Anecdote | 26 June 1848 | Teackle Elliott, Plaintiff, against Susan G. Elliott, William & Catharine S. Elliott, Defendants in Chancery. This day came the plaintiff by L.J. Bell his counsel, and filed his bill; and it appearing to the court that the defendants William and Catharine S. Elliott are infants, on motion of the plaintiff by his said counsel , Revell West, is appointed their guardian ad litern; and thereupon the said defendant Susan G. Elliott appeared in her own proper person and filed her separate answer and the defendant William and Catharine S. Elliott appeared by their guardian ad litern and filed their joint and several answer. This cause then came on to be heard upon the said bill and answers, and was augured by counsel. On consideration whereof the court doth adjudge, order and decree that dower by assigned to the said Susan G. Elliott of a full third in value, of the two separate and distinct lots of woodland mentioned in the bill of complaint in this cause, the on e containing by estimation thirty acres and adjoining the lands of Geo. B. Mapp and others the other containing by estimation twenty acres and adjoining the lands of John H. Longsdale and others. That after assignment of dower as aforesaid and set forth in the bill of complaint in this cause(except that portion assigned for dower to the said Susan G. Elliott in the lots in Locustville in said bill mentioned and described which premises are described as follows: a parcel of land situated in Locustville in the Parish of St. George in the County of Accomac, containing about ten acres, divided into several distinct lots, with several dwelling and other houses thereon, and adjoiing the lands of Custis W. Kellam and others; a certain tract or parcel of woodland situated in the parish and county aforesaid, containing by estimation thirty acres and adjoining the lands of Geo. B. Mapp and others; a certain other tract, or parcel of woodland situated in the parish and county aforesaid containing by estimation twenty acres and adjoining the lands of John H. Longsdale and others, in equal proportions among the plaintiff Teackle Elliott and the defendants William and Catharine S. Elliott. That division be make of the said slaves to wit: Sylvia, Moses, Ibby, Mary, Thomas and John among the plaintiff Teackle Elliott and the defendants William & Catharine S. Elliott according to their respective rights and interests therein. That the said Susan G. Elliott and Thomas P. Copes, administratrix and administrator jointly of William Elliott dec'd do deliver the said slaves to the said commissioners herein afterwards named to be divided by them amongst those entitled to the same according to the decree of this court and that Solomon Bunting, John White and John E. Ames be and they are hereby appointed commissioners for the purpose of making such partition and division any two of whom may act. That the said commissioners before proceeding to the execution of their duties as such shall be severally sworn before a justice of the peace of this county honestly and impartially to execute the trust reposed in them and to make partition and division as directed by this court. That the said commissioners after the assignment of dower in the two lots of woodland above mentioned as by this decree directed shall divide the said lands and premises into there equal parts, quantity and quality relatively considered and that they allot to the complainant one of the said equal third parts of the said premises; to the defendant William Elliott one other of the said equal third parts; and to the defendant Catharine S. Elliott the remaining equal third part, to be held and enjoyed by the said parties in severalty according to their right and interest therein as aforesaid; and that the said commissioners shall designate the parts or portions so allotted to each of the said parties and the boundaries thereof by sufficient description and monuments. That the said commissioners do also divide the said slaves so as to allot to the complainant one third part thereof in value, to the defendant William Elliott one third thereof in value; and to the defendant, Catharine S. Elliott the remaining third part thereof in value to be held by the said complainant and the said defendant William and Catharine S. Elliott in severalty in absolute property. But the complainant and the defendants William and Catharine S. Elliott shall not have the benefit of so much of this decree as refers to the slaves aforesaid until they either jointly or severalty or some one for them shall have entered into bond or bonds with sufficient security, before the Clerk of this Court in his office in a penalty double the value of the said slaves, to be ascertained by the said commissioners payable to the said Susan G. Elliott and Thomas P. Copes, administratrix and administrator jointly of William Elliott dec'd and conditioned to refund their respective due proportions of any debts or demands which may hereafter appear against the said William Elliott dec'd and the costs attending the recovery of such debts. And it is further ordered, adjudged and decreed that in case partition of the said real estate and division of the said slaves cannot be made with perfect equality among the said parties, according to their respective rights and interests therein, unless compensation be made by one or more of the said parties to the other of them for equality of partition and division, that then and in that case, the said commissioners, or such two of them as may make said partition and division as certain and report the proper compensation which ought to be made for equality of partition and division and by which of parties the same should be paid and to which the same ought to be allowed. And it is further ordered that the said commissioners be authorized to employ a surveyor and to cause all necessary maps and surveys to be made and that they make a report of their proceedings herein, and of the manner in which they shall have executed this decree to this court.5 |
