Brown, Sally Ballard, Mary Jane Hayman, Wesley Orem and Elizabeth his wife, Charlotte McGoffin and Louis Donaldson and Ellen his wife, which said bill of complainant ensues as follows, to wit: To the Honorable Thomas A. Spence, Circuit Judge of the eighth Judicial Circuit of Maryland. The bill of complaint of Sydney C. Long of Somerset County and State of Maryland respectfully represents that William H. Brown, late of Somerset County dec'd, was in his lifetime indebted unto your orator in the sum of $660 with interest from 21 Oct 1859, upon a certain bill obligatory of that date and for that sum for part of the purchase money of a tract of land called Rowley Ridge which said complainant had sold him, the said William H. Brown and which said Long purchased of Edward S. Maddox as will appear by a copy of said bill obligatory under seal of the Circuit Court for Somerset County, herewith filed as Exhibit "A" and that on 13 Jan 1863 on a settlement between said complainant and said William H. Brown there still remained due of the balance of said purchase money after allowing all payments made by said Brown at sundry times, the sum of $667.31 for which balance a judgment was rendered in the Circuit Court for Somerset County on 9 Apr 1863, which judgment was for said balance of purchase money due on said Bill obligatory as aforesaid and your orator charges in lien and charge upon said land: Your orator further states and charges that being so indebted to your orator and to sundry other persons in large sums on whose behalf or such of them as will contribute to the expenses of this suit, this proceeding is instituted, the said Brown departed this life intestate and without issue at Somerset County aforesaid about the month of July 1863 seized of said tract of land called "Rowley Ridge" and no other real estate, that letters of administration on his personal estate have been granted to Levin Waters of Somerset county and that his personal estate is wholly insufficient to the payment of his debts and that a sale must be had to his said real estate with the aid of this Court. Your orator further charges that said William H. Brown left the following persons his only heirs at Law to wit: Francis Brown and Margaret Mure, wife of Thomas Mure of Somerset County, brother and sister of the whole blood, Sally Ballard, Eliza Orem, wife of Wesley Orem, Mary Anne Hayman and Charlotte McGoffin of Baltimore City, sisters of the whole blood and George T. McClemmy, John McClemmy and Ellen Donaldson, wife of Louis Donaldson, children of a dec'd sister Harriet of the whole blood that George T. McClemmy and John McClemmy are of full age and reside in Somerset County and Louis Donaldson and Ellen his wife are of full age and reside in Baltimore City. To the end therefore that your orator may have a decree for a sale of the said real estate or so much thereof as may be necessary to pay your orator's preference debt and such other debts as may remain unpaid from the personal estate and that your orator may have such other and further relief as his case may require. May it please your Honor to grant unto your orator the State of Maryland's unit of sulprence(?) to be directed to said Francis Brown, Thomas Mure and Margaret his wife, George T. Spence, Circuit Judge of the eighth Judicial Circuit of Maryland. The bill of complaint of Sydney C. Long of Somerset County and State of Maryland respectfully represents that William H. Brown, late of Somerset County dec'd, was in his lifetime indebted unto your orator in the sum of $660 with interest from 21 Oct 1859, upon a certain bill obligatory of that date and for that sum for part of the purchase money of a tract of land called Rowley Ridge which said complainant had sold him, the said William H. Brown and which said Long purchased of Edward S. Maddox as will appear by a copy of said bill obligatory under seal of the Circuit Court for Somerset County, herewith filed as Exhibit "A" and that on 13 Jan 1863 on a settlement between said complainant and said William H. Brown there still remained due of the balance of said purchase money after allowing all payments made by said Brown at sundry times, the sum of $667.31 for which balance a judgment was rendered in the Circuit Court for Somerset County on 9 Apr 1863, which judgment was for said balance of purchase money due on said Bill obligatory as aforesaid and your orator charges in lien and charge upon said land: Your orator further states and charges that being so indebted to your orator and to sundry other persons in large sums on whose behalf or such of them as will contribute to the expenses of this suit, this proceeding is instituted, the said Brown departed this life intestate and without issue at Somerset County aforesaid about the month of July 1863 seized of said tract of land called "Rowley Ridge" and no other real estate, that letters of administration on his personal estate have been granted to Levin Waters of Somerset county and that his personal estate is wholly insufficient to the payment of his debts and that a sale must be had to his said real estate with the aid of this Court. Spence, Circuit Judge of the eighth Judicial Circuit of Maryland. The bill of complaint of Sydney C. Long of Somerset County and State of Maryland respectfully represents that William H. Brown, late of Somerset County dec'd, was in his lifetime indebted unto your orator in the sum of $660 with interest from 21 Oct 1859, upon a certain bill obligatory of that date and for that sum for part of the purchase money of a tract of land called Rowley Ridge which said complainant had sold him, the said William H. Brown and which said Long purchased of Edward S. Maddox as will appear by a copy of said bill obligatory under seal of the Circuit Court for Somerset County, herewith filed as Exhibit "A" and that on 13 Jan 1863 on a settlement between said complainant and said William H. Brown there still remained due of the balance of said purchase money after allowing all payments made by said Brown at sundry times, the sum of $667.31 for which balance a judgment was rendered in the Circuit Court for Somerset County on 9 Apr 1863, which judgment was for said balance of purchase money due on said Bill obligatory as aforesaid and your orator charges in lien and charge upon said land: Your orator further states and charges that being so indebted to your orator and to sundry other persons in large sums on whose behalf or such of them as will contribute to the expenses of this suit, this proceeding is instituted, the said Brown departed this life intestate and without issue at Somerset County aforesaid about the month of July 1863 seized of said tract of land called "Rowley Ridge" and no other real estate, that letters of administration on his personal estate have been granted to Levin Waters of Somerset county and that his personal estate is wholly insufficient to the payment of his debts and that a sale must be had to his said real estate with the aid of this Court. Your orator further charges that said William H. Brown left the following persons his only heirs at Law to wit: Francis Brown and Margaret Mure, wife of Thomas Mure of Somerset County, brother and sister of the whole blood, Sally Ballard, Eliza Orem, wife of Wesley Orem, Mary Anne Hayman and Charlotte McGoffin of Baltimore City, sisters of the whole blood and George T.
