, by John Cole, Jr., and Frances (X) Cole. Sworn in open court on 4 February 1685/86. Deposition of Katherin Hanning: On 17 December Katherin saw Lancelot Jacque strike his mistress in the face and push her against the "bed's post" and chest. Katherin asked him "if he was not ashamed to misuse his mistress so bad." Signed and sworn in open court on 4 February 1685/86, by Katherin (0) Hanning.8 |
Court - defendant | 18 September 1688 | She was a defendant in a court case on 18 September 1688 at Accomack Co, VA. Mary, the wife of John Cole "in a most notorious, insolent manner in contempt of his Majesty's laws and authority" loosened and "pulled out a nail fastened to the ear of Micha Wardell in the pillory." (This had been his punishment for an infraction which he had confessed.) As a just reward for her offense, and to deter others from doing the same, the court ordered "that she stand two hours tied fast to the pillory with her back thereto and her face to the courthouse with paper fastened to her breast written in capital letters viz. 'For her contempt of authority.'" She was to remain in the sheriff's custody till posting a bond for her good behavior and payment of court charges. John Lewis and William Parker both proved that they had attended court for one day as witnesses on behalf of the King in the case against Mary, the wife of John Cole. Ordered that John Cole pay each party 40 lbs tobacco and court costs. Deposition of William Parker aged about 23 years: Parker saw "Mary Cole take up the hair of Michaell, which was fast nailed to the pillory, and with her hand plucked the nail which he was fastened with out of his ear and afterwards laid the nail upon the plank and said, 'Here it is.'" John Lewis, Jr., was ready to attest to the same. Signed and sworn in open couirt 20 September 1688, by William Parker and John Lewis.9,10 |
Land deed named in* | 17 February 1690/91 | She was named in a deed on 17 February 1690/91 at Ye Folly, Matomkin, Accomack Co, VA. Deed: John West, gentleman, gave notice that John Cole, innholder, "did by his deed acknowledge" 500 acres on Matomkin to West. Mr. Richard Bayly had sold Cole the land, which was part of the plantation called "Ye Folly"; Mrs. Cole was currently living there. "For the better support of the said John Cole's wife and children", West released the land to John Cole, who was obligated to "make a firm deed of the said land to his wife and to all his sons for their future livelihood and acknowledged the same in court." Signed 10 February 1690/91, by John West and acknowledged by him in open court on 17 February 1690/91. John Cole had formerly purchased from Mr. Richard Bayly a 500 acre tract of land at Great Matomkin. Bounded by John Bagwell, John Dye, Lt. Col. John West and a fork of Great Matomkin Creek, the land was part of 2150 acres granted in 1672 to Ambrose White (deceased). For the future benefit of his wife Mary and children, John Cole assigned the land to her (unless she were to remarry after his death). She was to pay the taxes till the children came of age, at which time each would receive the acreage specified by Cole: William (150 acres), Robert (125 acres), Richard (125 acres) and John (125 acres). If any of the sons should die, his inheritance would go to the child Mary was expecting, if it were male. Cole reserved the right to use the pasture and timber for the good of his other plantation named "Freeman's Plantation." Cole entrusted part of his personal estate to Mr. John Washbourne and Mr. William Parker for the use of Cole's wife Mary--things like a feather bed, iron kettles, sheep, spinning wheel, a new "square-turned table" and cattle. Acknowledged in open court 16 February 1690/91, by John Cole. Witnesses: Cha. Leatherbury and Tully Robinson.11 |
Deed of Gift - Named* | 15 September 1691 | She was named in a deed of gift on 15 September 1691 at Accomack Co, VA. William Yeo gave a cow and calf to Richard Cole and John Cole, twin sons of John Cole. When they came of age, the cow and her increase were to be divided equally. If the twins were to die, the cattle would be divided between their other brother Wm. Cole, their sister Angellica Cole and their mother. If the mother died before they came of age, then their brother Robert Cole should look after the cattle. Signed 20 September 1691, by Wm. Yeo.12 |
Land sold* | 1696 | She sold land in 1696 at Onancock, Acc Co, VA. It was in this year that John and Elizabeth Bradhurst assigned a lot in Onancock to John Cole. The next year he and his wife Mary Cole sold back to Esther Hill, widow, and the year following that she sold to Jonathan Livesey, of the Towne of Leaverpoole.13 |
