The court accepted Edmund Allin as his security, and the clerk prepared the papers soon after the date of the order, but in contempt of the order, Henry Allin failed to give bond. Since the orphans might be defrauded by his embezzlement of their estate, it was ordered that Henry Allin be taken into custody until he gave security. At the next court he was to answer for his contempt and show why he had not performed the order.22
Anecdote3 April 1700 Ordered that Mr. William Martiall and
On 3 Apr 1700 in Accomack Court Mr. George Parker meet at the house of Henry Allen to inventory and divide the estate of James Atkinson (deceased) into four parts: one for Henry Allen (in the right of his wife Elizabeth, widow of Atkinson) and one part for each of Atkinson's three children. The children's parts were to be committed to the custody of Sebastian Cropper, who was to be responsible for them till the children attained lawful age.23
Anecdote4 June 1700 On 4 Jun 1770 in Accomack Court Elizabeth Atkinson (widow of James Atkinson and now wife of Henry Allin) requested that because of "her husband's improvidence & neglect in not maintaining her said son John (who was eight years of age ye 18th of October next) might be committed to ye care & tuition of Col. John Custis, who being present in court rendered himself willing (in reference to his wives (sic) relation to the said Elizabeth) to take the said John until he arrived to lawful age." The court approved the arrangement. It was also on this date that Henry Allin had in his possession a pot and rug that Daniel Esham and his wife had given to Elizabeth, daughter of James and Elizabeth Atkinson. Ordered that Allin pay court costs and give the items to Sebastian Cropper, to whom the orphans' estate was committed. (Side note: Execution on the order was returned 6 March 1700/01, by Wm. Dennison, subsheriff.)24
Anecdote6 August 1700 On 6 Aug 1700 in Accomack Court Mr. William Martiall and Mr. George Parker presented the inventory of the estate of James Atkinson (deceased) and the division they had made between Henry Allin and the children: Elizabeth, John and James Atkinson. Sebastian Cropper, who had been ordered to take care of the Atkinson orphans' estates, presented security (George Parker and Thomas Cope) to be responsible for it and deliver it to the children when they reached lawful age.25
Death*before 8 April 1701Henry Allen Sr. (ye bigger) died before 8 April 1701 at Accomack Co, VA. He was evidently dec'd by this date as on 8 Dec 1697 in Accomack Court Walter Harges and Francis Crossey sued Henry Allin for 150 lbs tobacco; ordered that Allin pay the debt and court costs. (Side note: The judgment was satisfied 8 April 1701, by execution served on Allin's estate in the hands of Mr. Robert Pitt. Signed by Wm. Dennison, subsheriff.)20
