To the Court of Accomack County in Chancery sitting - Complaining shows unto the Court your Oratrix Nancy Milliner, widow of Smith, formerly Nancy ______ that she is the only surviving child & heir of a certain Abagail Poulson, late of said County dec'd. That said Abagail Poulson departed this life in the year 1826 or 1827 at the advanced age of nearly eighty years; that for many years prior to her death she was totally blind; that her mind was also so perfectly in imbecile, unstable & childlike, that she was incompetent to make any contract which ought to bind her & that she was in all respects as regards her conduct & action subject to the influence & control of those persons with whom she resided; that said Abagail was seized in fee in the year 1825 of a small piece of land adjoining the lands now owned by James W. Twiford, formerly Matthias Outten, Richard D. Bayly heirs, James White and others containing by estimation 23 acres more or less which the only property or estate to which said Abagail was entitled or had claim; that having no other property she was entirely dependent & had been for some years upon the charity of your oratrix & her other more distant relatives; that said Abagail had at the time aforesaid lived with your oratrix for many years at great expense for board & clothing & attendance & continued for some time afterward to be an expense & bother to your oratrix for articles of necessity furnished to her; that your oratrix freely & willingly consented to submit to the inconveniences and expenses of supporting and taking care of said Abagail because she your oratrix knew that she was her only child & had no reason to doubt but that at the death of said Abagail she your oratrix would become entitled to the remnant of said Abagail's estate, to wit, the small tract of land aforesaid; Your oratrix further shows that in the year 1824 a certain James H. Milliner, now dec'd, late of said County, prevailed upon said Abagail to go his house & reside with him pretending that he would be her friend & protector, & that he would gratuitously furnish & provide for her all the comforts of life, such as food, clothing &c &c.6

Death*before 3 December 1645Henry died before 3 December 1645 at Ware, County Hertford, England. It was on this date that his will was proved. Probate to Isabella Ayre als Fitzwilliams extrix named in will. His will was not settle for several years and in Apr 1648 about 18 months before Isabel's death, her first husband's father, Henry Ayres Senior, claimed that his late son Henry Ayres Jr. in his lifetime had become indebted to his said father in the sum of £250 and gave an obligatory bond to repay the same when it became due, and if not so repaid to Henry Senior, to forfeit to the latter the penal sum of £500. Thus began a family row. On 13 May 1648 this Henry, the grandfather of the 5 sons of Henry Jr. brought suit against his dec'd son's widow Isabel and her newly married 2nd husband Robert Fitzwilliams, Gent., to get that money. The particulars of the proceedings in the Court of Chancery are long and a brief abstract of the case can be found in Ayres, Dawson & Allied Families, Vol 1, beginning on page 20..3

Biography*According to Ayres, Dawson and Allied Families, compiled by Henrietta Ayres Dawson, the Eyers (Ayre, Ayres, Eyres, Aires, Airs, Ayer, Ayers, Eyre, Eyers, Eires) came into England with William the Norman. Their lands at Battle, arose from a gift. The first of the family was named "True-Love," but at the Battle of Hastings, 14 Oct 1066, Duke William was flung from his horse and his helmet beaten into his face, which True-Love saw, pulled off, and 'horsed him again. The Duke told him, 'Thou shalt hereafter from True-Love be called 'Air' (Eyre), because thou hast given me the air I breathe.' After the battle, the Duke inquired respecting him, and found him sorely wounded, his leg and thigh 'Struck-off.' He ordered that utmost care be taken of him. On his recovery, he gave him lands in County Derby, in reward for his services and the leg and thigh in Armor, cut off for his Crest; an honorary badge, yet worn by all the Eyers in England. Several generations have intervened between the first Norman Eyre (Ayre) and the Eyres of the Wiltshire Pedigree, generally accepted as the orgin of this American family.

Severin East, Southy East and Richard East brought a chancery suit against Mary East, Asa East, Sally East and Nehemiah East. The dispute was over a tract of land in St. George Parish, Accomack County containing about three acres being the land which a certain Southy East Senior deceased resided on during his lifetime and devised to William East who died intestate and without issue in 1796 leaving both the plaintiffs and the defendants who were his siblings of the whole blood as his next of kin (there being no mother living). Since the defendants were minors, under the age of 21, they could not consent to the sale without a decree from the chancery court. William Gibb acted as guardian for the minor children. A summons was issued which ordered the defendants to appear in court on 12 March 1797.2

Land warr named in*27 May 1831Severn (of Southy) East was named in a warrent for bounty land on 27 May 1831 at Accomack Co, VA. Southy East was awarded bounty land for three years service from the state of Virginia on 27 May 1831. Jno Cropper formerly the Lieutenant Colonel of the 11th Virginia Regiment indicated on 3 January 1820 in Accomack County that Southy East enlisted a soldier in the 9th Virginia Regiment in the last of 1775 or beginning of the year 1776 and was appointed sergeant and that he served with reputation and that being before a seafaring man and seaman being wanted he was permitted to go in the naval service that he served to the end of the war and that he lived to be an old man and has been dead some years. He was a scholar and navigator. On 1 May 1820 Stephen Gunter of lawful age made oath that he well knew Severn East to be the eldest son of Southy East a solder in the army of the United States.5
Rev War Vet relative*27 March 1832He was shown to be related to a Rev War veteran on 27 March 1832 at Accomack Co, VA. Nottingham shows that Southy W. East, Severn East and Mary Bloxom, wife of Elijah Bloxom, are the only heirs at law of Southy East and Nehemiah Walker dec'd, who were in the Army of the Rev. from Virginia. Victor S. Dunn found that Southy’s heirs received a military certificate for his service. A note dated 27 May 1831 indicates he was allowed land for three years’ service as a seaman in the Virginia State Navy. A statement dated 25 June 1832 indicates that William East, Asia East, Richard East, Sarah East and Nehemiah East children and devisees of South East deceased formerly a soldier in the Revolutionary War are dead and that each died intestate, unmarried and without issue and that Severn East, Southy East and Mary Bloxom, wife of Elijah Bloxom are the only heirs at law and devisees of said Southy East now living with said Severn, Southy and Mary as the only heirs of the deceased children and also of the widow of Southy [not named] who also died intestate. Immediately below this is a statement indicating that on 29 June 1832, the Accomack County court certified that Nehemiah Walker formerly a solder in the Revolutionary War died intestate and that no will of the said Nehemiah Walker was ever proven or offered for probate.6,7
