Chancery suit* | 27 December 1820 | He was named in a chancery suit on 27 December 1820 at Accomack Co, VA. The bill of complaint of Colemore Bird & Hetty his wife, formerly Hetty Taylor, state that Abednigo Taylor, late of this county, owned in his own right negroes slaves. In the fall of 1811 he went to the West Indies in the Schooner ______ commanded by Captain Crippen Taylor Jr of this county and owned by Crippen & Thorowgood Taylor, merchants of the county. That your orator & oratrix have understood and believe that it was expected that the said vessel would return to this county about Christmas in the same year 1811. That the said schooner arrived safely in the West Indies and after transacting their business about the 3 day of December 1811 bounty to the country, having on board the said Abednigo Taylor and the rest of the crew. After they had been at sea about twenty days and probably near the American Coast, a sever gale of wind came on and a number of vessels were lost. The said schooner was spotted by another vessel the day before the gale of wind came on, bound direct to this county and being only about 100 miles from Cape Henry the said schooner and her crew have not been heard from by her owners, or the friends of any persons on board and no doubt but that she and her whole crew were lost in said gale of wind. They further show that at the time of the death of said Abednigo Taylor, he left no will, nor did he leave any widow or children, but left his father Teackle Taylor living. They have been informed that by the laws of this Commonwealth that on the death of Abednigo Taylor his father was entitled to the aforesaid slaves and took possession thereof and held them until his death. He died intestate in January 1813 leaving four children: your orator Hetty, and James B. Taylor, Henry Taylor and Samuel Taylor. They are advised that the aforesaid slaves, as well as the other estate of the said Teackle Taylor, dec'd, are due to them. They further show that since the death of Teackle Taylor the aforesaid James B. Taylor and Henry Taylor have taken possession of said slaves and have all of them in their possession except two, one of whom is now in the possession of Michael Robins and another in the possession of Thorowgood Taylor, both of who alleged that they purchased them from the said James B. Taylor and Henry Taylor. Your orator & oratrix presume that such a purchase cannot affect the rights of you oratrix, being at the time of her marriage with your orator which took place in 1820, under that age of 21 and still being under that age. The orator states that since his marriage to your oratrix, he has frequently applied to James B. Taylor, Henry Taylor, Samuel Taylor and Thorowgood Taylor and Michael Robins and furthermore that the said Michael & Thorowgood should surrender up the slaves purchased by them and the said James B. Taylor & Henry Taylor would consent that all the slaves belonging to Abedingo Taylor should be equally divided in an amicable way without the expense of a law suit among your orator (in right of your oratrix) and James B., Henry & Samuel Taylor. But since they did not comply your orator & oratrix have brought suit. On 1 Sep 1820 James B. Taylor, Henry Taylor, Samuel Taylor, Thorowgood Taylor and Michael Robins were summoned to appear in court on 27 Sep 1820 to answer the above bill in Chancery exhibited against they by Colemore Bird and Hetty his wife. (NOTE: The suit also outlined that if the defendants did not prove otherwise, commissioners would determine the value of all the slaves which would be divided equally by commissioners between the late Abednigo Taylor's four sibling named in the suit.)3 |

John W. Byrd Sr.
M, b. circa 1745, d. 1829
Birth* | circa 1745 | John was born circa 1745 at Accomack Co, VA.1 |
Biography* | | The fact that he inherited Solomon Bird's land shows he was the eldest son. |
Anecdote | 1766 | On 27 October 1766, Edmund Poulson and Elizabeth Parker, executors of John Parker, sold to John Bird, Ship carpenter, 50 acres of land on Deep Creek, for 33 pounds 5 shillings (Deeds 1751-1770, p. 437). On 25 January 1770, John Bird, Ship Carpenter, and Mary, his wife, sold the same land to Southy East for 35 pounds (p. 675). These deeds show John Bird's trade and that he had married by 1770. |
Marriage* | circa 1768 | He married Mary (-----) circa 1768. The maiden name of this wife has not been found. She could have been a Parker. Mary Bird was deceased by 7 June 1790, when John Bird was issued a bond to marry (2) Esther Ross (MLB 1774-1806, p. 4)..1 |
Marriage* | 7 June 1790 | He married Esther Ross on 7 June 1790 at Accomack Co, VA. William S--- was the security on the 1790 Acc Co M.L.B. of John Bird and Esther Ross..2 |
Anecdote | 1793 | On 1 January 1793, John Bird bought 36 acres of land and marsh from Solomon, Johnson, Senr, "at head of Cat Tail Creek, being part Johnson bought of John Upshur, where said John Bird now lives" (Deeds 1793-1791, p. 60). He paid 27 pounds. It appears John Bird had been living here, at least from 1783, when his name was grouped with Solomon Bird, Senr and Solomon Bird, Junr in the tax list of that year, and continued to live on this land for two more years before moving into his father's home, after the death or marriage of his sister Esther and the marriage of sister Rebecca. He likely became a farmer at this time. |
Anecdote* | 1800 | The 1800 Federal Census gives John Bird, Senr as head of a household, aged over 45 years. There was one other male in his household, 16 to 26 years of age, and eight females, one of whom was likely his sister Scarbough. He owned four slaves in 1800. In 1810, John Bird, Senr was again over 45 years of age, as was his wife. There were two other males in his household, one under 10 years and one 10 to 16. Two young females were of the same ages, under 10 and between 10 and 16. In 1820, John Bird was again over 45, as was his wife. There were two males aged 16 to 26 in the household, a daughter aged 16 to 26, a daughter aged 25 to 45, and a daughter aged 10 to 16. Other members of the household in 1820 appear to have been a married daughter, aged 26 to 45, her husband aged 26 to 45, with their two children. John Bird was circa 75 years of age in 1820 and would have needed assistance in operating his farm. He still owned four slaves. |
Anecdote | 1802 | John Bird's name appeared on two deeds after 1800. On 29 August 1809, John Bird, Senr sold 6 acres to John Bird, Junr for $6 (Deeds 1807-1810, p. 244). On 6 September 1810, John Bird, Senr sold to James (freed by Hall)", a black woman named Broadus, two Negro boys Levi and Ishmal, and a Negro girl Tabby, for 11 pounds (Dist. Court Deeds 1807-1830, p. 161). |
Will* | 6 July 1810 | He made a will on 6 July 1810 at Accomack Co, VA. Bird Bird Sr. named a son Ebourn Bird and a daughter Catherine Bird. The executor was Thorogood Taylor. Witnessess were Crippen Taylor, John Kilmond, Cumfort Young, L.G. Taylor and Samuel H. Holland. At probate on 1 Dec 1829, John W. Bird opposed. John Killman gave oath (Comfort Young and Crippen Taylor being deceased). Thorogood Taylor also testified to the hand writting of Crippen Taylor. Securities for the bond to probate were John W. Bird and Raymond Riley (Acc Co Wills&c, 1828-46, p. 49). John Bird, Senr left all his lands "unto my son Ebourn". He gave this son "one still and tub and worme, one Cyder Mill and Cyder casks also one Gun one Broad as first choce my chist (chest of drawers) one Bade and furniture Suckont choys (second choice)". He left daughter Cathren Bird "all my nigrows" and the balance of his estate. John Bird, Senr's second wife appeared to be living when he wrote his will, and as late as 1820, but he did not name her in the will, nor was she named in the settling of his estate. His two eldest sons were both deceased when the will was probated.. |

Probate* | 1 December 1829 | John's will was probated on 1 December 1829 at Accomack Co, VA.3 |

Abraham Marshall1
M, b. circa 1760, d. before 30 September 1805
Biography* | | Abraham Marshall was grouped with his brothers in the Acc Co 1784 tax list; Samuel Marshall Jr., Thomas Marshall, Sexes Island; and Sampson Marshall. The 1800 Census lists Abraham Marshall, Sax. Island, as age 26-45 (40). There was a female in his household of the same age and another female age 10-16, indicating he may have married circa 1785 and had a daughter. When Abraham's brother Benjamin bought 30 acres of land on Saxis on 16 Oct 1800, it was bordered on one side by land owned by Abraham Marshall. No record has been found of Abraham buying land, as his name has not been found in the Acc Co deed books at all. If he had been married and had a daughter as indicated by the 1800 Census, both his wife and daughter were apparently deceased by 1805. |
