That a certain Joshua Wescoat, late of this County, being in his lifetime and at the time of his death, seized in fee of and in a tract of land in this County near Franktown, adjoining the land of William Wescoat and others, and containing 180 acres, more or less, and being so seized the said Joshua Wescoat departed this life in the year 1798(sic), leaving your oratrix, Polly Wescoat, his widow, and nine children, to wit: Edmund, John, Major, George, Hezekiah, Rosey, who intermarried with John Wescoat, deceased, Vianna, who intermarried with Samuel Matthews, Polly, the wife of William Underhill and Jemima Mears, the widow of Shadrack Mears, to all of whom the said land descended equally to be divided, subject to the dower of the said Polly, the widow; That John, by deed of record in this Court, sold and conveyed his one ninth of said land to your orator Hezekiah Wescoat; that Vianna, who intermarried as aforesaid with Samuel Matthews, departed this life in the year 1817, of full age, intestate and without issue, leaving as her next of kin her mother and the aforesaid brothers and sisters, to all of whom her undivided one ninth of said land descended; that Rosey, one of the aforesaid children, departed this life in the year 1818, intestate, leaving two children, to-wit: Ann and Rosey Wescoat, infants, to whom her interest in said land descended, equally to be divided between them.3 
Heir - named as*14 March 1831Jemima was named as an heir on 14 March 1831 at Northampton Co, VA. It was on this date that Major Pitts appeared in Court and deposeth he is now in the 76th year of his age and that in 1776 he enlisted as a soldier under Capt. Smith Snead in the 9th Virginia Regiment ... and that the family of Major Pitts consists of himself, a niece named Jemima Mears, who has two children, daughters, & who owns a female slave who is the mother of four infant children..4 
Will - Uncle's*1 June 1839Jemima was named in her uncle's will on 1 June 1839 at Northampton Co, VA. In his will Major Pitts gave to niece Jemima Mears my land where I now live containing sixty acres upon condition that Jemima Mears will deed to Hezekiah P. Wescoat the twenty acres of land which she heirs from her father Joshua Wescoat. I give and bequeath to Floyd's Meeting house the sum of forty dollars. I leave all the balance of my property which I have not yet bequeathed as follows; to George Wescoat one part, to Polly G. Underhill one part, to Jemima Mears one part, to Ann Wescoat (daughter of Patty Walter) one part, and one part to be equally divided between Rosey Wescoat and Polly Wescoat (the daughter of Major Wescoat). I leave Hezekiah P. Wescoat executor. Signed with his mark, Major Pitts. Witnesses: Michael R. Matthews and Edward R. Turner. The will was recorded on 11 Nov 1839.1

Death*14 March 1831John died on 14 March 1831. It was on this date that Major Pitts, age 76, appeared in court regarding a Rev. War pension, and it was brought out that he had a niece Jemima Mears who had two daughters. So evidently her son John had died by this date..2

(NOTE: In order to witness the will, Major would have to have been at least age 21, putting his birth at or before 1748. He was possibly a brother of Littleton as he would have been too old to have been a son.)1

Land Division of*1765He was named in a division of land in 1765 at tract A69, S-E of Accomac, Accomack Co, VA. In 1722 Alexander (7) Bagwell (a brother of Henry (6) Bagwell), wife Neomy, left his part of this tract to his daughter Mary (28) Bagwell and in 1742 George Douglas sold this part to John Smith, saying it was the land he bought from Mary Smith. In 1753 John & Susanna Smith made a deed of gift to his brother William Robinson Smith for this land along with some from tract A70. In 1760 William R. Smith, wife Mary, left his land to his daughter Elizabeth. The widow Mary Robinson Smith married Fairfax Smith and 5 years later Fairfax as guardian for young Elizabeth, sued for division of her land from that belonging to her cousins Spencer and Charles Bagwell. The line was run the next year, beginning at the point in the middle at the end of the neck and extending westward to the west bounds of the tract, with the north half formally awareded to Elizabeth. She later married Thomas Custis.5

According to Whitelaw in 1805 Adah Mears and her husband William Smith sold 58 acres each to Isaac Melson and Alexander Morrison. The former was the western half and was not traced further. For a long time the Morrison part was called Morrison's Hill. No disposition by him could be found, and in some way it becamed owned by an Abel Mears and after his death the rest of the heirs in 1840 united in a deed to a son Abel. A deed in 1867 from Abel Mears called it Red Hill..2
