Land bought*1686John Dalby (Matchipungo) bought land in 1686 at tract N52, Matchipungo, Northampton Co, VA. It was in this year that William Whittington sold 200 acres to John Dolby, describing it as being in a fork of Scott's Quarter Branch. The branch makes this fork just west of the seaside road and the land extended northwest from there. The land remained in the Dolby family until nearly the middle of the last century, but a lack of wills makes it difficult to trace the family line accurately. From various deeds from surrounding lands, in which bounds are given, it has been determined that certain owners were: 1740 John Dolby; 1747 & 1756 William Dalby; 1759 William & Joseph Dolby. In 1760 Joseph and Elizabeth Dolby sold the north 100 acres to William Satchell and that became merged with the land above it. Defendant & the said Roberts appearing, being summoned by the sheriff, and the said Roberts assumed in Court to put in a direct and perfect answer to the said Foster Jacob and Watts bill in Chancery. The said Roberts was to lodge in the Clerk Office 3 days before the next court to. On 15 Nov 1715 a bill in Chancery was read in Court which was exhabited by Robert Foster, one of the sons, and Risdon Jacob and Bridgett his wife, one of the daughters, and Smith Watts and Elizabeth his wife, one of the other daughters of Robert Foster, late of N'hamp County, Dec'd, plaintiff and Wm. Roberts Extr of the will of Elizabeth Foster, who was the Extrx of the will of Robert Foster, being called and the plaintiff appearing in person and Defendant by his attorney Mr. James Kempe and after a long debate between them the court is of the opinion that said bill in chancery is insufficient and not perfect in several parts, therefore the said bill is chancery is dismissed and plantiff to pay cost.6

Will*27 January 1708/9John made a will on 27 January 1708/9 at Worcester Co, MD. In his will John O'Wtten (Outten) of Somerset Co, MD, gave and bequeath to my loving son Thomas Outten my dwelling plantation to made out 200 acres of land and marsh to be bounded by the inlet adjoining next to William Selby and not go over into that marsh formerly belonging to Shop called Tensie for any part of said 200 acres. Secondly - I give and bequeath unto my loved son Samuel Outten 200 acres of land and marsh belong to it so far as Pegg or Prigg and so to have marsh along adjoing as ye woods bears in the 100 acres. Thirdly - I also give and bequeath unto my loved son Abraham Outten 100 acres of land to be laid out at the head of my tract my now dwelling plantation and beyound upon the division line of Thomas Selby and also 50 acres of marsh called Tensie formerly belonging to John Bishop. Fourthly - I also give and bequeath unto my well loved son John Outten all my lands and marsh belong to me lying on Marmuscoe Creek in the Neck called Condsque only excepted 50 acres sold to Peter Karsie as after will be mentioned. Fifthly - In case my son John should depart this natural life without lawful begotten issue of his body then these land and marshes bequeathed to him at Morumscoe to be the right of my son Thomas to enjoy the same my said son Thomas not to have any right or claim to that 200 acres bequeathed him in this will of my now dwelling plantation but the said 200 acres of land and marsh to be equally divided between my two youngest sons Samuel and Abraham. Sixthly - I give and bequeath unto Peter Kersie 50 acres of marsh being at the west end of Patent called Discovery lying upon a creek called Ease Creek near a Sandie Beach. Seventhly - all my land bequeathed in this will to my four beloved sons, sits., Thomas, Samuel, Abraham, and John, shall enjoy, dispose, make sale as to them shall seem meet as they attain age and to enjoy the same to them their heirs forever.
