Court - namd in suit | 15 March 1691/92 | He was named in a lawsuit on 15 March 1691/92 at Accomack Co, VA. On behalf of John Price, Lt. Col. John West complained that Price was supposed to pay a judgment of 2500 lbs tobacco obtained against him by Comfort Scott, the administratress of Ambrose White (deceased). He had been sued by Mr. William Anderson (attorney of Comfort Scott) and William Emett (attorney of Jeremiah Scott, who married Comfort, widow and administratress of Ambrose White and then widow of John Roades) and attachment had been made by the sheriff. West claimed the attachment "by defect in process" had been made void, but the goods were still in the sheriff's hands. "In tender consideration of the matter" the court advised the sheriff, Mr. Welburne, to have Price's estate appraised as soon as possible. If there was not enough to satisfy the debt, West promised to pay the remainder.6 |

The court ordered that the suits be dismissed and granted nonsuits against Price with the court costs.7 |

John Custis) became security for Price's appearance; they failed to produce Price, whose attorney asked Welburne to prove the bill. The court judged the proof sufficient and ordered that judgment be confirmed against Silverthorne and Collins; they were to cause the carpentry work to be performed and pay the costs of the suit. The attorney Silverthorne and Collins was granted an appeal to the next General Court and gave security.8 |
