One moiety or one half thereof and 1/4 of one moiety doth belong to the said plaintiff, and 3/4 of the other moiety doth belong to the said defendants; that the said defendants do not permit division, although the said Dennis Kelly is entitled to one moiety & 1/4 of one moiety of the said lands by virtue of a decree of Accomack County Court 2 Apr. 1812 wherein John Custis & William Robinson Custis were plaintiffs & William Nock & Agnes Nock & Lucretia Nock, children and heirs of Elizabeth Nock, were defendants, the said land being sold according to the said decree, & the said Dennis Kelly being the purchaser of the said land being recovered by the said William Nock & Elizabeth his wife against Joseph Powell in the District Court of Accomack & Northampton on the 17 Oct. 1808; Sally Bayne appointed guardian to the infant defendant Betsy Bayne, & John Bull guardian to the other infant defendants for the purpose of defending this suit. Surveyors report: 14 Jan. 1813 - A certain tract of land containing 173 3/4 acres situate near Pocomoke in the county aforesaid, heretofore belonging to Joseph Powell & by him sold to Walter Bayne, Esq., & Elisha Garrett, both now dec., and from whom, or their heirs, William Nock & Elizabeth his wife afterwards recovered 1/2 & 1/4 of 1/2 in an undivided state, which interest of the said William Nock & Elizabeth his wife in the said lands they afterwards mortgaged to John Custis & William R.
