According to Whitelaw, in 1746 Richard Read sold his interest in tract A36 to his brother Henry Read, who died in intestate in 1772 and was succeeded by a son Southy who also died intestate at some unknown date and was succeeded by a brother or son Zorobabel Read.7,1 |

This indenture made 26 Sept 1758 between Abraham Taylor and his wife Sarah and Richard Read and Henry Read. On 27 July 1757 Abraham petitioned for a mill, owning land on one side of a Branch of Pungoteague Creek called Pocomoke Branch, desirous to build a Water Grist Mill & needing an acre on the opposite side of the branch. On 13 August 1757 twelve free holders (Edmund Scarburgh & 11 others that had been selected) viewed the land and noted that some adjacent land would also go under water. There would be damage to the land of John Read, who possessed the said acre valued at 35 shillings & 6 pence, and to adjacent land owned by William Groten, valued at 6 pence. Abraham Taylor, who was to pay for the land, agreed with Richard Read and Henry Read that he would convey to each of them 1/3 part of his right & interest in the 1 acre and 1/3 part of the 1 acre next to & adjoining the mill to be built. Abraham Taylor & Sarah his wife sold this 1/3 right & interest to Richard Read & his heirs for 25 shillings & 1/3 part of said 2 acres mentioned above. Abraham Taylor & Sarah his wife also sold this 1/3 right & interest to Henry Read & his heirs for 25 shillings & 1/3 part of said 2 acres mentioned above. Access to enter into & upon the said premises for & towards the erecting & finishing of said mill & for that purpose to go through the land & plantation of Abraham Taylor with horses & carts or other necessaries to & from the said premises. Abraham will proceed to & with them (Richard & Henry) to build & finish the said mill & find & provide 1/3 part of all the necessaries that shall be required in completing & finishing the same. Richard & Henry agreed to the same. This is to continue after the death of any of the parties (by their heirs, Extrs or assignees) to keep the mill in repair & grinding. Signed by Abraham Taylor, Sarah Taylor, Richard Read & Henry Read.8 |

Anecdote* | The original 700 acres went as follows (in birth order): John - 0 ac - inherited 350 acrs from his brothers William & James, died 1720 without a will, leaving a daughter Sarah and an underage son Richard Jr to inherit 350 ac Henry Jr - 150 ac - died 1734, leaving 74 acres each to sons Richard Jr & Henry III, in 1746 Richard Jr (no wife) sold to Henry III Richard Sr - 200 ac - died 1748 without a will leaving a underage son John William - 150 ac - died without a will and no issue, 150 ac went to the oldest brother John James - 200 ac - died without a will and no issue, 200 ac went to the oldest brother John Richard Jr, son of John, inherited 350 ac from his father. John's brother Henry Jr, inherited 150 acres from his father Henry Sr in 1694 and sold it in 1713 to Thomas Budd, a miller. In 1719 Budd sold it back to Henry Jr along with a mill. In 1734 Henry Jr left his sons Richard & Henry III his mill and 74 acres each. Then in 1746 Richard Jr sold his 74 acres to his brother Henry III, which assumingly included his share of the mill. He didn't have a wife co-sign the deed in 1746. In 1758 a patent was issued to Henry III for 673 ac (originally shown as 700 ac) which was all the land shown above. Whitelaw could not determine how Henry III came to be in line to claim all the land, as John was the oldest son of Henry Sr as shown in 1695 when he petitioned the court that Mary Read (widow of Henry Sr) be summoned to probate his father's will. If Henry III had been the eldest son of the eldest son of Henry Sr it would have been more logical, but he wasn't. In 1759 Henry III & wife Sarah sold 537 ac (taking out of the patent acreage the land of his father Henry Jr, which would have been what Henry III inherited from his father and what he bought from this brother Richard Jr, which would have included the mill) to a Richard Read (no indication of him being a Jr or him being his brother). Whitelaw suggested that this Richard could have been the only son of the oldest son John, making him heir-at-law to Henry Sr, thus inheriting all the original 700 acres less the 150 ac which was given to Henry Jr.10,1,9 | |

In a suit regarding 400 acres that Anderson Parker had owned on the East side of Pungoteague Branch it was noted that after Anderson Parker’s death the land descended to his grandson John Parker (eldest son of William Anderson Parker, also an eldest son, who predeceased his father Anderson Parker). The grandson John Parker died without issue and the land was inherited by the eldest surviving brother William Anderson Parker, who recently sued Hancock Nicholas Rowles, Henry Reid and Abraham Taylor (tenants in possession of the land and two grist mills) and on last 27 August, obtained a writ of possession.18 |

Anecdote* | 1655 | The progenitor of the Mears family of the Eastern Shore of Virginia was Bartholomew Mears, who came to Northampton (now Accomack) County by 1655. His name was given as a headright by William Taylor when Taylor was granted 300 acres of land near the head of Occohannock Creek on 11 Mar 1655 (Nugetn, Vol. I, p. 331). Taylor was eligible for 300 acres for having paid the transportation costs to bring 6 persons to the Virginia Colony, Bartholomew Mears being one of them. On 26 Mar 1662 William Taylor and Bartholomew Mears were together granted 500 acres for the transport of 10 persons (Nugent, Vol. I, p. 419). The land was bounded on the east by land of John Evans and "part of the Beaver Dams of Matchipungo Creek" and on the west by lands of the head of Occohannock Creek. On 5 Apr 1666 Bartholomew Mears was granted 300 acres in the same area for the transport fo 6 persons (Nugent, Vol. I, p. 551). On 4 Oct 1668 he and William Taylor divided their 500 acre patent, Taylor being deeded 300 acres by Bartholomew Mears and holding the remaining 200 acres (Acc Co Deeds & Wills, 1664-1671, p. 94). Bartholomew Mears received a new patent on 9 October 1672 for his entire 500 acres (Nugent, Vol. II, p. 119). Whitelaw, p. 749-751 locates this patent as approximately half way between present day Painter and Keller, to the east of US Route 13. The land was crossed by Beaver Dam Branch of Machipungo Creek, which later became known as Otter Dam Branch, before being called Mears Branch, and is shown on present day maps as Frog Stool Branch. On 25 Oct 1679, Bartholomew Mears, planter, bought 355 additional acres from John Cropper of Somerset County, MD for 1600 pounds of tobacco, "the plantation whereon John Kellam now dwelleth at head of Occohannock Creel (Acc Co Wills & Deeds, 1676-1690, p. 167). Whitelaw, p 600, places this land to be west of present day US Route 13, south of Pungoteague. With this purchase Bartholomew Mears owned 855 acres.2,3 |

According to Whitelaw, when Mark Mears died intestate in 1773 he was succeeded by a George Mears, who in 1795, wife Peggy, left all his land to a son John. In 1798 this son John sold 106 acres by survey to Francis Savage. The bounds mentioned a schoolhouse, which would have been about where the old road turns northwest towards Keller..5 |
