He was awarded the Congressional Medal of Honor of conspicuous gallantry in Haiti in 1914. At the time of his death he was a Major General and was the Comanding General of the Marines of the Pacific and second ranking officer of the Marine Corps. In 1949 the New York Shipbuilding Corp. began building the ocean liner, President Hayes, for the American President Lines at Camden, NJ. War broke out in Korea in June 1950 and three months later the US Navy acquired her for military service. She renamed the USNS Upshur in honor of this dedicated Marine.1 |

Biography* | | In 1811 his father gave him a tract of land a few miles from "Vaucluse" farther up Church Neck on Hungars Creek, know as "Pear Plain." He represented N'hamp Co for several years in both the Virginia House of Delegates and Senate. He was a member of the Masonic Lodge No. 11 of Eastville and a Vestryman of Hungars Church as his father had been. He served as Captain in the 27th Regiment of Virginia Miitia for N'hamp Co in the War of 1812 along with several of his brothers. In later years he was know as Colonel Littleton Upshur and his name was so recorded in many of the records of N'hamp and Accomack Counties.1 |

I desire that my executor divide my Library, or such books thereof as he may deem worth preserving amongst my three sons, and my nephew Littleton U. Mayo son of Peter P. Mayo. I appoint my brother Abel P. Upshur my executor and in case of his death or neglect or refusal to qualify then I appoint my brother George P. Eastville, VA, March 12, 1889 - Eastville and the adjacent country was very much excited and greatly shocked this morning when it became known that during last night Jefferson Adair, a resident of Onancock, had shot and instantly killed Peter B. Smith, a highly respected and well-known farmer, residing just outside the limits of this town. The facts, as far as ascertained, are as follows: Sometime during the night, Adair and Smith went to a well-known place in Eastville and joined in a game of cards which was in progress. Everything ran along smoothly until a late hour when the effects of liquor were felt. Finally, Adair picked up the cards and dealt the hands around. Smith received three "jacks" and Adair three "queens." Betting became lively and a call was made. The hands being shown, Smith pulled in the pile of money that was upon the table remarking that Adair had cheated in the deal. Smith was entirely deaf, but was made to understand by signs by Adair that he must give up the money. Smith refused, saying he would not be cheated by anybody out of his money. Then Adair jumped up, drew a pistol, and fired, the ball entering just below Smith's right eye and entering the brain, causing instant death. Smith died as he sat in his chair. Adair was immediately placed under a strong guard, and afterwards lodged in jail. The deceased was a son of the late Dr. W. G. Smith and served in the Confederate army, being at one time a member of Oter's Battery. He leaves a wife and six children, most of them grown. He was well known throughout the eastern part of Virginia and in Baltimore and Philadelphia, where he has many friends and acquaintances. A Jury of inquest was held this afternoon. Alter the testimony in the case had been heard, the jury rendered a verdict "that Peter H. Smith came to his death by a pistol bullet fired by a pistol in the hands of Jefferson Aair, and fired by said Adair without any provocation." After the rendering of the verdict, Adair was brought into court for a preliminary hearing, but he waived an examination and was committed to jail for the action of the grand jury. The prisoner expressed great sorrow for his act and attributed it to the effect of liquor. Jefferson Adair has been employed for the past year as clerk in Col. Benj. T. Parker's Grand Central Hotel, Onancock, and is the only surviving son of the late John W. Adair, of Accomack Court House, formerly one of the best known hotel proprietors on the Eastern Shore of Virginia. Mr. Edward Adair brother of the murderer, was the proprietor of the Atlantic Hotel in Berlin for several years, where he died. His widow afterwards conducted the place until Gus Parker bought it out and became the landlord. Jeff, who stayed with his brother while he ran the hotel, was a noted gambler, and was one of a notorious gang of sharps that ran a den at Ocean City. His brother who was a gentleman in every respect knew of Jeff's doings and told him he must do better or leave his house, which he eventual[ly did. The trouble he has got into now was not unexpected by many who knew him well as it is not his first shooting affair. Will - Father's* | 1876 | Mary was named in her father's will in 1876 at Northampton Co, VA. In his will William W. Churn gave to daughter Ellen S. Dunton, wife of Joseph Dunton- the farm on which I now reside some 40 acres. To my son Severn B. Churn the farm known as the Roberts Farm containing 105 acres, I also give to my son Severn B. Churn forty five acres of the farm referred to in item 1st on which I reside running from seaside road to cross road to bayside road for term of his natural life & then to his children forever. To my daughter Mary A. B. Dunton the sum of five dollars. I give to Susan Beach and Dimmona Beach daughters of my dead daughter Margt Sarah the sum of five dollars each. I give to Keturiah G. Kelly (my daughter) the sum of $500 to be paid out of the proceeds of sale of Birdsnest property due me from J. B. Powell. To my grandson Benjamin Dunton.1 |
