Scarburgh's house, and was there "in ye dining room where were present Elizabeth Morris and John Bloxum & his son John Bloxum, Jr., & Col. Scarburgh & wife. The Said John Bloxum, Sr., & ye said Elizabeth Morris having then & and there a controversy before ye said Col. Scarburgh, [I] did hear John Bloxum, Jr., say unto Elizabeth Morris, 'You are a thief, and I will prove you a thief tomorrow morning, if you please.'" Signed and sworn in open court on 19 March 1694/95, by James Lee.1 
Court - named in ord*20 March 1694/95He was named in a court order on 20 March 1694/95 at Accomack Co, VA. James Lee had sued John Wise, Jr., and at the last court an order passed against the sheriff for the appearance of Wise. Lee declared that Wise, who "had in his possession and did illegally detain a son of his wife's named William Helmot", pretended that the child's mother, after her marriage, had given William to him. Lee swore it was done without his knowledge or consent. Wise's attorney (Mr. Tully Robinson) entered a plea in abatement, but it was overruled. The court considered that Sarah Helmot, "while under coverture" gave her child to Wise; the agreement was therefore invalid. Ordered that Wise return Wm. Helmot to Lee and pay the costs of the suit.
John Wise, Jr., requested and was granted liberty to appeal the above decision to the next General Court. Both parties gave security.3

James Lee petitioned that Peter Pritchard had bound his son Joseph as an apprentice to Lee by an indenture with a term of four years three months. Lee claimed that the indenture had been surreptitiously taken out of Lee's box so he "might be by the father of ye said boy defrauded of his service." Lee asked that several witnesses give depositions to prove that Joseph had been apprenticed to learn the trade of tailor. Joseph, who was present in court, admitted he was indentured to Lee by his father and said he was willing to serve the term.
Deposition of Metilda Wise aged about 24 years: At her home about 10 March [1694/95], Metilda saw Peter Prichard, Sr., sign , seal and deliver to James Lee an indenture in which Prichard's son Joseph was bound to serve Lee for four years and three months to learn the trade of a tailor. Signed 8 April 1696, by Matilda Wise.
Deposition of Henry Boats aged about 18 years: About 10 March 1694/95, Mr. John Wise, Sr., was requested to write an indenture between Peter Pritchard, Sr., and James Lee, in which Pritchard's son Joseph was apprenticed for four years three months to learn the trade of tailor. Signed 8 April 1696, by Henry Boats.2

The court acquitted Bradford, who paid his present tax.12

Mrs. Rebecca Coleburne, executrix of the will of Robert Colebounre, (attorney: HC [Henry Custis]) sued James Lee for breach of articles in a lease; Lee had rented 50 acres of land at Nickawamson from Robert Coleburne for 15 years. Now Rebecca was suing for the penalty in the lease, 5000 lbs tobacco. Lee's attorney (Mr. Tully Robinson) put in a plea of abatement, which the court overruled. A jury was impaneled and found for Lee. The court confirmed the verdict and dismissed the suit.17 
HeadrightOctober 1701He was named as a headright in October 1701 at North Carolina. Hannah (Rogers) Cockerham was granted 640 acres for transportation of a number of persons into North Carolina, including James Leigh Sr., his wife Sarah Leigh Sr., and their children. Hannah sold to Leigh 10 rights: James Leigh Sr., James Leigh Jr., Sarah Leigh Jr., Mary Leigh, William Holeman, Patience Leigh, John Leigh, Eliz. Leigh and Sarah Depee.18 
Anecdote*7 April 1702 These are to certify all whom it may or shall concern that I the subscriber do intend, God willing, to depart this county and remove my self and family unto North Carolina: if any person or persons hath any occasion to speak with me let them repair to my house at or near Wachapreague in this county, shall receive full satisfaction from me. Signed on April 7th 1702 by James Leighe(sic).
Then affix up at the court house by James Lee at a court then held for the said county and by him taken down April 7th 1702 and at the instance of the said Lee ordered to be recorded.19

James Leigh, Esq, for love and affection gave his son-in-law Robert Purser, planter, 221 acres of land on the south side of Pampeico River in Bath Co, part of 442 acres formerly belonging to Charles Mengure, dec'd, which for want of heirs was escheated to the Lords Proprietors, and was purchased from them by James Leigh as "highest of kin." On the next page of the deed book on the same date, James Leigh for love and affection gave his son-in-law Thomas Underwood 221 acres out of the same tract, possibly because his daughter was deceased by that time.20 
Will*23 September 1728James made a will on 23 September 1728 at Bath Co, NC. Leigh's bequest of a tract called "Accomack Entry" to his son John Leigh provided his descendants with the clue which led to the discovery of his origins.4

John Savage of the same county, 10,000 lbs tobacco for the use of Thomas Jervis & Robert Jervis, the sons of Christopher Jervis, late of said county, dec'd. The condition of this obligation is such that 7 cows with calf or calves and one bull aged between 3 & 8 years be delivered to Thomas Jervis when he attains the age of 16 years in the colony of Virginia or Maryland where said Hudson or his heirs may have them and to deliver to Robert Jervis when he shall attains the age of 16 years, 4 cows & calf or calves with one bull aged between 3 & 8 years in all respects as Thomas Jervis is to receive his and in case either Thomas or Robert die before they become age 16, then whole quanitity of cows & bulls above mentioned to the survivor. Hudson until he attain the age of 21 years. And likewise take charge of his stock and deliver the same in kind when he attains the aforesaid age. And also Wm. Hudson to buy for him a mare colt next spring to run with all its increase male & female for the use of said Robert Jarvace until he shall attain to the age aforesaid. And an account thereof to be exhibited annually to the orphan's court.5
