With the court requiring proof, Hutchinson referred to an agreement made between Foxcroft and Stevens and now in the hands of Mr. Edward Ashby, who brought it to court. In the document Stevens obliged himself to sell the sloop, but only if several conditions had been performed by Foxcroft. After examining the case, the court found that no bill of sale had been made--only a conditional agreement which had not been performed.
