Bridget Custis sold 100 acres on Wallops Road (which she owned in fee simple) to Elizabeth Savage, wife of John Savage (of Rich'd), James Justice (of Ralph) and Catharine Mears, wife of Thomas Mears. It was bounded by Keziah Laws on the S.E. and on the E by James Fox & Sally Ling, on the NE by Sally Ling & John Savage and on the NW by Tinney White & James Justice. Whereas Bridget Custis is seized in right of dower of land devised to Elizabeth Savage by her father to contain 33 acres, in another tract devised as aforesaid (by his father) to James Justice containing 20 acres and a tract devised to Sinah Core of 33 acres, and also in 3 other tracts owned by Thos. Biography*When his daughter Emily L. Thornton married Charles Smith in 1884 at Oak Hall, she was shown as the daughter of Wm. Thornton of W. & Emeline Ailworth, which conflicts with him being shown as Wm. Thornton of G. in the 1860 census, but is consistent with him being shown as William Thornton of William in 1859 when he was named as a security to the estate of Delight Christopher. The "of G." could have meant he was from Guilford.
Birth*circa 1819William was born circa 1819 at Accomack Co, VA. The 1850 census puts his birth at 1820, but he had reached the age of 21 by 10 Oct 1840 when he was named as a defendant in a chancery suit..2
Will - Aunt's*12 November 1824William was named in his his aunt's will on 12 November 1824 at Accomack Co, VA. He was shown as William, son of my brother William Thornton, in the will of Easter Thornton. He was to have the land now occupied by her father after the death of her brother (his father) William Thornton.3
Anecdote10 October 1840 On 10 Oct 1840, a Chanery suit was brought into Accomack County Court: William Thornton's Admr (Plaintiff) vs. William Thornton' heirs (Defendants). The plaintiff was Littleton A. Hinman, administrator of Nancy Thornton deceased, and the defendants were William Thornton Jr. (now age 21 years) and Spencer Drummond, guardian to Nancy Thornton. The case was heard during 5 court sessions between Oct 1840 and Oct 1845. Nancy Thornton deceased was evidently their Aunt, who had died and who's estate was administered to Littleton A. Hinman on 29 Oct 1838. The details are as follows: 10 Oct 1840 - The defendant, William Thornton Jr., has arrived to the age of twenty one years ... Spencer Drummond is appointed Guardian to the defendant Nancy Thornton in the place of Lewis T. Joynes ... The plaintiff, Littleton A. Hinman as Admr of Nancy Thornton dec'd shall render an account of his transactions with the estate of his intestate ... And make an account of the debts, which may be due to the plaintiff & also of all the debts which may be still outstanding against the said Nancy Thornton dec'd ... Binding the heirs expressly, as have been paid by her Admr out of her personal estate & that he make report thereof ... to the Court. 18 Oct 1843 - A debt therein reported in favor of George Cutler ... To make the principal of the debt due George Cutler, $400 & bear interest & that the commissioner also ascertain the value of the mentioned 3/4 of the tract of land in the Bill mentioned and make report thereof to the Court. 7 June 1844 - It appearing to the Court that the commissioner's report to this term as to the real assets of Nancy Thornton dec'd embraces only a particular parcel of land, and not purporting to be all the real assets of the said decedent, and it being suggested that there are other such assets; it is ordered that the said report be re-committed with directions to the commissioner to report whether there are any other real assets of said decedent and what is their value ... 18 October 1844 - The commissioner to enquire whether any of the $400 reported due by Nancy Thornton dec'd to Peter Cutler in right of his wife Delilah Cutler formerly Delilah Thornton was applied by the latter whilst sole and unmarried, to the payment of the mortgage debt which was due by said Nancy Thornton to Thorougood Taylor, and if any such payment was mad whether the same was made at the motion and request of said Nancy Thornton and whether the whole or any part thereof was paid by the said Nancy Thornton, and that the said commissioner also enquire into ... circumstances attending such payment, and whether any settlement ever took place between the said Nancy Thornton in her lifetime and the said Delilah whilst sole or the said Peter Cutler & Delilah his wife, or either of them since their intermarriage ... And that the Sheriff ... Do make sale of the whole real estate whereof the said Nancy Thornton died seized and possessed ... by public auction to the highest bidder ... And the Court reserve consideration of all other matters until after the said report shall have been made. 25 June 1845 - That the Sheriff out of the funds reported in his hands, first pay the costs of this suit, and then pay to Dennis Clayton $313.75 with interest on $262.04 part thereof from the 20 August 1842 till paid; to George Cutler & Delilah his wife, $200 with interest from the 9 July 1836 till paid; to Littleton A. Hinman $40.38; to Thomas Lilliston assignee of Thomas A Gibbins $55.00; to Thomas Taylor $5.25; to George Cutler & wife the further sum of $104.98; to Robert P. Taylor $1.24); to Major Taylor $7.85 - And the balance pay to the defendant William Thornton Jr. 10 October 1845 - Upon motion of the plaintiff, it is ordered that this cause be reinstated on the docket and that the commissioner of Sales do convey the land ... by deed ... to the purchaser Littleton A. Himnan.4
Land sold*1845William sold land in 1845 at Guilford Creek, Acc Co, VA. After the deaths of William and Mary Thornton, in 1845 a William Thornton sold his 1/4 interest in 94 acres to Littleton A. Hinman, and the next year Hinman bought the 3/4 interest of Nancy Thornton at public auction. This was part of Whitelaw's tract A111 on Guilford Creek..5
