When the will was proved on 3 Nov 1762 both witnesses stated that Dubberly did not recognize them when they went to his house and neither believed him "to be in his senses appearing to be like a man drunk . . ."1

To Eleazer Johnson n. boy Jacob and a horse colt called "Trample". To Hezekiah Johnson a fellow named Peter and a dark gray mare called "Fly". To Eleazer Johnson 100 A. being the westward part of the plantation whereon I now dwell extending easterly up Coldmans Branch to a small branch issuing out of the same near against Peter Kellum's house to include the westward part of my plantation. To Hezekiah Johnson 100 A. being the eastward part of my plantation, and for want of heirs to Eliakim Johnson. But if Eliakim, Eleazer and Hezekiah Johnson all die without heirs then the whole 200 A. to my brother Jonathan Smith. My friends Thomas Marshall son of John, and Obedience White extrs. Land inherited*1751He inherited land in 1751 at tract N113, west of Jamesville, Northampton Co, VA. Isaac Smith bequeath this tract in two parcels. He left the western 100 acres to Eleazer Johnson, or if he had no heirs, the succession was to be to Eliakim Johnson, then to Hezekiah Johnson, and finally to a brother Jonathan Smith. The eastern half he left to Hezekiah Johnson, but if heirs failed, the succession was to be to Eliakim Johnson, Eleazer Johnson or his brother Jonathan Smith. In 1757 the whole 200 acres somehow came into the possession of a John Shepherd who died intestate, and in this year his daughter Elizabeth with her husband John Harmanson of Northampton and his daughter Margaret with her husband Edward Ker of Accomack united in a deed for the 200 acres to John Fathery.3

The eastern half he left to Hezekiah Johnson, but if heirs failed, the succession was to be to Eliakim Johnson, Eleazer Johnson or his brother Jonathan Smith. In 1757 the whole 200 acres somehow came into the possession of a John Shepherd who died intestate, and in this year his daughter Elizabeth with her husband John Harmanson of Northampton and his daughter Margaret with her husband Edward Ker of Accomack united in a deed for the 200 acres to John Fathery.3
