At the court held March 1724/25, Sarah Ryly petitioned for the part of her estate that remained in the hands of Jonathan Baker, who married Mary, the widow and administrator of Benjamin Coe, who had been administrator of Sarah Coe, deceased. The estate included one cow, two steers, one sheep and six hogs. Now the Bakers failed to appear. Mary(sic) (Sarah) produced her account and swore that the animals were the balance of what was due her from the estate of her deceased mother. The court ordered that the Bakers pay Sarah the animals out of the estate of Sarah Coe, deceased, with costs and fees. (Side note: execution issued 7 November 1726.)4 
Court - named in ord12 November 1726She was named in a court order on 12 November 1726 at Accomack Co, VA. At the last court the sheriff was ordered to take into custody Jona: Baker and his wife Mary (administrators of Benjamen Coe, deceased) and keep them till they appeared at this court to answer the petition of Ralph and John Justis. Now the Bakers did not appear, and the sheriff reported that he could not take them. Considering the Bakers to be in contempt, the court ordered that the sheriff immediately raise "all ye: forces he Can for Apprehending & Takeing ye: sd Jonathan & Mary his wife, and also to brake open doores &c." When taken they were to post a bond for their appearance at the next court to answer for their contempt and respond to the Justis's petition. The order was to continue in force till they were taken.5

In 1790 John Fitzgerald united with Richard and Ann Fitzgerald in a sale to Abel Wright..3,4

Land bought*1721He bought land in 1721 at tract A62, Savageville, Acc Co, VA. It was in this year and shortly before his death that Edmund & Mary Leatherbury sold 250 acres of tract A62 to Robert Tiseker, and 20 years later the sale was confirmed by the heir Perry Leatherbury with an addition of 40 acres more. The land extended along the south side of the winding head-branch of Leatherbury's Creek and a little way east of the baysdie road, including most of the village of Savageville. In 1754 Robert Tizzaker (wife Fetaplace) left the home part to his son William and the balance to his son Joseph, but the later died 11 years later and his part went to William. In 1786 William Tizeker left all of his land to daughter Mary; she married Jacob Bird, whom she survived, and she appears in the records as Polly Bird.2

Lawsuit Named in*7 February 1684John Fitzgerald I was named in a lawsuit on 7 February 1684 at Accomack Co, VA. The suit of John Fitzgerard against Mr. Henry Jenkins was referred to the next court at the request of Mr. Anderson, Jenkins' attorney. On 27 Mar 1684, John Fitzgerrard brought action against Mr. Henry Jenkins for removing several items belonging to Fitzgerrard from Jenkins' plantation on Watts Island and for breaking and agreement they had. Fitzgerrard wanted 200 pounds sterling for the penalty in the condition and for other damages. Mr. Anderson (attorney for Jenkins) requested that the case be referred to the next court; the court persued the lists and depositions presented by Fitzgerrard and thought fit to delay the case. However, if Jenkins did not appear at the next court, then judgment would be granted against him. Henry Jenkins granted power of attorney to Mr. William Anderson. Signed 29 Nov 1683, by Henry Jenkins. On 4 Jun 1684 John Fitzgerrard sued Mr. Henry Jenkins for taking several of Fitzgerrard's items from the Jenkins plantation on Watts Island. Henry Jenkins assigned power of attorney to Benjamin Eyre, signed 16 May 1684, by Henry Jenkins. On 11 Feb 1684/85 Maj. Charles Scarburgh presented a letter from Governor Francis Lord Howard, Baron of Effingham, signifying that John Fitzgerrard had complained to the Governor about "great abuses and damages" done to Fitzgerrard by Henry Jenkins of Yorke County. As directed by the letter, the court reviewed all papers relating to the case and endeavored to reach a decision so Fitzgerrard might receive just satisfaction for the illegal practices of Jenkins. When he first started action against Jenkins Fitzgerrard only petitioned the court for several things "injurioulsy and violently taken away" by Jenkins from Watts Island; afterwards several references were granted for Jenkins' appearance. Fitzgerrard produced a schedule of goods he brought to Watts Island and which were taken away by Jenkins; part of them were later received by Fitzgerrard. The quantities of tobacco and corn were not known because Fitzgerrard had been "driven off before division of the crop." Other goods in the schedule were not found, and could not be appraised. It was ordered that Fitzgerrard, before the next court, give the court clerk an inventory of goods not yet returned by Jenkins and swear to their value. Then he could be awarded damages against Jenkins' estate if it could be found in the county. On 8 Apr 1685 John Fitzgerrard had been ordered to produce a true inventory of the goods not return by Henry Jenkins, who took them from Watts Island. Mr. Robt. Hutchinson and Mr. William Anderson were requested to value the goods and proportion them between the two men. It was ordered that Jenkins pay 2,689 lbs tobacco to Fitzgerrard. A list of the inventory was included.1

In 1765 Peter Fitzgerald sold 32 acres to Smith Snead. In 1774 Snead and his wife Sophia sold to James Lewis thie tracts he had bought from Peter Fitzgerald and from William Fitzgerald (no record). In 1785 Joseph Fitzgerald gave an unspecified acreage to is sons Elijah and Joeph. In 1793 Elijah and Sophia Fitzgerald sold 6 1/2 acres to John Cropper, 13 acres to Thomas Custis and 5 1/2 acres to Levin Walker.3

Mary's birthdate taken from Wills & Deeds 1676 1690, p. 434. Among three studies of Eastern Shore Parker families the line of this particular Parker family is omitted (Virginia Magazine of History & Biogr. 6, pp. 412 418 (1899); ibid. 61, pp. 68 79 (1953); The Mark B. Lewis Files, "Parker and Allied Families," (1958), Eastern Shore Library, Accomac, Va.) At this writing only Some Descendents of Giles Copes by A.B.P. Barnes (1988) discusses this particular Philip Parker family. The name 'Philip' is taken from Northampton Wills & Deeds 1657 1666, p. 75 which also suggests that Mary's maiden name was Fletcher. Shortly after the marriage of William and Mary, William was involved in a property possession suit vs. Richard Fletcher, also suggesting a Fletcher connection for Mary (North. Orders 1657-1664, pp. 80, 92, 173 (Nov. 12, 1660 - Aug. 28, 1663). According to the Hungars Parish Records, William and Mary had a son Thomas who died July 12, 1661 (North. Deeds, Wills 1657-1666, p. 113 (Courthouse copy), p. 134 (VSL original)). There is a fair chance that William was the father (or at least an uncle) of John Martial (b. 1666, dt. 1733/4), but so far the closest association is their sequential listing as Accomack County titheables (Accomack Titheables, 1663 1695, by S. Nottingham (1931).) In 1690 William is listed with 2 titheables. John's name first appears in 1691, and he is listed immediately after William, both of them with one titheable and resident in Col. Jenifer's precinct. When Col. Daniel Jenifer was sworn in as High Sheriff of Accomack, he presented his son Daniel of St. Thomas Jenifer as undersheriff and Mr. William Marshall as his deputy undersheriff (Wills & Orders 1682 1697, p. 161 (June 4, 1689)). By April 7, 1698 he had married Elizabeth who may have been the widow of Peter Morgan (Orders 1697 1703, pp. 24a, 31; Orders 1690 1697, p. 250a (Aug. 4, 1697)). An Elizabeth Morgane (and a Sarah Harrod) witnessed the will of Benjamin Eyre (dt. 1687). The earliest reference to a Willliam Marshall in Accomack/Northampton is his transportation by JOHN CUSTIS, Jr. on or before Oct. 5, 1657 (Cavaliers and Pioneers, Abstracts of Virginia Land Patents and Grants, 1623 1666, Vol. I (1963), by N. Marion Nugent, p. 353.) In Vol. II (p. 128) of the same reference dated May 28, 1673 in an 800 acre Northampton Co. patent granted to Christopher Thompson, William is referred to as the owner of land near the head of "Nuswatox" Creek. If the completeness of Virginia Tax Records (1983) can be trusted, a William Marshall was the only Marshall titheable in Northampton in 1666. He was also listed among Northampton titheables in 1662 and 1677. Whitelaw, p. 1061, states that in 1668 William was the renter of a 1000 acre tract in Accomack bounded on the north by Nuswatocks Creek, which is today called Parkers Creek (This tract appears to be directly east of Accomac on Metamkin Inlet.) By the time of his marriage to Elizabeth, he was residing on 333 A. of this tract, the 333 A. belonging to Mary (Parker) Selby wife of Daniel Selby (Orders 1690 1697, pp. 118, 224a). William's birthdate is taken from two depositions given in Accomack (Wills and Orders (1675), p. 293; Wills and Orders 1682 1697, p. 130.) His deathdate is presumed to be the last year in which his name appears in court records (Orders 1703 1709, p. 34 (Oct. 13, 1704) or Deeds 1692 1715(II), p. 291 (May 5, 1708)). However, a William Marshall, Gent. is referred to as one of her majesty's attorneys in the Court of Common Pleas in the City of Dublin, Ireland (North. Wills & Deeds 1725-1733, p. 81 (Aug. 17, 1731)). Some land dealings of William, Peter, and Mary Parker are detailed in Deeds, 1715 1729(I), p. 182. William Marshall registered his cattle mark and he is listed next to William Parker (North. Deeds & Wills 1651 1654, p. 230 (Jan. 22, 1665)). A Mary Parker, perhaps the dau. of Peter (dt. 1686), is a witness to one of the deeds of John Martial (dt. 1733) (Deeds 1692 1715(I), p. 117 (Feb. 27, 1693)).
