All which will more fully and at large appear by reference to the said Last Will and Testament, a duly authenticated copy whereof, is herewith filed, marked "A", and prayed to be taken and considered part of this bill. The Estate of the said Smith Milliner devised and bequeathed as aforesaid, consisted in part of a Tract of Land situated near the Court House of this County, containing, by estimation, ninety six acres, and adjoining the lands of John W. Gillet, Isaiah N. Bagwell and others. The said Jane Milliner, having taken possession of the Estate aforesaid under and by virtue of the clause of the said will herein first above recited, departed this life on or about the ____ day of February A.D. 1853, leaving Catharine, the wife of your orator, formerly Catharine Milliner, Eliza Walker, formerly Eliza Milliner, and Maria Milliner, children of the said Testator in his said will mentioned, surviving her - no other children of the said Testator were living at the time of the death of the said Jane Milliner. Since the death of the said Jane Milliner, to wit, on or about the _____ day of October A.D. 1856, the said Catharine, wife of your said Orator John R. Melson, departed this life, leaving children, viz: William Henry Smith Milliner, Levin J. Melson, Margaret J. Melson, Wesley T. Melson and John R. Melson, your orators and oratrise aforesaid, surviving her. At the death of the said Catharine, the interest in the tract of Land aforesaid which she owned and held, descended and passed to her said Children in fee simple, subject to the life estate of your Orator, John R. Melson, as tenant by the Curtesy - On or about the ____ day of October A.D. 1857, the said John R. Melson, infant child of your Orator, John R. and Catharine his wife, departed this life, leaving your Orators and Oratrise William Henry Smith Milliner, Levin J. Melson, Margaret J. Melson and Wesley T. Melson his heirs at Law. Subsequent to the death of the said Jane Milliner, and in the life time of Catharine, the wife of your Orator, John R. Melson, a contract was entered into verbally amongst the parties entitled as aforesaid, you said Orator repreesnting his wife, whereby it was agreed that partition of the premises should be made by persons chosen for the purpose and fully authorized to act in the matter; and in persuance of this contract and agreement, certain persons were selected, who undertook to make the said partition, and to allot to the parties their several and respective portions of the said tract of Land; but leaving their work incomplete, no deed of partition or other writing which might be evidence of title and partition, was even executed by any of the parties aforesaid. Your orators and Oratise are advised that such a contract in reference to real estate is null and void, and could not be offered in evidence of title to any particular part or portion of the said premises by any one of the parties to whom such part or portion may have been allotted and assigned. Your Orators and Oratrise are advised that the said Tract of Land remains, for all purposes of legal title or ownership, undivided.7 |
