In further deposition John Stutson said that Mr. Charlton and John Knight carpenter being at some difference did hear Knight tell Mr. Charlton, I care not to work with you any longer except I might work quietly, whereunto Mr. Charlton answered saying if thou find any fault then go and bring me my monie as I have layed out and I am engaged for and go whether thou will, then Knight answered saying I will do it tomorrow and bring you your monie. Knight did continue in the work for ten days after and then went away and left his work.3 |
Land patented* | 1654 | John Cutting I patented land in 1654 at Northampton Co, VA. It was in this year that the court ordered Nicholas Waddelowe to give John Cudden a deed for land sold him. In 1656 Waddelowe must have applied for a patent before his sale but it was no issued until this year when it called for 350 acres of tract N100 (east of Jamesville) and two years later Nicholas and Amy Waddelowe sold it to John Cutten. Then in 1663 a patent was reissued in his name. In 1681 John and Tabitha Custis and Argoll Yardley united in a deed to John Cuttin for the 350 acres "as by a pretended Pattent to John Cuttin." Apparently the Yardley heirs had claimed this land as being a part of the Francis Yardley patent and were able to substantiate the claim and secure a payment from Cuttin. In 1686 John Cuttin gave 100 acres to his grandson Bailey Johnson and 3 years later (1689) he gave the remaining 250 acres to this son William Cuttinge. (NOTE: Since John Cutting I deposed that he was age 84 in Sept 1684 it is possible that it was his son John Cutting II that gave the land to his grandson Baily Johnson in 1686 and it was more likely that it was his son John Cutting II that gave the remaing 250 acres to his son William Cutting in 1689.)4 |

Court - named in ord* | 17 June 1696 | He was named in a court order on 17 June 1696 at Accomack Co, VA. John Read (guardian of Richard Read) brought action against Mary (executrix of Henry Read, deceased) and declared that in the will of William Stevens (deceased) Richard Read had been bequeathed the following items: a large iron pot, large iron kettle, a small iron pot, a brass kettle "cast and not hammered work", a bell metal mortar, brass pestle, feather bed and bedding, "that bed which was my mother's", a large chest, pair of iron dogs [andirons] at Capt. Foxcroft's, a chest, a gun, all his books of "chyrurgerie" [surgery], "one Negro woman with all her increase to be purchased out of ye tobacco due to him in Somerset County", his "small styllyards" and his pewter. The items were to be divided between Richard and Henry Read, Jr., and, within one month of Stevens' death, to be "marked with their several marks" along with part of the cattle and horses belonging to the estate. Henry Read had been executor of Stevens' will and was therefore possessed of the estate; now Mary Read (the executrix of the estate of her husband Henry Read) refused to deliver the legacies. The court considered the case and found that Henry Read had failed to turn in an inventory of Stevens' estate; he also failed to give the legacies to Richard Read. Likewise, Mary Read had not turned in an inventory of her husband's estate. Ordered that Mary deliver all the legacies that Stevens had given to Richard Read, with execution on the order respited till the next court at which time Mary was to give a true account of the Read estate under oath. Henry Read brought an action against Mary Read (executor of the estate of Henry Read, Sr.) declaring that Wm. Stevens (deceased) in his will left Henry a feather bed and bedding, brass mortar, his biggest iron pot, a small iron kettle "which had one leg put in", and an equal share of the cattle and horses that were to be divided among the children of Henry Read. As in the above complaint, Mary Read refused to deliver the legacies.
