Court - namd in suit* | November 1764 | Paul Fabian III was named in a lawsuit in November 1764 at Northampton Co, VA. This plea by Benjamin Stratton, Jr claims that Paul Phaben, Jr (Phabin, Faben) has broken a covenant made between them. The agreement made in 1763 was that the said Paul would serve as Overseer for the ensuing year. The said Benjamin would find him 5 negroes, horses, plows, harrows and other farm equipment. Phaben agreed to work with the negroes in tending the crops. Also, the said hands were to cut (brick) wood for [making] 50,000 bricks and help make them in the fall. The negro woman shall stay in until the first day of March and then work out until the corn is layed. She shall spin while indoors. The said Benjamin is to have six shares in the crop. The agreement was witnessed by Mary Biggs. [Whitelaw states in Virginia’s Eastern Shore:128 that the oldest part of “Stratten Manor” was probably built by Benjamin Stratton [d 1717] circa 1700. One of the bricks in the north chimney has what looks like the date 1694. Higher up on the same chimney are three bricks clearly showing Benjamin Stratten 1764. This Benjamin would be the son of the original builder, and who, according to Whitelaw’s account, seemingly made substantial changes to the house then standing. The reference to bricks being made in 1764 under the direction of Benjamin Stratton, Jr [d 1783] as described in his plea abstracted above would serve to confirm Mr. Whitelaw’s supposition as to the dating and architecture of the house “Stratten Manor”.] The petitioner, Benjamin claims that the said Paul did not perform his duty as Overseer in any respect or cut the brickwood or help to make the aforesaid bricks or take good care of the stock nor the crops. He attended many of their games in the Bronx. He was a devoted member of the Naomi Makemie Presbyterian Church in Onancock. Buddy is survived by his daughter, Betty Ann Perry; grandson, Ed C. Perry and wife Kara; brothers, Calvin T. Perry and wife Verna, and Phillip M. Perry and wife Lynn; and several nieces and nephews. He was preceded in death by his wife, Betty Lou Perry; son, Edward “Ned” L. Perry III; brothers, Richard A. Perry and Gerald A. Perry; and sisters, Norma Lee Elliott, Barbara E. Craver, and Janice R. Banks. The family wishes to acknowledge and thank Kathy Merritt for her kindness and care given to Buddy. She worked tirelessly to ensure his comfort and maintain his dignity. She had been a useful and faithful member of the Baptist Church for many years. Funeral services were held Monday, February 19th at Harborton Baptist Church. Interment was in the Hollies Cemetery. She is survived by six children, Mrs. James Custis, Mrs. Annie Smith, Mrs. Kate Bonniwell, Mrs. Bettie Mister, and Mr. John W. Guy, of Harborton and Mrs. M.S. Harris of Baltimore, one sister Mrs. Alice M. Fulmer of Smithfield, and a brother, Capt. W.T. Mister, of Makemie Park.4 |

John Fleaharty and Jonathan Guy had had their disagreements over money, but it appeared that Fleaharty was patching things up when he visited Guy and asked if he wanted to buy a canoe. Guy wanted the canoe, but had no money, so Fleaharty inquired about Guy’s gun. In a rather bold move, Fleharty then entered Guy’s house, took the gun down and started home; he at first said he would pay Guy when he got there, but later revealed that he had intended to take the gun all along, even if Guy had not been home. In the safety of his own house, Fleaharty refused to pay for the gun or return it unless Guy paid an account. Guy, who maintained it was Fleaharty who owed him, asked for the gun, but Fleaharty “kept him off with a Large knife which he had Drawn.” Guy then announced he would take the canoe so Fleaharty “should not have that to Run Away in.” As Guy was going down to the creek, Fleaharty followed; when Guy struck at him, Fleaharty “made a Pass at him with his Knife and Cut his Jacket But Did not enter his Body.” Afterwards Guy went back a second time and asked for his gun, but Fleaharty, who again demanded money, stood in the door with his knife and the loaded gun, threatening to shoot Guy’s legs from under him. It was not long before Fleaharty broke up housekeeping and left, but he did not get away. Brought to trial in May 1769, for stealing the gun as well as counterfeiting coins and currency, Fleaharty was found guilty of felony by the Accomack court, who then sent him to Williamsburg for trial. The next month, however, a notice appeared in the Virginia Gazette stating that John Fluharty from Accomack had been acquitted.3 |
