(NOTE: See the Land Cause below for the details of this sale.)5 |
Land cause* | 1823 | John was named in a land cause in 1823 at Northampton Co, VA. 1823 - Bill in Chancery of Thomas H. Guy, John B. Revell & John C. Parramore merchants trading under the firm of Guy, Revell & Co. vs. John Robins. On 2 Dec 1822 the merchants filed their bill in Chancery against John Robins, that John Robins of N'hamp County was on 12 Oct 1821 indebted to the merchants in the sum of $1,410.96 and for the purpose of securing the payment thereof proposed to convey to the merchants in mortgage his plantation in Acc Co and several Negro slaves. On 12 Oct 1821 John Robins and Jane his wife executed a deed conveying to the merchants a mortgage on the land containing 307 acres in St. George Parish, Acc Co, VA near Bell Haven, adjoining the lands of Nathaniel Turner, Isaac D. Robins, Arthur Robins, Thomas Robins & Richard Cutler Senr, being the land left to John Robins by his uncle Arthur Robins and slaves Jonas, Nat, Ibby George & Lucy & the future increase of the females with a proviso that this would be void if the John Robins should pay $1,410.96 with interest & cost of recording & other sums that Robins might become indebted to the merchants. This deed was recorded in Acc County. Since the deed was recorded, John Robins has become indebted to the merchants in diverse sums of money on Notes and on account for goods, and including the $1,410.96, now totaling $1,979.34 and since the deed was recorded, John Robins has sold the Negro slaves and out of the proceeds has paid $280 and another $250, leaving a balance due on 15 Aug 1822 $1,449.34. The merchants now request that the mortgaged land to be sold in satisfaction of the debt and request that the Sheriff of Acc Co, sell the land and pay the merchants $1,449.34 and interest and the balance to be paid to John Robins. On 17 Apr 1822 the above deed was transferred to the merchants for $1.00. In March 1823, since the bill had been filed more than 3 months without any payment, it was ordered that Robin appear on 1 May 1823. Then on 13 July 1823, Robins having still not appeared, it was ordered that the merchants recover the $1,449.34 with interest and if not paid by the October Court that the sheriff of Acc County proceed to sell the land, being 307 acres for ready cash and out of the proceeds pay the merchants and Robins to be barred and foreclosed from all equity of redemption of the mortgaged premises. (N'hamp Co Land Causes, 1815-1834, p. 140-143) . |
