Lee swore it was done without his knowledge or consent. Wise's attorney (Mr. Tully Robinson) entered a plea in abatement, but it was overruled. The court considered that Sarah Helmot, "while under coverture" gave her child to Wise; the agreement was therefore invalid. Ordered that Wise return Wm. Helmot to Lee and pay the costs of the suit. John Wise, Jr., requested and was granted liberty to appeal the above decision to the next General Court. Both parties gave security.3 |

Lee asked that several witnesses give depositions to prove that Joseph had been apprenticed to learn the trade of tailor. Joseph, who was present in court, admitted he was indentured to Lee by his father and said he was willing to serve the term. Deposition of Metilda Wise aged about 24 years: At her home about 10 March [1694/95], Metilda saw Peter Prichard, Sr., sign , seal and deliver to James Lee an indenture in which Prichard's son Joseph was bound to serve Lee for four years and three months to learn the trade of a tailor. Signed 8 April 1696, by Matilda Wise. Deposition of Henry Boats aged about 18 years: About 10 March 1694/95, Mr. John Wise, Sr., was requested to write an indenture between Peter Pritchard, Sr., and James Lee, in which Pritchard's son Joseph was apprenticed for four years three months to learn the trade of tailor. Signed 8 April 1696, by Henry Boats.2 |

The condition of this obligation is such that 7 cows with calf or calves and one bull aged between 3 & 8 years be delivered to Thomas Jervis when he attains the age of 16 years in the colony of Virginia or Maryland where said Hudson or his heirs may have them and to deliver to Robert Jervis when he shall attains the age of 16 years, 4 cows & calf or calves with one bull aged between 3 & 8 years in all respects as Thomas Jervis is to receive his and in case either Thomas or Robert die before they become age 16, then whole quanitity of cows & bulls above mentioned to the survivor. Bonwell and Arthur Killman now live, on condition that he pay to the children of Labin Evans $50 between them and to my son John Hoffman $50. To son N. S. Hoffman 6 acres of land between W. G.
