Court - namd in suit | 5 May 1703 | He was named in a lawsuit on 5 May 1703 at Accomack Co, VA. Capt. Bennet Scarburgh had brought action against Charles Venetson “for words.” Capt. Henry Custis (attorney for Venetson) submitted a plea in writing; Capt. Tully Robinson (attorney for Scarburgh) asked to answer in the morning. Now that the case was called, Scarburgh wanted it delayed because his attorney had his papers and because of the absence of “Capt. Robinson [who] was elected burgess for the county and obliged to attend at this present session of assembly upon public service.” Custis claimed that this was not a sufficient reason to delay the case, for the plaintiff was required by law always to be ready. However, the court agreed with Scarburgh and continued the case to the next court.7 |
