By virtue of a warrant issued by Henry Scarburgh (gentleman, a justice of this court), Hathan Fittaplace Chandler was committed to jail on suspicion of "casually killing his wife Mary Chandler by a Shott out of a Gun." Chandler now appeared in court and two witnesses were questioned. They declared "that when They came to the House of the aforsd Hathan Fittaplace Chandler (being sent for by him) they found him sitting on the Floor with his wife in his Arms and seeing her bleeding & a wound in her side They asked him how it happened, who answered, The Gun was laying in my Lap and accidently Fired & killed my Dear Creature & she cannot speak to to (sic) me, & that They having asked him how the Gun fired he answer'd that he thought it was by a spark out of the Fire which flew into the pan of the Gun the pan being open & he moving the priming with his Thumb, That they viewed the Gun & found the Steel up & the Cock half bent & the Flint not soiled and that the said Chandlers Hand was burnt & torn which They suppose to be done by the Gun flying back out of his Lap." While the court felt there was just cause for trying the prisoner at the General Court, they also felt the prisoner was bailable. Hathan and his securities (Delight Sheild, John Lecatt, Richard Rogers Jr., Thomas Lurton, Solomon Chandler, John Fitzgerrald and William Phillips) posted a bond of £500 sterling to be levied on their lands, tenements, goods and chattels if Hathan failed to appear at the General Court to answer for "casually killing his afsd Wife." - Richard Rogers and William Kennahorn each posted a bond of £10 sterling to ensure that they would appear at the General Court as witnesses “for our said Lord the King against Hathan Fittaplace Chandler who stands accused of casually killing his Wife.”.1 |
