Richard Shield (Sheale)

M, b. circa 1630, d. circa 1700
Last Edited3 Aug 2010
Birth*circa 1630Richard Shield (Sheale) was born circa 1630.
Headright*18 October 1664He was named as a headright on 18 October 1664 at Accomack Co, VA. It was on this date that Richard Sheale appeared on a certificate granted to Arthur Upshott (Upshur) for 300 acres of land.1
Anecdote*16 July 1667 On 16 Jul 1667 it was recorded that Arthur Upshott's servant, Richard Shale had a bastard child that was supported by the parish. Upshott agreed to deliver Shale to the court after he had served his time, if he was still alive and had not run away. Because Richard Shale unlawfully dropped off a child at Mrs. Jordan's house, Shale was ordered he be taken into custody and receive 20 lashes on his bare back.2
Tithable list*1674He was on the list of tithables at Accomack Co, VA, in 1674. He was shown as Rich. Sheale as one of Mr. Upshars (Upshurs) 3 tithables on Capt. Wm. Custis' list.3
Tithable list1676He was on the list of tithables at Accomack Co, VA, in 1676. He was shown as Rich. Sheale with 3 tiths of his own. (NOTE: He evidently had 2 sons over age 16 by this time.)4
Tithable list1677He was on the list of tithables at Accomack Co, VA, in 1677. He was shown as Rich. Sheale with 4 tiths on Mr. Thos. Ryding's list. (NOTE: He evidently had 3 sons over age 16 by this time.)5
Marriage*circa 1690He married Alice (-----) circa 1690.6
Headright20 March 1693/94Richard Shield (Sheale) was named as a headright on 20 March 1693/94 at Accomack Co, VA. It was on this date that Rich. Shale & Alice Shale were shown on a certificate issued to Mr. Arther Upshor (Upshur) for 950 acres of land. (NOTE: The assumption is that this was the first Richard Sheale, who left the colony shortly after appearing in the 1677 titable list and was now returning with a wife Alice.)6
Death*circa 1700He died circa 1700. Richard Sheale's name does not appear in the indexes to the Accomack County Order or Will books after 1677. Since later records show 3 Shield men (Delight, Richard and William) in the same precinct (Cap. Wm. Custis in 1674) as Richard Sheale was shown as having 4 tithables in 1677, implying he had 3 sons over age 16, then it seems likely that they were his sons.7

Land bought*10 March 1715/16He bought land on 10 March 1715/16 at White Marsh, Accomack Co, VA. Richard Shield bought 150 acres from Jonathan James & Mary his wife. Whitelaw shows that in 1734 Richard Shield sold this land to Joseph Custis, son of Henry, but Mary Frances Carey looked at the original record, which shows that Jonathan Shield sold the 150 acres to Joseph Custis on 3 Dec 1734. So Richard Shield had evidently died intestate and the land reverted to his oldest son Jonathan Shield.4,5,6
Will - Witnessed*20 February 1720/21Richard witnessed a will on 20 February 1720/21 at Accomack Co, VA. It was on this date that Jacob Sare, Richard Sheald and William Burton witnessed the will of William Parker, who left his plantation to grandson-in-law William James and also named David james and Rachel James in his will.7
Anecdote4 April 1721 On 4 Apr 1721 Sarah Booles, extr of her father-in-law William Parker, presented and swore to Parker's will, which was proved by the oaths of Jacob Lare, Richd. Sheild and William Burton.8
Anecdote*4 December 1722 On 4 Dec 1722 Rose Bager was presented in the May court for fornication and bastard-bearing and was ordered taken (into custody). Now in court and questioned about the paternity of her child Rose swore that Delight Sheild was the father. Ordered that Delight Sheild be taken into custody till posting a bond for his appearance at the next court and for his good behavior. Richard Sheild came into court and agreed to pay the fine of Rose Bager (single woman) for fornication and bastard-bearing. Ordered that Sheild pay 500 lbs tobacco to the churchwardens (at the laying of the next levy) along with court costs. Richard Sheild acknowledged himself bound to the churchwardens to keep the parish from the cost of supporting the child born to Rose Bager (single woman). 2 Apr 1723 - At the December court Rose Badger appeared to answer the presentment of fornication and bastard-bearing. Questioned about the paternity of the child, she swore that Delight Sheild was the father. The sheriff was ordered to take Sheild into custody, and he now appeared. After being questioned, he pleaded not guilty, but on the strength of Rose Badger's oath, the court decided that "he was Guilty of ye sd fact Laide to his Charge of adultery." Ordered that Sheild (at the next laying of the parish levy) pay 1000 lbs tobacco to the churchwardens. (NOTE: The assumption here is that this Richard Shield was the brother of Delight Shield and was paying the fine for him.)9

It was on this date that it was ordered that George Cutler, Thomas Burton, Delight Sheild and Richd Sheild, or any three of them, inventory and appraise the estate of John Weily and Thomas Taylor dec'd before the next court.10
Jury duty*4 June 1723He served on a jury on 4 June 1723 at Accomack Co, VA. He was shown as Richd. Sheald who was on a jury headed by John Parker.11
Anecdote*6 August 1723 On 6 Aug 1723 Richard Sheild informed the court that Jonathan James had recently died, leaving several small children and a small estate consisting "of things perrishable." James left a will in which he appointed his wife Mary and his son John as executors, but Mary was also now deceased, and the son was still a minor. When the relatives of the children appeared in court and "Reffused to take ye Burthen upon them," the court ordered the sheriff to take an inventory of the estate and report to the next court so further action could be taken for the benefit of the children.12
Anecdote3 March 1723/24 On 3 Mar 1723/24 Richard Rogers, who owned land on one side of Burtons Branch and intended to build a watermill there, petitioned the court for an order "for Liberty of ye Land on ye other side." Richd. Sheild informed the court that the land on the other side belonged to him; he went on to say the proposed mill would take away part of his orchard. Ordered that Mr. Tho. Burton and Mr. Francis Wharton go upon the land, view it and make a report to the next court. On 7 Apr 1724 it was noted that at the last court Richd. Rogers petitioned that he owned land on one side of Burtons Branch and wished to build a water mill; he requested an order for "Liberty of ye Land on ye other Side." Richard Sheild, owner of the land in question, appeared and informed the court the proposed mill would take away part of his orchard. The court ordered Mr. Tho. Burton and Mr. Fran. Wharton to go view the land; they now reported that Shield's orchard would indeed be impacted by the proposed mill. The court consequently ordered that no mill be built.13
Death*after 7 April 1724He died after 7 April 1724. It was on this date that Richard Shield last appeared in Accomack County Orders.13

Birth*1666Elizabeth Shield was born in 1666 at Accomack Co, VA. It is possible that this Elizabeth was the bastard child, that was mentioned on 16 Jul 1667 when it was recorded that Arthur Upshott's servant, Richard Shale had a bastard child that was supported by the parish. Upshott agreed to deliver Shale to the court after he had served his time, if he was still alive and had not run away. Because Richard Shale unlawfully dropped off a child at Mrs. Jordan's house, Shale was ordered he be taken into custody and receive 20 lashes on his bare back. (NOTE: This is primarly based of the fact that this Elizabeth named brothers William & Richard Sheel in her will.)2

Land inherited*1715He inherited land in 1715 at tract N87, Franktown, Northampton Co, VA. In 1704 Benjamin Walter left his part of this tract to his wife Elizabeth, who married William Hintch and 6 years later she alone sold it to John Dweman, who left no will, but in 1718 a Daniel Dewman left the same land to his brother Nathaniel. In 1738 Nathaniel left to his brother Jacob Dewman, but the will must have been written some years earlier, as the will of Jacob was probated in 1734. In it the latter mentioned a wife Bridget and daughters Rosannah and Elizabeth. In 1752 Joachim Michael (wife Margaret) left to his son Thomas half of this land which he said he had bought from John and Rose Waterfield. No deed had ever been given to him, so the same day the will was probated the Waterfields executed a deed to Thomas Michael, and the next year he purchased the other half from Baily and Elizabeth Scott, she being the other Dewman heir.2
