Signed: John Tyler, Babel Scot, Robert Trower, John Dixon, Michael Dixon, Thomas Spady and John Fitchett. The petition was "rejected at the April Court 1756, but no entry made." (NOTE: Although no location is indicated in the petition, it concerns land in the very lower section of N'hamp County where petitioners are known to have lived.)2

Will - Father's*8 August 1678William was named in his father's will on 8 August 1678 at Northampton Co, VA. He was shown as a son William Scott (under age) in the will of Thomas Scott.2 
Anecdote*1681 He was the eldest son of Thomas and Ann Scott. He was probably born between 1655 and 1660. He lived on land that is just south of what is now Cheriton near the head of King's Creek. In 1681 he bought 150 acres from his brother-in-law, William Mellinge. ( Husband to his sister Ann Scott) (Book XIV pg 17) In 1710 he purchased another adjoining 150 acres from his nephew William Mellinge. (Book XIX pg 177) William married first, before 1682, Elizabeth Hanby. She was the daughter of Richard Hanby and his second wife, Maria (Stratton) Chilcott. (See will of Richard Hanby, Book XIII pg 296) Richard and Maria were married in 1656. (See their marriage agreement Book VII pg 8). Maria was listed as a daughter and headright for Alice Stratton the wife of Henry Bagwell. (Book I pg 46) It is not known when Elizabeth died but in 1709 William married Ann Davis, the recent widow of John Davis. Ann was born Ann Nottingham and was the daughter of Richard Nottingham the immigrant who died in 1692. Ann had been married three times. Her first husband was Charles Parkes who died in 1694. ( will in Book XVII page 269). They had two daughters; Ann and Joan. Her second husband was Thomas Cowdrey, born 1658 and died in 1698. (will in Book XVII page 490. Her third husband was John Davis who died in 1709. (will in Book XVIII page 469) William died intestate around 1712 as his inventory was recorded by his widow Ann. He would have been about 55 years old. It is uncertain how many children William and Elizabeth had but their were at least two sons; William and Joseph. In 1711 William Sr gave one half of his land to his son William Jr. (Book XXI-R pg 7) Very little is known about Joseph. In 1722 Joseph bought 100 acres from his brother William. Another deed in 1725 reveals that Joseph moved to North Carolina and he sold the land back to William. This was part of the original 300 acre farm.3

Will - Bro-in-law*7 October 1683William was named in his brother-in-law's will on 7 October 1683 at Northampton Co, VA. In his will William Mellinge gave to my eldest son Robert Mellinge my 200 A. plantation I now dwell upon, except my loving wife Anne to dwell upon and enjoy the same for her life. Said son to be at age at 21, but if wife marries before, then both sons to be at age at 18. To my son William Mellinge 250 A. in the woods adjoining my plantation and the land sold to my brother-in-law William Scott. Wife extrx. My friend Owen Marsh to oversee. Witt: Richard Waterson, Elizabeth 'E' Watts, Owen Marsh. (Note: Agnes Barnes' and William Waters' deeds of gift to Robert Melling the son of William and Ann.)4 
Will - Bro-in-law2 April 1709William was named in his brother-in-law's will on 2 April 1709 at Northampton Co, VA. In his will John Knight gave to my son Charles Knight all my land it being 100 A. on the south side of the neck, but for want of his heirs to his brother John Knight. If my brother Dixon Knight should die without heirs, then his land that returns to me by my father's last will and testament to go to my son William Knight, said land being on the north side of the neck. To my loving wife Ann Knight all my cupboard goods not already given to my three sons. Wife extrx. My three [sons] to be at age at 18 if wife marries, but if she remains a widow, they to stay with their mother until 21, and not to dispose of their estates without the consent of their onkell William Scott. Witt: Benjamin Stratton, Richard Thorman, John 'X' Nelson.5

Land bought*1665Thomas Scott bought land in 1665 at tract N3, Northampton Co, VA. In 1658 Col. William Kendall and his wife Susanna Baker, the widow of Thomas Eyre and Francis Pott, sold Capt. Francis Pott's land to Thomas Moore and William Junis. In 1665 Junis had sold his half to Thomas Scott and Gilbert Skinner and the three owners now divided, with Moore getting 525 acres and Scott and Skinner each 262 1/2 acres. Skinner sold his to John Knight and Thomas and Ann Scott sold his quarter to William Kendall.3 
Will*8 August 1678Thomas made a will on 8 August 1678 at Northampton Co, VA. My four children William, Anne, Ellenor, and Thomas Scott to live together on my plantation and all things belonging to remain for their equal uses. When any of my children marry or leave the plantation, they to take their equal share. My son Thomas to be at age at 16. To my godson John Jones one cow calf. My son William extr. By his will the said William devised the remaining term to be served to his son, Benjamin, who in turn sold the petitioner's term for a considerable sum to John Elligood, planter. Since the term is now up, neither the said Benjamin nor John, although often required to pay the freedom dues according to law, have offered to do so. Verdict for the plantif.5

William Burton's peteition shows that the Court ordered the Old Church Road which runs thru the land of William Scott in and out of Old Plantation Neck to be stopped at the request of Benjamin Scott. A short time after the said William obtained a decree of the General Court which set the proceedings of this Court aside. Not withstanding the said Scott has kept the road closed and planted in corn. The said William asks the Court to order opening the road. Petition was rejected.7

Land inherited*1749He inherited land in 1749 at tract N85, south of Nassawadox, Northampton Co, VA. Joseph Scott left his part of this tract to his son William. In 1765 a survey of the land of William Scott showed 204 acres. The next year a survey of the 50 acres in the northeast corner of it was made for Thomas Dalby, but as there was no local deed to cover it, it may have been bought through the General Court.4 
Land sold*1770He sold land in 1770 at tract N85, south of Nassawadox, Northampton Co, VA. William and Anne Mary Scott sold the balance of the 154 acres to William Matthews, and shortly afterwards Henry Scott gave a release deed to Matthews, saying that William Scott had deeded to him by a General Court deed, subject to the life interest of William and Anne Mary Scott.4

She lived with her son, Bayly Scott, but supported and maintained herself. The said Sallathiel was granted administration on her estate. The said Bayly refuses to deliver the remainder of his mother's estate and has given away or hidden a number of articles such as bed curtains, clothes, etc. The said Bayly claims that his mother gave most of her possessions to him in her lifetime.5

Anecdote*10 July 1648 On 10 Jul 1648 William Shrimpton of Whitechurch, County of Southampton, Gent. assigned to Chatles Franklyn 35 cattle of all sorts which he had in Accomack in Virginia in the custody of Mr. Douglas (agent for Shrimpton) for the use of Margerie Hamby widow; and whereas Charles Franklyn by his letter of attorney, a copy of which was given to Rich: Hamby, did authorize Mr. Wilkins of Accomack in Virginia to receive the said cattle of Mr. Douglas into his own custody (for the use of Rich: Hamby). The said Charles Franklyn together with the said Margerie Hamby do assign & make over all the said 35 head of cattle, together with the increase, from the said Wm. Shrimpton to me the said Charles Franklin and all other goods & chattells whatsoever due me the said Margery Hamby to Rich: Hamby, son of the said Margery Hamby. And he is given full power to recover all of the cattle from Mr. Dougles & Mr. Wilkins of Accomack aforesaid or anyone else in Virginia.4 
Anecdote*9 February 1649/50 On 9 Feb 1649/50 Richard Hamby, the lawfull attorney for Charles Franklyn signed a receipt saying he received from Edward Douglas the agent of Mr. Shrimpton the full quantity of the within mentioned cattle (36) and do discharge Mr. Shrimpton & his heirs forever. (Notes: In 1678 cattle marks were recorded for John and Charles Hanby the sons of Richard Hanby. In 1703 a cattle mark was recorded for Joseph Hanby (which mark was that of his father Richard Hanby dec'd and entered for him 28 Nov. 1667 as appears in this book and now recorded by gift from his mother as he affirmed).1 
Death*before 28 March 1683He died before 28 March 1683 at Northampton Co, VA. It was on this date that his will was probated.1 
Land left*1683He left land in 1683 at tract N41, N.E. of Cheriton, Northampton Co, VA. It was in this year that he left 50 acres at the west end ot a son William which was not traced further, and the balance of his plantation called Mountney's Creek he left to wife Susanna for life and it was then to be divided among his other sons Daniel, Richard & John. In 1697 Susannah Hanby deeded 50 acres each to the 3 boys, Richard to have the "ancient plantacon" where his father had lived and this was probably was on the seaside. Later Hanby wills are neither clear nor complete, and it was not possile to trace each definitely. 1719 John Hanby left the land where I formerly lived to his daughter Ellener Jacob. In 1727 she married John Ellegood. In 1736 John and Elinor Ellegood deeded 100 acres to their son John saying it was half of the 200 acres which John Robins had sold to Richard Hanby.24
