Biography*Her being a daughter of Stephen Massey is based on her will in which she named Caleb Massey Extr. and it was witness by Atkins Massey, who were known brothers. Being a widow with all those underage children she would have needed help from her brothers.

That a certain Finla McWilliams the elder was in his lifetime seized as of fee of and in a certain tract of land supposed to contain 400 acres, of which the premises in question is part; that being so seized on the 25 Mar. 1687, made his last will & testament and shortly afterwards died without having altered said will; that the said will was probated 16 Nov. 1687; that Finla McWilliams the younger & Overton, the sons of the said Finla McWilliams the elder, entered into the land devised them and were of their several parts respectively seized according to their several estates in the said will specified; that Overton McWilliams, one of the sons of the said Finla the elder, died leaving issue, which issue still survived at the time of the death of the said Finla the younger; that the said Finla the younger lived till 1762 and then died intestate and without issue, being seized at the time of his death of that part of the tract of 400 acres which his father, the said Finla the elder, had devised to him as aforesaid; that immediately after the death of the said Finla the younger, Charles Courtney, being the heir at law and the eldest son lawfully begotten of the body of Sarah, the daughter of the said Finla the elder, entered into the lands whereof the said Finla the younger had died seized as aforesaid, claiming title as heir of the said Sarah, who was then dead, under the will of the said Finla the elder; We also find that Mary, the wife of Abraham Turner, and only daughter and heir of the said Overton McWilliams, entered at the same time with the said Charles Courtney into the said lands whereof the said Finla the younger died seized as aforesaid, claiming title thereto as heir both of the said Finla the younger and the said Finla the elder; we find that the title to the said lands whereof the said Finla the younger died seized being in contest between the parties as aforesaid, the following deeds were respectively executed between them: A certain indenture from the said Charles Courtney to the said Abraham Turner, dated 30 Jan. 1764, & one other indenture from the said Abraham Turner dated the day and year aforesaid; we find that the said parties after the execution of the said deeds, to-wit: on the said 30 Jan. 1764, entered respectively into the lands in the said deeds respectively specified to them and remained possessed thereof; that the said Abraham Turner died on the ____ day of April, 1769 leaving issue two sons, Richard & William & three daughters Ritter, Dina & Peggy, having previously made his last will & testament; that Richard Turner, one of the said children of the said Abraham Turner, on the ____ day of ____ 1774, died an infant & without issue, and that William Turner, the younger of the two sons survived his said brother and arrived at lawful age in the year 1781; that Mary, the widow of the said Abraham Turner, having afterwards married with a certain Major Rayfield, remained on the lands which the said Charles Courtney had conveyed to the said Abraham Turner, and which are the premises in question, until the said William Turner, the younger of the two sons of the said Abraham Turner, had come to lawful age; that the said William Turner after coming to lawful age, to-wit: in the year 1781, entered upon the premises claiming title as heir of his said father whom he pretended held under the deed of the said Charles Courtney, and cleared a few acres of woodsland and built a house thereon and made other improvements; that on the ____ day of Aug. 1796, in the life of her said husband, Major Rayfield, the said Mary Rayfield died leaving issue the said William Turner, Dina, the wife of William Bull and Peggy the wife of Levi Ames, children of the first husband, Abraham Turner, and also Sarah Delastacion, an infant grandchild born of her daughter Ritter, then dec., who was a child of the said Abraham Turner, and leaving issue by the said last husband, Major Rayfield, the following children: William Betty, Major & Mary Rayfield; that Mary Rayfield, one of the children of the said Mary and Major Rayfield, after the death of her said mother, to-wit: on the 1 Sept. 1797, died an infant and without issue; We find that Major Rayfield, the husband of the said Mary the elder, continued in possession of the lands at the death of his said wife, claiming to hold the same as tenant by the curtesy; that the before named William Bull & Dianna his wife, & Levi Annis & Peggy his wife, on the 4 Oct. 1797 conveyed their right & interest in the said premises to the said Major Rayfield the elder; That Major Rayfield the elder by deed dated 21 May 1798 conveyed the said right & interest so purchased to the defendant Thomas Bayly; that on the ____ day of ____ 1799 the said Major Rayfield the elder died, and the said defendant Thomas Bayly entered into the premises claiming to hold part thereof in consideration of the right & interest conveyed to him by the said Major Rayfield aforesaid; Mears, who died without heirs and the property acquired by his grandfather Elisha Mears passed to his half brothers and sisters, children of Ann Arlington Mears by her third husband.5

Land inherited*1718He inherited land in 1718 at tract A6, Neville's or Bell's Neck, Accomack Co, VA. Simon Foscue (wife Ann) left part of this tract to two sons, as follows: John was to get the northeastern part "from Indian Landing across t othe horse bridge that leadeth out of the Neck," while Simon was to have the balance south of the above. In the processsioning records for 1732 both John and Simon Fosque are mentioned, but after that only John was reported as having land in this vicinity, so it is believed that Simon died and John inherited the whole. In 1746 John Fosque left his plantation to his wife Mary for life and then it was to be divided among their several children, but his son Nathaniel was the next owner so perhaps he claimed it all as the heir-at-law. In 1777 Nathaniel Fosque mentioned no land in his will but named his wife Ann and five children as residuary legatees. In 1796 the widow Ann, Nathaniel and Margaret Fosque, John and Mary Smith, George and Ann Smith, and Anthony and Elizabeth West joined in a deed to John Fosque for 325 acres, the deed reciting that John was the eldest son and they felt it had been the intent of the father Nathaniel to have then land go to him. In 1817 John Fosque (wife Peggy) left his land to his son Nathaniel. A recent land book showed that the souther 124 acres were owned by William T. Fosque and the upper 150 acres by S. Bayly Turlington.5 
Will - Step Mother*27 July 1719His was named in the will of his step-mother on 27 July 1719 at Accomack Co, VA. In her will Ann Fosque gave a daughter in law Elizabeth Hill my best suit of clothes, a gown, petticoat, cap and handkerchief. To daughter Barbary Blear two of my best hogs. To daughter Ann Fosque a good red rug, a smoothing iron and heaters, and my gray mare, but her first colt shall go to my grandson Clark Blear. To daughter Sarah Fosque my horse Buck. To daughter Sarah Fosque certain specifically named personal property. To son Simon Fosque my best feather bed and bolster and a negro salve called Sam, and also all the nails that I have, a drawing knife and a hammer. To son in law Henry Blear 2,000 pounds of Tobacco to put my son Simon Fosque to school for 2 years. To son in law John Fosque a cow calf. To son in law Luke Fosque. My wearing clothes to be equally divided among my 3 daughters Barbary, Anne and Sarah Fosque. Sarah Usphur and Elizabeth Bell to divide my clothes among my 3 daughters and my grandson Clark Blear. Court - nam in petit*6 December 1720He was named in a petition that was recorded in court records on 6 December 1720 at Accomack Co, VA. It was on this date that Henry Blair, borther-in-law to Symon Ffoscue, an orphan, petitioned the court, setting forth that one John Ffoscue, a half-brother to the said Symon, hath the estate of the said Symon lying in his hands, and alos that the said John doth refuse to keep the said Symon's estate, ye said Symon being under age to take care of the same or to chose his guardian, and humbly prays this court to choose a guardian for the said Symon, that such care may be taken of the said orphan and his estate by reason some of said estate is parishable. And the court taking said petition into consideration do thereupon order that the Sheriff sumon the said John Ffoscue to appear at the next court to make answer to the said petition and show cause why he doth refuse to take care of the said orphan and his estate. (NOTE: Since the orphan was under age to choose his guardian he was under the age of 14 at this time.)8

Abel Upsher (exr. of Arthur Upsher, decd.) swore to the will which was proved by the oaths of Edward Revell, John Fosque and Nathaniel Fosque. George Cutler, John Fosque, Robert Coleburn and John Bagwell (or three of them) were to appraise the Upsher estate and report to the next court.17

Death*before 29 July 1746He died before 29 July 1746 at Accomack Co, VA. It was on this date that his will was proved.18 
Land left*1746He left land in 1746 at tract A6, Neville's or Bell's Neck, Accomack Co, VA. John Fosque left his plantation to his wife Mary for life and then it was to be divided among their several children, but his son Nathaniel was the next owner so perhaps he claimed it all as the heir-at-law. In 1777 Nathaniel Fosque mentioned no land in his will but named his wife Ann and five children as residuary legatees. In 1796 the widow Ann, Nathaniel and Margaret Fosque, John and Mary Smith, George and Ann Smith, and Anthony and Elizabeth West joined in a deed to John Fosque for 325 acres, the deed reciting that John was the eldest son and they felt it had been the intent of the father Nathaniel to have then land go to him. In 1817 John Fosque (wife Peggy) left his land to his son Nathaniel. A recent land book showed that the souther 124 acres were owned by William T. Fosque and the upper 150 acres by S. Bayly Turlington.5

It was on this date that Richard Kellam Senr of Accomack gave to his son Richard Kellam Jr. of same place, 500 acres upon Occahannock Creek for his use, and entailed to such of his male issue as he Richard Jr. shall deem fitting to receive it, failing such issue then to sons Edward, William, daughter Katherine Taylor, daughter Ann Kellam (later Wallis), daughter Rachel Lingo, successively. Richard Senr & wife Sarah to have use for life.2 
Land rec'd as gift*29 January 1686/87He received land as a gift on 29 January 1686/87 at Matchepungo Creek, Acc Co, VA. It was on this date that Richard Kellam Sr. executed a Deed of Gift to his son Edward Kellam for 300 acres on Matchepungo Creek, being part of 400 acres fromerly taken up by John Evans, together with the plantation where the said Edward Kellam now lives, to begin at a branch commonly called the Beaver Dam Branch, and for want of heirs to my two sons, Richard and William Kellam to be equally divided between them, and for want of heirs to dau. Rose Garrison, and for want of heirs to dau. Bridget Kellam, alias Savage, reserving to himself and wife Sarah the use of the said lands for life.3

Land patented1705He patented land in 1705 at Wachapreague, Acc Co, Va. It was in this year that a patent was issued to Edward Kellam for tract A45. He had found 130 acres between A43 and A46 that had never been taken up. He later seated his son John on the land in his will of 1737 Edward (wife Sarah) left it to John. In 1771 John Kellam, wife Ursulla) left his home place to his son Zorobabel and 20 years later, he (wife Mary) left it "to my son Thomas in case he ever returns home, but if he does not return then to my son John Kellam for life and then to my grandson Thomas H. Kellam." In 1812 Thomas H. Kellam sold the original 130 aces to Thomas Ashby. While it was not traced further, the major part of the land later became owned by John S. Mears, and the western part by Dr. George LeCato.7 
Land deeded from*1720He deeded land in 1720 at Accomack Co, VA. It was in this year Edward Kellam gave 90 acres of tract A42 (between Quinby and Wachapreague) to his daughter Mary and her husband William Groton. This was northwest of the seaside road and between it and A41.8 
Will*18 October 1736He made a will on 18 October 1736 at Accomack Co, VA. To son John Kellam 130 acres where he now lives as it is patented in my own name, also the plantation where I now live with all the land between a branch called Bussells Branch & the line of Arthur Roberts land, containing 150 acres. To son Arthur Kellam all my land on the other side of Bussells Branch, containing 150 acres To son Richard Kellam 1 s. To daughter Mary Groton 1 s. To Grandson Benjamin Stewart 1 s. Administrator*31 January 1786Shadrack was named as administrator of an estate on 31 January 1786 at Accomack Co, VA. It was on this date that Thomas Fisher's estate was administered to Shadrack Mears with William Andrews as security. George Savage, John Young, Henry Fletcher and Robert Small, or any 3 of them, were appointed appraiser. (NOTE: Perhaps he married one of Thomas Fisher's daughter.)3 
Will - Uncle's*2 February 1796Shadrack was named in his uncle's will on 2 February 1796 at Accomack Co, VA. He was shown as a cousin (meaning nephew) Shadrack Mears in the will of Jonathan Mears.
