Shady (of Daniel) Fitchett1
F, b. circa 1792
Birth* | circa 1792 | Shady (of Daniel) Fitchett was born circa 1792 at Accomack Co, VA.1 |
Chancery suit* | 4 May 1804 | She was named in a chancery suit on 4 May 1804 at Accomack Co, VA. Orators & Oratrixes Jonathan Fitchett, Michael Fitchett, Mathias Taylor and Elizabeth his wife, Shady Fitchett (daughter of Salathiel), Thomas Newton & Peggy his wife, John Fitchett & Thos. B. Fitchett by Jno. Fitchett his next friend (guardian), Shady Fitchett (daughter of Daniel) by Jona. Fitchett her next friend (guardian) & Clara Trower Davis. Salathiel Fitchett Senr formerly of this county, but now sometime dec'd, being in his lifetime, besides other considerable estate, possessed in his own right of sundry slaves, died, and on 13 Jan 1767 made his will, which since his death has been proven and recorded, and by his will he lent to his wife Shady Fitchett, during her widowhood, all the remaining of his moveable estate, after some few specific legacies; & at her death or marriage he gave all the moveable estate including negroes, to be equally divided among all his children, except his son Wm., which will more fully appear by reference to said will hereto annexed (not in chancery papers file). That besides the said Wm. who by said will is excepted from the said bequest, the said Salathiel Fitchett Senr left the following children: Clara Trower Fitchett & Shady, Sinah & Annaritta Fitchett, Salathiel, Thomas, Jonathan & Severn Fitchett & also his wife then pregnant with his son Daniel Fitchett. Shady Fitchett the widow of Salathiel the testator, took the slaves under the bequest to her and lately died on 21 March 1804, leaving of the slaves aforesaid, a negro man named Peter. That slave Peter now belongs equally to your orators & oratrixes undivided, to the children of the said Salathiel Fitchett Senr, now living and the representatives of those deceased, except William, according to the limitation in the said will, of the said slaves, after the widowhood of the said widow. That the children of Salathiel Fitchett Senr, there are now living Jonathan, Shady the wife of Wm. J. Young, Sinah the wife of Crippen Taylor & Clara Trower, now Clara Trower Davis. Salathiel Fitchett the son of the testator is dead, some time since, leaving children: Michael Fitchett, Elizabeth the wife of Mathias Taylor, Shady Fitchett, & Peggy the wife of Thomas Newton. That Thomas Fitchett, the son of Salathiel the testator, is also dead, leaving children John and Thomas B. Fitchett. That Daniel Fitchett is also dead leaving a child Shady Fitchett. That Annaritta is also dead leaving a child Betsy Taylor & that Severn Fitchett is also dead leaving children Peggy & Nancy Lemmon Fitchett, that Jonathan is entitled to 1/9 part of the slaves; the said Wm. J. Young & Shady his wife in right of Shady is entitled to 1/9 part; Crippen Taylor & Sinah his wife in right of Sinah to 1/9 part; Clara Trower Davis to 1/9 part; Michael Fitchett, Mathias Taylor & Elizabeth his wife in right of Eliza, Shady Fitchett & Thomas Newton & Peggy his wife in right of Peggy to 1/9 part; John & Thomas B. Fitchett to 1/9 part; Shady Fitchett, daughter of Daniel to 1/9 part; Betsy Taylor to 1/9 part and Peggy & Nancy Lemmon Fitchett to 1/9 part. Your orators & oratrixes further show that it would be the interest of the parties to have the slaves sold and the money arising from the sale to be divided among them according to their respective interests therein. That Betsy Taylor, Peggy H. Fitchett & Nancy L. Fitchett being infants underage cannot consent to a sale & division thereof nor can the same be effected in any way save only by the aid of the court in chancery. Therefore a sale & division may be decreed according to the respective rights of the said parties may it please the court to grant the "Com:W. writ of Spa" to the said Wm. J. Young & Shady his wife, Crippen Taylor & Sinah his wife, Betsy Taylor, Peggy H. Fitchett and Nancy Lemmnon Fitchett to be directed commanding them & each & every of them that on a certain day and under a certain pain therein to be limited and inserted they be & appear &c. The joint answer of Wm. J. Young & Shady his wife, Crippen Taylor & Sinah his wife and also of Betsy Taylor, Peggy H. Fitchett & Nancy L. Fitchett, infants by Zadoc Nock their guardian specially appointed to defend this suit, to the bill of Complaint of Wm. J. Young & wife &c. The defendants' answer to the bill is that they cannot gainsay the truth of the matter stated in the bill, that they have no objection to a sale of slave Peter & a division of the money arising therefrom among the parties and submit to such decree in principles and consistent with equity & right.
