Rev War Veteran*1776Isaiah served in the Revolutionary War in in 1776 at Virginia. He was a private in the 9th Virginia Regiment 1776-78 and then a seaman on the schooner Betsey which was captured by the British on 12 Apr 1780 and imprisoned until May 1782..2 
Marriage*2 January 1790He married Christine Newton, daughter of Andrew Newton and Catharine Goldie, on 2 January 1790 at Accomack Co, VA.3 
Will - Brother's*5 November 1810Isaiah was named in his brother's will on 5 November 1810 at Accomack Co, VA. In his will Thomas Bagwell of St. George Parish gave to wife Peggy Bagwell the plantation on which I now reside containing 100 acres. To my half-sister Sarah Poulson the house in which she now lives with 3 acres. To my wife Peggy Bagwell the remainder part of the tract given to my sister Sarah, the whole tract containing 25 acres bounded by the county road on the west, lands of Abel Garrison on the north. Upon wife's death to brother Isaiah Bagwell the aforesaid tract of land containing 25 acres & he is to pay George Poulson, son of my sister Sarah Poulson, $100. In his will Isaiah Bagwell gave to my wife Christian Bagwell my half of the unexpired time of service of Negro man Anthony & my half of Negro children Malinda & Samuel until they arrive to age 21 & then they shall go free & Negro girl Maria to be maintained out of my estate, she being to much afflicted to set free & $400 & the balance, except those parts hereafter disposed of. To my grandson Isaiah Newton Bagwell $500 & a pair of gold sleeve buttons engraved "I. B." & my watch. To my granddaughter Anna Goldie Walston $50, … & ½ dozen silver teaspoons marked "K. G." & my interest in Negro girl Rosina until she arrives at age 21 & then she to go free. To daughter-in-law Margaret G. Bagwell ... To my great grandsons Samuel Walston & William Bagwell Walston ... To my son William Bagwell $120 & also my pension that may be due at my death. To my freed woman Silvy my Negro girl Harriet (which was born of Silvy while a slave) until Harriet comes to age 21 & then to be free. He was shown as Isaiah Bagwell the head of HH#710, a 47 year old farmer with real estate valued at $31,500 and personal estate valued at $21,000. Listed with him were Leah Bagwell, age 44; Margt G. Bagwell, age 67; Sam'l Teackle, age 65; and Isaiah N. Bagwell, age 5.8 
Will*9 December 1861Isaiah made a will on 9 December 1861 at Accomack Co, VA. In his will Isaiah N. Bagwell lent to loving wife as dower in my land during her life viz that portion of the farm called Mount Prospect where I live and the land that I cultivate, with privilege in the swamp and also the personal property indoors and out so long as she may wish to keep house. The balance of my estate she will receive as dower as the law directs. To son Isaiah Wm. Bagwell all my lands and personal estate subject to above provisions but in case he should die before he arrives at 21 without leaving a lawful child living then in the following way viz: To James Daniel Titlow at 21 years of age $2000.00. To nephew Samuel Isaiah Walston my Mount Prospect farm but if he should die before 21 or without leaving a lawful child then the same to my nephew Wm. B. Walston by his releasing to his brother and sister his interest in his mother's land purchased of Peter Shield. To my mother my Greenbush farm, 350 acres, during her life, and then together with the balance of my estate real and personal to be equally divided between Nephews and Niece William B. Walston, Thomas C. Walston, and Rose B. Walston. Executors brother-in-law William Walston and friend John D. Tyler, the former to be guardian to my son.9

Orphans Isaiah, Susannah and Elizabeth Bagwell chose Elizabeth Bagwell, their mother, as their guardian (security: William Arbuckle and Edward Revel.) Elizabeth (adm. of Thomas Bagwell dec'd) moved that John Bagwell, William Bagge, James Rule and John Parker, or two of them, audit/settle the administrative accounts and divide the estate. (NOTE: Normally you had to be age 14 or above to choose a guardian.)3

I give the remainder of my estate to be equally divide amongst all my daughters that shall be living at the time of death. I appoint my son William Bagwell and Smith Snead Extrs. Witt: Robert Coleburn, William Shacker Shield & Adoniah (his X mark) White. Signed 20 Oct 1748 by Elizabeth Bagwell. At a court held 27 Feb 1749/50 the will of Elizabeth Bagwell dec'd was proved by the oaths of Robert Coleburn, William Sacker Shield and Adaniah White and on the motion of William Bagwell and Smith Snead the Extrs therein named taking oath, certificate is granted them for obtaining a probate thereof in due form. The following was recorded separately: That Elizabeth Bagwell dec'd a few days before her decease devised and ordained that her Negro girl Hannah should be equally divided between her 3 daughters Elizabeth, Adah and Ann, they paying 2 pounds 10 shillings to Isaiah Bagwell her son. Sworn before me, Thomas Parramore, 11 Jan 1749/50.4 
Est Settm't Father's*27 December 1748He was named in the settlement of his father's estate on 27 December 1748 at Accomack Co, VA. Pursuant to and order of Accomack Court held 31 Mar 1748, we have audited and divided the estate of Thomas Bagwell dec'd according to the inventory that was produced to us. The widow and her 3 eldest children viz: William, Sophia and Susannah are paid each of them their particular parts of the estate and the younger 4 children viz: Elizabeth, Isaiah, Adah & Anna their particular parts of the estate was left in the hands of the widow, their mother, which is here to annexed. Signed: 27 Dec 1748 by John Bagwell & James Rule. A list of inventoried items & values followed.5 
Guardian - chose27 March 1750He chose a guardian on on 27 March 1750 at Accomack Co, VA. Isaiah Bagwell (orphan of Thomas Bagwell) chose George Parker (security: Mitchel Scarburgh). His sisters Elizabeth and Adah Bagwell chose William Bagwell (security: Smith Snead). Ann Bagwell (orphan of Thomas Bagwell) had appointed for her Smith Snead (security: William Bagwell).6 
Land inherited*circa 1753He inherited land circa 1753 at tract A66, east of Locustville, Accomack Co, VA. In 1713 Thomas Bagwell (his wife was living but not named in the will) left his home plantation to his son Thomas, who (wife Elizabeth) died intestate in 1740 and was succeeded by a son William. In 1753 he also died intestate and is belived to have been followed by a son Isaiah, who (wife Sarah) left a will in 1764, but made no mention of his lands, so after that date there is a good deal of uncertainty about the title. In 1783 processioning returns showed a Stephen Bagwell and a John Kellam to have been the landowners in this vicinity. (NOTE: Whitelaw was evidently mistake about William having a son Isaiah, as it appears that it was his brother Isaiah who died in 1764.)7

That a certain William Burton formerly of Accomack County, now dec., having a daughter then married to a certain John West, made his last will and testament in which he devised a number of slaves to his said daughter for life then to be equally divided between all her children; that the said Agnes West had nine children, one of whom named Katharine intermarried in her mother's lifetime with a certain Edmund Chambers and died before her mother and before any division could be made of said slaves; that after the death of the said Agnes the said Edmund Chambers obtained administration on the estate of his said wife, who was one of the said nine children, and a division was made among the complainants under the said Burton's will after a long and tedious litigation, and a slave named Lazar was alotted to the representative of the said Edmund's deceased wife without determining whether the right to the said slave vested in the son or the administrator of the deceased, as also the sum of 21 £ 16 s. and 8d for the proportion of the rent of the said slaves with interest from 23 Nov. 1766; that in consequence of the said partition and administration the said Edmund obtained possession of the said slave sometime in the year 1767 and sold him to your orator for a valuable consideration; that the said Snead held the said slave until sometime in the beginning of the year 1768 when he was spirited away and seduced from his service by Major Chambers, the son and heir of the said Catherine Chambers, one of the nine children aforesaid, and by a certain Jonathan Willett, and by them, after the said Willett had kept him in possession ____ years sold to the respondent &c. Catherine Chambers left at her death Major Chambers, her only son and heir at law, and a daughter Agnes. The defendant in his answer denies that the said Edmund Chambers had any right to any part of the slaves devised by William Burton, but only in right of his son, Major Chambers, one of the defendants; and that this will appear evident from a suit in chancery commenced in this Court by Jonathan Willet and Agnes, his wife, Garrat Topping and Scarburgh, his wife, Charles Crowson and Comfort, his wife, and Major West then plaintiffs vs. John West, Smith Bunting, Major Chambers, one of the present defendants, Thomas Goffigon & George Scott then defendants, in which it was decreed that the slaves devised to the said Agnes should be equally divided between the parties plaintiff and defendant, children and grandchildren of the said Agnes. Decreed that the plaintiff, Charles Snead, was a fair purchaser of Edmund Chambers whose property the said slave was, and that he recover the said slave Lazor of the defendant (Jonathan Willett m. Agnes West, Charles Crowson m. Comfort West, Garret Topping m. Scarburgh West, George Scott m. Susanna West, Thomas Goffigon m. Elizabeth West, Smith Bunting m. Anne West, Edmund Chambers m. Katherine West, daughters of John West & Agnes (Burton) West, who had nine children, the above named seven daughters and two sons, John & Major).19 
Anecdote*1772 Albert James Willett Jr. in his book Poquoson Families III shows that there were 2 Garrett Toppings in Accomack Co, VA. The elder Garrett Topping (1734-1772) married Scarburgh West about 1755 and died in 1772 and his son Garrett Topping (1757-1817) married Scarburgh Snead 22 Mar 1785. The Accomack County Order Books of this time period, abstracted by JoAnn Riley McKey, with an every name index, were searched and there was no mention of a Garrett Topping Sr and a Garrett Topping Jr and no mention of a Garrett Topping dieing in 1772. So until proof of the 1772 death is found, it is assumed that there was only one Garrett Topping in Accomack Co, VA who married 1st Scarburgh West and 2nd Scarburgh Snead, as shown in AP&P, 4th Ed, by John F. Dorman.20

And they further certify that said Garret Topping hath errected such buildings on the said lott as are required by law to secure the possession & fee simple estate. Witt: Wm. Snead, Tully Snead & Wm. Satchell Junr. According to Whitelaw this was Lot No. 10 in Onancock..27,28

Bennett Scarburgh & George Scarburgh, heirs & devisees of Henry Scarburgh dec'd, both of St. George Parish, Accomack Co, sell 150 acres for £195 Virginia money to Garret Topping of the same place the following tract of land in aforesaid Parish & Co bounded on the North East corner by George Teackle, Northeasterly by Henry Custis, Northwesterly by Henry Custis & William Finney; on the Westerly by William Finney & heirs of George Holden dec'd, being part of a larger tract whereof the aforesaid Henry Scarburgh died seized. Witt: John Wise, Tully Snead & Zero Rodgers. According to Whitelaw Garret Topping bought 150 acres (part of Whitelaw's tract A54) from Bennett & George Scarburgh, who left 75 acres each to his sons John S. and Nathaniel S., the later to get "the mannor part of my plantation." The house (Whitelaw's A54E) was known both as the Topping Place and the Dahl's Swamp House. The quaint little house stands well back in the swamp, and it must have been built by Garret Topping soon after his purchase in 1792.34,35

Anecdote*1812 According to Whitelaw, in 1812 Garret Topping's widow Anne Topping exchanged Lot No. 10 in Onancock for land elsewhere with Patience Laylor and Elizabeth Jacob, and 2 years later Levin and Patience Laylor sold their interest to James Ashmead, who had married Elizabeth Jacob. The deed stated it was the lot "whereon the tavern is now kept," so if it happend to have been at the east end fo the lot, it would have been approximately where Taylor's Inn is now operated (1953). (NOTE: Whitelaw must have been mistaken on this Anne Topping being Garret's widow, as Garret was found about 5 years later freeing a slave. The deed showed that she was exchanging her dower rights, but it did not show her as a widow of Garret Topping.)50
