Arew's wife told her husband that he "need not be so forward to swap for another horse. You had so bad success with the first you bought." Brotherton told Arew that it was God's justice that the horse "should thrive no better with you, for I think in my conscience one of the cows you gave for the first horse was mine." When Arew's wife asked how he could prove that, Brotherton replied, "My dame gave me a calf, and when I went to Watts Island to live, I desired Jno. Arew to mark it for me, and the said Arew marked it of his own mark." The wife of John Arew "was disturbed at these words." May ordered Abbot to transport the hogsheads and to leave them in the woods, where by May's neglect they were "damnified by rain." When Lee found out, he procured a warrant from Capt. Richard Hill; it directed John Arew and others to view the hogsheads. They determined that 300 lbs tobacco damage had been done. Since it appeared by the depositions of John Abbot, Jr., and Robt.
