After nightfall, when Briggs came near home and the dogs started barking “and gave notice of his coming,” Fittiman immediately blew out the candle and took the shoat away to hide it. When Briggs came in, he asked why they were suddenly in the dark. When the candle was lit again, he seemed to have some suspicions. Deposition* | 15 December 1691 | He gave a deposition on 15 December 1691 at Accomack Co, VA. On behalf of John Bowing, Elizabeth Johnson and Elinor Bowing, Woodman Stockley (who was so entrusted in the will of John Bowing, deceased) declared against Elias Tailor, saying he had a mare and colt in his custody that belonged to the children of Bowing. (Col. Jno.Westwas attorney for the plaintiffs.) At the last court an order passed against the sheriff for the appearance of Tailor; now Mr. William Anderson (who claimed priority to the mare and colt) asked to defend his case. It appeared to the court that the animals were the property of Anderson; the suit was dismissed. Deposition of Henry Towles aged about 40 years: About three of four years ago, a two-year-old mare belonging to the orphans of Jno. Bowing went astray and was gone about three years. When shewas brought home, she had with her a two-year-old colt and a yearling mare and a suckling colt. They branded all three colts with the orphans’ brand, but a few days later, Nathaniel Ratcliff sent word saying “that I had done wrong, and that I had branded a colt of Mr. William Anderson’s.” Towles went to Anderson’s house and explained the situation. Anderson said, “Neighbor, if you have done so through ignorance, no more shall be said about ye said colt.” When Towles returned home, he was given to understand “by the report of people” that Ratcliff could not swear to what he had said, but only supposed that the yearling belonged to Anderson. Towles returned to Anderson and explained again, saying that the colt “might be ye orphans’ as well as ye said Mr. Anderson’s.” Anderson then replied that “rather than he would be fooled out of his colt, he would spend more than ye colt was worth.” They had some hard words. Towle went home and sent his wife to Nathan. Ratcliff’s to find out what he could say about the yearling. Ratcliff told her that the yearling was certainly Anderson’s and “did send me word it was to save trouble.” After that Towles relinquished the colt. Signed and sworn in open court 19 November 1691, by Henry (HT) Towles. Nathaniel Racklife swore that he was well acquainted with an old mare that William Anderson got from John Barker and which was bred at Wm. Tayler’s and frequently ranged the Racklife plantation along with several colts the old mare had. The last colt was a bay filly that ran with her dam till about February orMarch when the old mare died. The filly “took company” with a mare belonging to John Bowin’s children. When it was about a year old, Racklife saw it freshly branded by Henry Towles and sent word that he had branded a mare belonging to William Anderson. Elizabeth, wife of Towles, came and inquired about the mare and left satisfied that it “was ye said Anderson’s mare and not her children’s.” To the best of Racklife’s knowledge, this was the same mare that had since been branded with Elias Tayler’s brand and was now in controversy between Bowen’s children, Anderson and Tayler. Signed 17 November 1691, by Nathanl. (N) Ratclife. Sworn in open court 15 December 1691. William Tayler swore that he was well acquainted with the old mare and her increase as described by Nathaniel Racklife. After the old mare’s death, her last colt took up with the “aforesaid company.”William was persuaded that this was the same mare now in controversy between the children of John Bowing,WilliamAnderson and Elias Tayler. Signed 17 November 1691, by Willm. Taylor. Sworn in open court 15 December 1691.1 |
