Coleburn, wife of James H. Coleburn, for life, with remainder to his grandaughter Betsy F. Coleburn, his plantation called Snead's & Hargis, containing 40 acres, with a contingent limitation to William D. Outten & John H. Copes & Elizabeth Copes; the said Mathias Outten devised to his grandchildren John H. and Elizabeth Copes his two lots in the town of Drummond, and also devised to his son William D. Outten his field called the Joynes field, also the houses and lots on which the testator lived containing 1 acre; he also directed that the lands purchased by him from William R. Bunting, and also the 16 acres purchased by him from Mckeel Bonwell should be sold for the payment of his debts, and also gave his executor the right to sell the field called the Monger field if necessary for the same purpose, and appointed your orator and the said William D. Outten executors. The land devised by the said Matthias to his daughter Sally T. Coleburn, is the same land mentioned by the said Matthias in the second deed above mentioned to your orator, and expressed therein as containing 50 acres; the lots devised to his grandchildren John H. and Elizabeth Copes in the said will are the same lands conveyed by the first deed of mortgage to your orator; the land devised to the said William D. Outten is the same lot conveyed by the second deed to your orator; the land devised to the said William D. Outten called the Joynes field is the same conveyed in the second mortgage to your orator; the land directed to be sold and purchased by the testator from William R. Bunting is the same land conveyed in the first deed of mortgage; the land directed to be sold called the Monger field, is the same land conveyed in the second deed of mortgage containing 20 acres; the land directed to be sold purchased from Mckeel Bonwell was conveyed in neither of the aforesaid deeds; after the death of the said Matthias Outten your orator ascertained that the testator was indebted to a certain John B. Walker, his late ward, in a greater sum than the value of the whole real estate, and that there is still a considerable balance due the said Walker &c.5 |
