William and Sarah Black sold Richard Rodgers 300 acres of this tract; in 1728 Bennet & Temperance Scarburgh Rodgers 40 acrs of this tract; and the next year 100 acres more, for a total of 440 acres. It was on the east and north sides of the head branch of Warehouse Creek, generally known as Revell's Branch, and was the southest corner of the whole tract. In 1740 Rodgers (wife Mary) left this part of his considerable holdings to his son Daniel.7

Mary and Susanna Hutchinson, “Infants” and joint heirs of Stephen Hutchinson (deceased), petitioned that “their Mother as Executer & Gardian to them [was] unable as a woman / as she believes / to defend [their interests].” Their “first friend” Richd: Rogers Sr. was admitted to prosecute suits on their behalf. (NOTE: Their mother was Elizabeth, who had recently married John Rogers Jr, the son of Rich'd Rogers Sr.)9 
Court - namd in act*12 November 1726He was named in an action that was brought to the court on 12 November 1726 at Accomack Co, VA. "William Doright" brought action against "John Dowrong" for land that Richard Rogers Sr. (the "next friend" of Mary and Susanna Hutchinson, "infants" and co-heirs of Stephen Hutchinson, deceased) devised to Doright. The subsheriff (James Wishart) left a copy of the ejectment with John Hutchinson, the tenant in possession of the land in question. Mr. Griffith Bow Bowin (sic), attorney for Doright, appeared as did John Hutchinson, who asked to be admitted as defendant in the place of Dowrong. He was granted till the next court to "try title" of the lands in question. (NOTE: "Doright" and "Dowrong" are fictitious names.)10

Doeright” against “Jno: Doerong” for land lying in the county, Richard Rogers Sr. “next Friend” of Mary and Susannah Hutchinson, the minor daughters of Stephen Hutchinson, deceased, failed to appear to prosecute. The attorney of John Hutchinson, who entered himself as defendant, requested that the suit be dismissed, which the court did. They also awarded Hutchinson costs and fees.11

In the action of ejection brought by “WilliamDoright” against John Hutchinson for lands and appurtenances, the court found that Richard Rogers Sr., (who represented the interests of Mary and Susanna Hutchinson, the minor
children of Stephen Hutchinson, deceased) had demised the land to the plaintiff for a term. After arguing points of law, the court was of the opinion that the law favored the defendant. Ordered that the plaintiff pay John Hutchinson the costs in his suit. The plaintiff was granted permission to appeal the judgment to the next General Court; Hancock Nicholas and Thomas Gascoyne were presented as securities.12

Anecdote20 November 1622 On 20 Nov 1622 a John Rogers, an inmate in the Newgate Prison, was among those pardoned because of an epidemic of jail fever and chosen to be transported overseas, probably to Virginia. (NOTE: This may not have been the same John Rogers who settled in Accomack-Northampton County on the Eastern Shore. There was another John Rogers who settled in Northumberland County about the same time. They were both granted land patents in 1662.)4,5

The hogshead was carried to Lt. Col Robins & there taking it out of the caske, it proved to be very rotten. My master left me two days at farmer Jones house to help strike tobacco and farmer said he should lose 100 lb of tobacco if he should stripe his tobacco and having then old tobacco he threw water upon it to bring the same in case; it might wll packe & make me & my master go away without tobacco, and said he would leave his best tobacco to pay small debts. He was shown as John Rogers, aged about 63 years, who saith that being at the house of John Ranny about April last, Maj. Jno Tilney came into the house of Ranny where none were present but Ranny's wife, Darkiss Alworth, Maj. Tilney & your deponant, where I heard said Ranny & Tilney discourse about [word crossed out] which Tilney had bought of Ranny & was to receive satisfaction of Tilney in goods. Ranny went into his shop & fetched a Snaffell for a bridle & delivered it to Tilney. Your deponant said he did not see Tilney nor Ranny go forth together neither had they any private discourse concerning any agreement about a horse. The deponent saw Tilney leave the house and the deponent being supposed by Ranny his order about a difference of a horse between Ranny & Tilney and went to the house of Richard Bondack, where Darkis Allworth was to confer with her(sic) (him) about it if so any thing might come fresh into your deponent's memeory & Darkis Allworth replied she could not say any thing in the least for all the wealth of the world of any bargain or talking about a horse between Tilney & Ranny. (NOTE 1: Wm. Thorne, Timothy Coe, Thomas Harmonson (age 28), Richard Stephens (age 19), Wm. Aylworth (age 25) & Darkis Aylworth (age 29) also gave depositions. Evidently Tilney gave Ranny a horse in exchange for a woman servant and Ranny said the servant woman was at his house [near the Maryland line] and Tilney said the horse was at his house at Machipungo [which were quite some distance apart]). (NOTE 2: He was not shown as a "joyner," so perhaps there were 2 John Rogers at this time.)32

Taylor, 1,000 lbs tobacco & cask forthwith and to pay to William Taylor one table 10 foot long and a fortnights work in Spinning by the said servant and Rogers was to give 2 or 3 days days work towards triming of his Orchard. And Taylor said to Rogers, perform this bargain and the servant is yours. (NOTE: Perhaps the maid servant was Mary Hughes who had been a headright for William Taylor on a land certificate dated 29 Aug 1661 and became Taylor's indentured servant to pay back the cost of her passage to Virginia?)36

Deposition of John Cropper, aged about 18 years, 17 August 1663: Said that he never heard Thomas Osbourne say that he was ordered by John Jenkins to deliver any beast to John Rogers. When John Rogers had branded the heifer, she broke her rope and ran into the woods, and he said that he didn't care where she went now that he had branded her. Then Cropper heard Osbourne say to Rogers, "Oldman, ye had best have a care that ye go not abroad and say that I, Thomas
Osbourne, deliver to you another man's beast, for I will not do any such thing." Signed, John Cropper.44

Deposition named in17 March 1668/69He was named in a deposition on 17 March 1668/69 at Accomack Co, VA. Deposition of Elizabeth Ward aged about 29 years: William Jones, Robert Troy and Arthur, servants to Mr. Devorax Browne brought seven bottles of brandy and English spirits to Michaell Ricketts. Mr. Wise came into the house, and Miles(sic) Ricketts offered him a drink, which Wise accepted. Noting that it was good, Wise said he believed it was Mr. Browne's. Miles(sic) Ricketts answered that it belonged to his friend, the servant of Mr. Browne, who was asleep in the house. Wm. Jones lay in the cuddy, and Wise said it was "not handsome to entertain othermen's servants." Miles(sic) said they had never been there before, but Elizabeth said she had seen them three of four times, and each time they brought at least six bottles of liquor with them. Once it included five bottles of sack. One Sabbath day, Elizabeth went to look for cattle and stopped to rest at the house of Jno. Rogers, the joiner. There she saw Wm. Jones, Robt. Troy, Arthur and another man drinking from three cases of brandy and some sack. When Griffeth Savedge came to the house to borrow some tools, the drinkers ran away. Two took the branch; the two who hid in the shed thrust Elizabeth in with them, fearing she would betray them. While in the shed, she asked where they got the drink. They said they would never lack it as long as Mr. Browne had it. The old joiner came to the shed and said, "You are all children. Did not I buy as much drink the other day as cost me 300 weight of tobacco?" Arther said Mr. Browne would suspect James, who had bond given in England for his truth. Once Robt. Troy brought a parcel of linen, a pair of stockings and pair of booties[?] to Elizabeth's master's house and would have left them with her, but she would not take them, her master Miles(sic) Ricketts not being home. Signed before William Stevens on 5 March 1668/69, by Elizabeth (E) Ward.
Verdict in the case of Jno. Rogers: the same jury that tried Ricketts found cause for action and awarded Browne 2240 lbs tobacco for the goods and 1000 lbs tobacco for Rogers entertaining Browne's servants.
Deposition of Jno. Picke aged about 32 years, 18 January 1668/69: About four years ago, Picke was working at Jno. Rogers' when two servants of Mr. Devorax Browne named Wm. Jones and Robt. Troy came late one Saturday night. Rogers brought out a bottle of spirits that was hidden in the corn barrel in the loft; while they all were drinking it, Wm. Jones went out and brought in clothes. He changed his clothes, giving his soiled ones to "Old Joyner's" wife. Then he brought in four of five deer skins and sold them to Jno. Rogers for a six month old sow; Rogers was to keep it till Jones was free. Because Picke needed nails for his work, Rogers said he would borrow 300 from Mr. Thomas Fookes on Monday morning. When Picke arrived for work there was an Indian bowl full of double tens, single tens, sixes and fourpenny nails. Picke asked Rogers' son where his father had gotten them, and he answered that one of the men that was drinking there Saturday brought them; Rogers' son said he would get a beating if his father found out he told. Robt. Troy asked Rogers if that was all the drink that he and Jones left here. Rogers' wife answered that if she had not hid it, there would have been none left. Deposition of Isaac Heaman aged about 50 years, 17 March 1668/69: Said that Jno. Pike swore the truth. Signed, Isaac (I) Heaman. Deposition of Robt. Troy aged about 32 years: The first year that Troy came into the country, Jno. Rogers received from Wm. Jones and Arther Edwards, both servants to Mr. Devorax Browne, 100 lbs tobacco, a pair of plain shoes, a case of liquor, an Indian basket of nails, and a case of brandy. These things were carried there on a young mare by night during the winter of 1664/65. Signed 24 January 1668/69, by Robert Troy.48

(NOTE: If his wife was the Mary Holden, aged 49, who deposed on 16 May 1678, that a year ago last fall, Thomas Barnet came to Mary's house and asked her to spare one of her sons to assist him in his crop, it seems she would have inherited the 300 acres as she had several sons. But Whitelaw shows the land went to Edmund Custis & his wife Tabitha instead.)12,3
